Kay Ivey signed into law SB79, the \u201cWhat is a Woman Act,\u201d which will codify definitions for terms like \u201cman\u201d and \u201cwoman\u201d into state law.<\/p>\n<p>The act is now the first bill signed into law during the 2025 Legislative Session after Republicans rushed it through the state Legislature last week. The bill\u2019s sponsors, Sen. April Weaver, R-Brierfield, and Rep. Susan DuBose, R-District 45, have characterized it as one of \u201csimple definitions\u201d meant to aid in record-keeping and legal decision-making.<\/p>\n<p>However, the new law has also been the subject of <a href=\"https:\/\/www.alreporter.com\/2025\/02\/12\/house-health-committee-approves-three-bills-including-what-is-a-woman-act\/\">heavy criticism<\/a> on numerous grounds. Everyday Alabamians and LGBTQ+ advocacy groups, like the <a href=\"https:\/\/www.alreporter.com\/2025\/02\/10\/alabama-transgender-rights-action-coalition-criticizes-algops-what-is-a-woman-bill\/\">Alabama Transgender Rights Action Coalition<\/a>, have argued that the law is actually a targeted attack on the rights and liberties of transgender and nonbinary Alabamians.<\/p>\n<p>Experts have also pointed out that the law itself operates under an inaccurate understanding of sex and gender, specifically noting that the law\u2019s description of sex as being unchangeable is inaccurate, and that the law largely discredits the existence of intersex people.<\/p>\n<p>The Republican-led legislature has also been criticized for the unusual methods used to hastily move the bill to the governor\u2019s desk. On Wednesday, the House passed the bill after <a href=\"https:\/\/alabamareflector.com\/briefs\/ivey-signs-bill-putting-sex-based-terms-into-alabama-law\/\">limiting debate<\/a> on the issue to under 10 minutes.<\/p>\n<p>The bill also passed without the inclusion of an amendment introduced by Rep. Neil Rafferty, D-Birmingham, which would have prohibited surveillance in spaces like restrooms and changing rooms.\u00a0<\/p>\n<p>\u201cIf this bill was really just about \u2018common-sense definitions,\u2019 this common-sense amendment would\u2019ve passed easily,\u201d ALTRAC volunteer Hunter Fuller told the Alabama Reflector last week.\u00a0<\/p>\n<div class=\"code-block code-block-6\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div class=\"zox-post-ad-wrap\"><span class=\"zox-ad-label\">Advertisement. Scroll to continue reading.<\/span><\/div>\n<\/div>\n<p>The Reflector\u2019s Brian Lyman also argued that the law opens the door to <a href=\"https:\/\/alabamareflector.com\/2025\/02\/17\/that-anti-transgender-bill-is-even-worse-than-you-think\/\">sex-based segregation<\/a> in the state, quoting a section of the law that reads, \u201cNeither the state nor any political subdivision of the state shall be prohibited from establishing separate single-sex spaces or environments for males and females when biology, privacy, safety, or fairness are implicated.\u201d<\/p>\n<p>Despite the legislation\u2019s supporters celebrating the act as a win for women\u2019s safety, Lyman suggested that it will actually harm Alabama women in the long-run by giving \u201cpublic officials and entities an unchecked ability to decide the nature of \u2018fairness\u2019 and \u2018security\u2019 for men and women.\u201d<\/p>\n<p><!-- CONTENT END 1 -->\n\t\t\t<\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>On Thursday, Gov.
