Judgment of acquittal passed by
\nthe Chhattisgarh High Court in a case of marital rape where the wife died due
\nto the sexual brutality of the husband is nothing but a mockery of justice. The
\ncase belongs to the Jagdalpur district of Chhattigarh. The accused husband, a
\ndriver, committed unnatural sex with his wife, and left her in pain, who died
\nin a hospital. <\/span>In her dying declaration, recorded before a
\nmagistrate, the victim alleged that her husband had inserted his hand in her
\nanus, following which she suffered excruciating pain.<\/span><\/p>\n

The woman was admitted to
\nthe hospital for treatment, from where a report was made to the police station
\nconcerned and the offence under IPC Section 377 (unnatural sex) was registered
\nagainst her husband.<\/span><\/p>\n

The Indian Evidence Act,
\n1872, under Section 32 deals with the concept of a \u201cdying declaration\u201d.
\nUsually, a dying declaration is only admitted as evidence in cases where the
\ncause of a person\u2019s death comes into question. This concept is based on the
\nLatin legal maxim \u201cnemomoriturus prae-sumitur mentire\u201d\u00a0which means a man
\nwill not meet his maker (God) with a lie in his mouth.<\/span><\/p>\n

In Naeem vs the State of
\nUttar Pradesh, the Supreme Court ruled that a dying declaration can be the sole
\nbasis of conviction, but courts must find it to be trustworthy, and one that
\ninspires confidence.<\/span><\/p>\n

Notably, in this case, the
\ndoctor who had conducted a postmortem of the deceased\u2019s body had said there
\nwere \u201ctwo perforations on the rectum\u201d, one on the anterior side and another
\nabove the pelvic floor, causing him to conclude that the victim died on 11 December
\n2017, as a result of the same.<\/span><\/p>\n

In February 2019, a trial
\ncourt at Jagdalpur convicted the husband\u00a0<\/span>under
\nSections 376 (rape), 377 (unnatural sex), and 304 (culpable homicide not
\namounting to murder) of the Indian Penal Code (IPC)<\/span>, and sentenced him to 10
\nyears rigorous imprisonment and a fine of Rs 1,000. <\/span>However,
\nthe Chhattisgarh High Court later acquitted him, citing the marital rape
\nexception under Section 375 IPC, which states that sexual intercourse by a man
\nwith his wife, if she is above 15 years of age, is not considered rape. Here
\nthe wife was said to be over 15 years.<\/span><\/p>\n

It also cited the
\nfive-judge SC bench\u2019s ruling in Navtej Singh Johar vs Union of India (2018) to
\nsay that if an \u201cunnatural offence is done with consent, then the offence of
\nSection 377 IPC is not made out\u201d.It is ridiculous to say that the wife
\nconsented\u00a0to her husband to insert his hand in her anus.\u00a0The law, it
\nis often said is like an ass but all the same, it is also true that insensitive
\njustice is no justice. This decision was the height of insensitivity.\u00a0<\/span><\/p>\n

Most women,
\nfrom a very young age, are sold the idea that safety and prestige come with
\nmarriage. However, ironically, marriage becomes just another apparatus in
\npatriarchy\u2019s arsenal, to perpetuate violence, as was seen in this case.\u00a0<\/span>Rape isn\u2019t merely about a violation of a person\u2019s consent but also
\ninvolves an assertion of power that men enjoy in a patriarchal society.<\/span><\/p>\n

The central argument against criminalising marital
\nrape is the fear of its misuse, a reiteration of each time when laws have been
\nproposed for the protection of the marginalised.\u00a0This decision of the
\nChhattisgarh High Court is a clear miscarriage of justice and very shocking.
\nSex with a wife without her consent may fall within exception 2 in section 375
\nbut extreme brutality resulting in her death is frightening, to say the least.<\/span><\/p>\n
