For instance, of the 53.5 million acres in Idaho that make up its land mass, 34.5 million, or nearly 65 percent, are federally-owned, according to the <a href=\"https:\/\/www.idl.idaho.gov\/about-us\/land-board\/federal-lands-task-force\/\">Idaho Department of Lands<\/a>. While landowners may have rights to what\u2019s on the surface, the area below may belong to the government if the land is a federal-private split estate.<\/p>\n<p>A session at the 3<sup>rd<\/sup> Annual Western Water, Agricultural, and Environmental Law Conference will detail federal-private split estates, particularly those existing under the Stock-Raising Homestead Act of 1916, or SRHA. Holland and Hart LLP Associate <a href=\"https:\/\/www.hollandhart.com\/kdriker\">Katy DeVries Riker<\/a>, who specializes in environmental and natural resource law, will lead the session, titled, \u201cFederal-Private Split Estate: Considerations for Living and Operating on Stock-Raising Homestead Act Lands.\u201d<\/p>\n<p>After it was enacted over a century ago, the SRHA resulted in millions of acres of public lands being privatized.<\/p>\n<p>\u201cWhile the SRHA provided homesteaders with the ability to own and occupy the land\u2019s surface, it severed and reserved what\u2019s below the surface \u2013 or the mineral estate \u2013 to the U.S.,\u201d Riker said. \u201cIt\u2019s had a tremendous impact on our country and how landowners are allowed to operate, especially in the Western U.S. It is still a topic that raises many questions for those who live and run their agricultural operations on these lands.\u201d<\/p>\n<p>During the session, Riker will discuss the continued impact of the SRHA on lands today and\u00a0explore the relationship between surface owners, entities seeking to\u00a0develop minerals, and\u00a0the Bureau of Land Management, which manages federally owned minerals.<\/p>\n<p>The Western conference is co-hosted by the National Agricultural Law Center, or NALC, and the National Association of State Departments of Agriculture Foundation, or NASDA Foundation. The program will be held June 19-20 in Reno, Nevada, and features a livestream option.
