Rare is the witness who isn\u2019t anxious, worried, scared–even
\nterrified–during deposition or cross-examination. Often this leads to a rapid
\npace of speech. Not only that, but witnesses tend to believe that if they just
\nblurt out their response, they\u2019ll get this dreadful experience over with
\nsooner.<\/p>\n

Now, there\u2019s nothing wrong with speaking quickly, in and of
\nitself, but speaking quickly often means the client fails to think things
\nthrough. Failing to think through a response can often lead to flawed testimony
\nif not downright disastrous testimony. Unfortunately, simply telling a witness
\nto \u201cslow down, speak more slowly\u201d may work for a response or two, but with the
\npressure of nerves, the witness\u2019s pace then picks up rapidly.<\/p>\n

One technique that works well while preparing the witness
\nfor their testimony is to encourage the witness to speak in full sentences and
\nto do so by first repeating part of the question. This has two advantages.
\nFirst, it forces the witness to listen better to the question asked. You can\u2019t
\nvery well repeat part of the question if you haven\u2019t carefully listened to it.
\nSecondly, it slows the response down. The witness is forced to think through
\ntheir whole response, to concentrate. And that ensures better testimony.<\/p>\n

For example, in response to \u201cHow soon after this meeting of
\nMay 22 did you visit the construction site?\u201d \u201cI visited the construction site
\nnext on May 30\u201d slows the response down, as opposed to a simple \u201cMay 30.\u201d It
\nalso helps the witness stay on track with the subject at hand.<\/p>\n

This is even more critical with a compound question. For
\nexample, \u201cDo you know whether you saw water in the trench or ever examined that
\ntrench before May 30?\u201d The quick response of \u201cNo\u201d could be inaccurate as to
\neither seeing the water or examining the trench. A full-sentence response, such
\nas \u201cI did examine the trench before May 30, and I did not see water in the
\ntrench before May 30\u201d may be wordy but could be more accurate.<\/p>\n

Full sentences work to slow the witness down so that their
\nbrain is engaged before the response and to produce a more accurate response.<\/p>\n
