The brilliant cartoonist, Wiley Miller (\u201cNon
\nSequitur<\/a>\u201d), captured the misunderstandings between men and women as few
\nothers have. For example, the wife says: \u201cLet’s go shopping.” The husband
\nhears: “Let’s go drain the life force from your body.” The husband
\nsays: \u201cHoney, are you almost ready yet?” The wife hears: “Life as we
\nknow it will cease to exist unless you can alter the space-time
\ncontinuum.”<\/p>\n

My experience with jurors has led me to conclude that
\nsimilar misunderstandings occur regularly in the Courtroom between attorneys
\nand jurors. For example, the lawyer says: \u201cNegligence.\u201d The juror hears:
\n\u201cForgetfulness.\u201d The lawyer says \u201cProximate.\u201d The juror hears \u201cApproximate.\u201d
\nThe lawyer says: \u201cStandard of care.\u201d The juror hears: \u201cLike OSHA.\u201d The lawyer
\nsays: \u201cPreponderance.\u201d The juror hears: \u201cHeavy thinking.\u201d<\/p>\n

I could go on and on. Lawyers like to say a graphic will
\n\u201cdepict\u201d things. Jurors need to know what the graphic will \u201cshow.\u201d The lawyer
\nsays this event was \u201cprior\u201d to the current one. Jurors want to know what came
\n\u201cbefore\u201d what. And \u201caforementioned\u201d doesn\u2019t even compute.<\/p>\n

You must speak a language the jurors understand if you are
\nto persuade them. For example, explain legal terms such as negligence so there
\ncan be no confusion with the more common use of the term, forgetfulness. Use
\nwords you used before you became a lawyer: familiar words, easy-to-understand
\nwords, words that don\u2019t require more than a high school education.<\/p>\n
