Ins. Code \u00a7 2071<\/a><\/em>. In 2024, the California Supreme Court interpreted this to include causes action for breach of contract and breach of the covenant of good faith and fair dealing, but not a cause of action under California\u2019s Unfair Competition Law seeking declaratory and injunctive relief, which has a four-year statute of limitations. <a href=\"https:\/\/scholar.google.com\/scholar_case?case=2357402831342000890&amp;q=16+Cal.+5th+520&amp;hl=en&amp;as_sdt=40006\" target=\"_blank\" rel=\"noopener\"><em>Rosenberg-Wohl v. State Farm Fire &amp; Cas. Co.<\/em>, 16 Cal. 5th 520, 537 (2024)<\/a>. For a loss occurring during a State of Emergency, the time is extended to 24 months. Cal. Ins. Code \u00a7 2071.<\/p>\n<p>The applicable time to file suit starts running at the \u201cinception of the loss.\u201d <em>Id. <\/em>It is \u201cequitably tolled,\u201d meaning \u201cpaused,\u201d once the claim is submitted. <a href=\"https:\/\/scholar.google.com\/scholar_case?case=2535129002092057456&amp;q=51+Cal.3d+674&amp;hl=en&amp;as_sdt=40006\" target=\"_blank\" rel=\"noopener\"><em>Prudential-LMI Com. Insurance v. Superior Court<\/em>, 51 Cal.3d 674, 687 (1990)<\/a>.\u00a0 The adjustment ends when the insurer \u201cunequivocally\u201d denies the claim, in whole or in part. <a href=\"https:\/\/scholar.google.com\/scholar_case?case=5250607951593250077&amp;q=63+Cal.+App.+4th+135&amp;hl=en&amp;as_sdt=40006\" target=\"_blank\" rel=\"noopener\"><em>Singh v. Allstate Ins. Co.<\/em>, 63 Cal. App. 4th 135, 140 (1998)<\/a>. An insurer\u2019s reconsideration of a denial does not reopen the statute of limitations. <em>Id. <\/em>Equitable tolling is a case law principle and is not found in any statutes or regulations.<\/p>\n<p>Insurers are required to actively alert insureds to any applicable statutes of limitations at least 60 days in advance. <em><a href=\"https:\/\/govt.westlaw.com\/calregs\/Document\/IE642F9A05C2F11EC9C68000D3A7C4BC3?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)#:~:text=(f)%20Except%20where,the%20claim%20matter.\" target=\"_blank\" rel=\"noopener\">10 Cal. Code Regs. \u00a7 2695.7(f)<\/a><\/em>. Failure to comply further tolls the statute of limitations until 30 days after notice is actually provided. <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=INS&amp;sectionNum=2070.1.\" target=\"_blank\" rel=\"noopener\"><em>Cal. Ins. Code \u00a7 2070.1<\/em><\/a>. Failure to notify the insured prevents the insurer from asserting the defense. <a href=\"https:\/\/scholar.google.com\/scholar_case?case=8360207661393061560&amp;q=71+Cal.+App.+4th+1260&amp;hl=en&amp;as_sdt=40006\" target=\"_blank\" rel=\"noopener\"><em>Spray, Gould &amp; Bowers v. Associated Internat. Ins. Co.<\/em>, 71 Cal.
