{"id":99635,"date":"2025-02-20T15:07:53","date_gmt":"2025-02-20T15:07:53","guid":{"rendered":"https:\/\/peraltafinancing.com\/business\/legal\/exportlawblog-newsweek-gets-confused-by-ofac-travel-rules\/"},"modified":"2025-02-20T15:07:53","modified_gmt":"2025-02-20T15:07:53","slug":"exportlawblog-newsweek-gets-confused-by-ofac-travel-rules","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=99635","title":{"rendered":"ExportLawBlog \u00bb Newsweek Gets Confused by OFAC Travel Rules"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"post-9260\">\n<div class=\"entry\">\n<p><span style=\"float: left; margin: 0px 20px 0px 0px;\"><img decoding=\"async\" title=\"Image via https:\/\/pixabay.com\/p-1202440\/?no_redirect [Public Domain]\" src=\"https:\/\/www.exportlawblog.com\/images\/cuba_cars.jpg\" alt=\"Image via https:\/\/pixabay.com\/p-1202440\/?no_redirect [Public Domain]\" width=\"170px\" \/><\/span>Last week the State Department <a href=\"https:\/\/www.reuters.com\/article\/us-cuba-usa\/us-state-department-softens-travel-advisory-on-cuba-idUSKCN1L82GL\">changed<\/a> its travel advisory on Cuba from \u201creconsider travel\u201d to \u201cexercise increased caution.\u201d\u00c2\u00a0 The \u201creconsider travel\u201d warning was apparently based on the sonic attacks on diplomats in Cuba.\u00c2\u00a0 The decision to change to \u201cexercise increased caution\u201d came after the State Department concluded that sonic attacks on private U.S. citizens was unlikely.<\/p>\n<p>Still this business of travel warnings appear to have little, if any, relation to the actual safety of the destination.\u00c2\u00a0 There are no warnings about the safety of travel to Belize even though between 2009 and 2016, 16 Americans were murdered in Belize.\u00c2\u00a0 That put Belize as the seventh most dangerous country for Americans as measured by its\u00c2\u00a0 <a href=\"https:\/\/priceonomics.com\/ranking-the-most-dangerous-countries-for-american\/\">death rate of 1.02 per 100,000<\/a> American tourists.\u00c2\u00a0 During that same period, only two people were killed in Cuba giving it a <a href=\"https:\/\/data.world\/travelwarnings\/travel-danger\/workspace\/file?filename=DeathsPerCapita%281%29.csv\">death rate of 0.08 per 100,000<\/a> American tourists, approximately 12 times lower than that of Belize.\u00c2\u00a0\u00c2\u00a0Of course, given the U.S. homicide rate of\u00c2\u00a0\u00c2\u00a0<a href=\"https:\/\/fivethirtyeight.com\/features\/the-u-s-murder-rate-is-up-but-still-far-below-its-1980-peak\/\">5.3 per 100,000<\/a>, it\u2019s probably safer to travel to Cuba, or even Belize, than to stay home in the United States.<\/p>\n<p>A number of news sites commented on this change.\u00c2\u00a0 But one of them, namely <em>Newsweek<\/em>, caught my eye when it decided to add <a href=\"https:\/\/www.newsweek.com\/can-i-travel-cuba-us-no-longer-says-you-should-not-go-still-restrictions-1090152\">this statement<\/a> about travel to Cuba:<\/p>\n<blockquote>\n<p>\u00c2\u00a0The only legal way for U.S. citizens to travel there is by applying to the Treasury Department\u2019s\u00c2\u00a0Office of Foreign Assets Control for a license under one of 12 categories of travel.<\/p>\n<\/blockquote>\n<p>Good grief.\u00c2\u00a0 Is Google not working at <em>Newsweek<\/em> these days?\u00c2\u00a0 Those twelve categories mentioned in the quote are for <em>general licenses<\/em>, you know, the ones that do not\u00c2\u00a0require a specific OFAC license application.\u00c2\u00a0 In case the <em>Newsweek<\/em> reporter wanders by and reads this post, here is the <a href=\"https:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=93199d536b6dbd8e16eb346881e58f62&amp;mc=true&amp;node=se31.3.515_1560&amp;rgn=div8\">link<\/a> to the OFAC regulation noting that general licenses are available for each of those categories.<\/p>\n<p>So, as you\u2019ve heard before, don\u2019t believe everything you read on the Internet unless, of course, you read it here.<\/p>\n<p>\t\t\t\t<span style=\"font-size:0.8em;\"><plusone size=\"small\" count=\"false\" href=\"https:\/\/www.exportlawblog.com\/archives\/9260\"><\/plusone> <img decoding=\"async\" src=\"https:\/\/www.exportlawblog.com\/images\/permalink.gif\" alt=\"\" \/><a href=\"https:\/\/www.exportlawblog.com\/archives\/9260\" rel=\"bookmark\">Permalink<\/a>  <\/span><\/p>\n<div><a class=\"addthis_button\" href=\"http:\/\/www.addthis.com\/bookmark.php?v=250&amp;username=clifburns\" addthis:url=\"https%3A%2F%2Fwww.exportlawblog.com%2Farchives%2F9260\" addthis:title=\"Newsweek+Gets+Confused+by+OFAC+Travel+Rules\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/s7.addthis.com\/static\/btn\/v2\/lg-share-en.gif\" width=\"125\" height=\"16\" alt=\"Bookmark and Share\" style=\"border:0\" \/><\/a><\/div>\n<p><!-- AddThis Button END --><br \/>\n<br \/>\nCopyright \u00a9 2018 Clif Burns. I\u2019d bet fifty CUC that Newsweek has sent personnel to Cuba under the general license at 515.563 within the past five years.<\/p>\n<p>2.  In O\u2019Connor\u2019s defense, the distinction between specific and general licenses is easy for non-experts to miss.  Several months ago I had a circular and slightly entertaining hour-long phone call with a CBP officer who was adamant that he would accept only a license \u201con OFAC letterhead,\u201d and not my written declaration and explanation regarding the perfectly applicable general license in Part 515.  The concept of general licenses existing in the text of the CACR just wasn\u2019t computing for him\u2013he was positive he needed to see a case-specific document from OFAC.
