This article explains what constitutes a valid waiver and how to properly plead it in court when seeking to enforce a partition waiver.  <\/p>\n<h2 class=\"wp-block-heading\" id=\"h-what-is-a-waiver-of-partition\"><span id=\"What_is_a_Waiver_of_Partition\">What is a Waiver of Partition?<\/span><\/h2>\n<p>In California, a \u201c<a data-type=\"post\" data-id=\"14499\" href=\"https:\/\/talkovlaw.com\/types-of-co-ownership-in-california\/\">co-owner<\/a> of property has an absolute right to a partition unless barred by a valid waiver.\u201d The California <a data-type=\"page\" data-id=\"14492\" href=\"https:\/\/talkovlaw.com\/partition-statutes\/\">partition statutes<\/a> explain that \u201cpartition as to\u2026the property shall be as of right unless barred by a valid waiver.\u201d<\/p>\n<p>\u201c\u2019Waiver\u2019 means the intentional relinquishment or abandonment of a known right. Waiver requires an existing right, the waiving party\u2019s knowledge of that right, and the party\u2019s actual intention to relinquish the right. Waiver always rests upon intent. The intention may be express, based on the waiving party\u2019s words, or implied, based on conduct that is so inconsistent with an intent to enforce the right as to induce a reasonable belief that such right has been relinquished.\u201d<\/p>\n<figure class=\"wp-block-embed is-type-wp-embed is-provider-talkov-law-partition-attorneys wp-block-embed-talkov-law-partition-attorneys\"\/>\n<h2 class=\"wp-block-heading\"><span id=\"Which_Party_Must_Raise_Waiver_of_Partition\">Which Party Must Raise Waiver of Partition?  <\/span><\/h2>\n<p>\u201cCase law is clear that waiver is the intentional relinquishment of a known right after knowledge of the facts. The burden \u2026 is on the party claiming a waiver of a right to prove it by clear and convincing evidence that does not leave the matter to speculation, and doubtful cases will be decided against a waiver.\u201d<\/p>\n<p>An argument exists that the co-owner seeking to block a partition because the other co-owner(s) waived their right to pursue it has the burden to demonstrate clear and convincing evidence of a waiver. Generally, the party who asserts a waiver of partition will be required to prove the other co-owner(s) knew of their right to partition and intentionally relinquished that known right<\/p>\n<h2 class=\"wp-block-heading\"><span id=\"Does_Waiver_Need_to_be_Pleaded_as_an_Affirmative_Defense\">Does Waiver Need to be Pleaded as an Affirmative Defense?<\/span><\/h2>\n<p>A California court has articulated that \u201c[t]he facts showing the <a href=\"https:\/\/talkovlaw.com\/affirmative-defenses-partition-action-california\/\" data-type=\"post\" data-id=\"5438\">affirmative defense<\/a> of waiver must be pleaded.\u201d Indeed, in a case where: \u201cThe Board\u2019s answer alleged merely: \u2018Plaintiff\u2019s claims are barred in whole or in part by the doctrine of waiver,\u2026. [The] affirmative defense consist[s] of legal conclusions that could survive neither a demurrer nor a motion for judgment on the pleadings.\u201d<\/p>\n<p>To plead <a data-type=\"post\" data-id=\"18795\" href=\"https:\/\/talkovlaw.com\/waiver-right-to-partition\/\">waiver of partition<\/a>, a party would need to sufficiently plead the facts that establish a waiver including the manner of communication, i.e., in writing, orally, or implied by conduct.
