\u201cNo matter what.\u201d<\/p>\n

These are chilling words to hear from any law enforcement official.\u00a0 After all, given the enormous stakes involved in a criminal prosecution<\/a>, restraint has to be the operative word.<\/p>\n

It is thus particularly concerning when these words are uttered by the chief federal law enforcement official for the nation\u2019s capital and when the words are targeted at specific groups \u2014 Antifa and Black Lives Matter \u2014 without any evidence of those groups\u2019 involvement in the criminal activity in question.<\/p>\n

The new U.S. Attorney for D.C., Edward R. Martin, used these three words in his open letter<\/a> to Elon Musk pledging to protect members of Musk\u2019s Department of Government Efficiency (DOGE) staff.\u00a0<\/p>\n

It is not just that Martin\u2019s emails and letters have been full of typographical and grammatical errors.\u00a0<\/p>\n

It is not just that Martin uses racially-tinged language in the letter like \u201cthugs with gun.\u201d\u00a0 We know who he is talking about.\u00a0<\/p>\n

It is not just that Martin has never even worked as a prosecutor or headed any organization other than his small law firm, much less an organization as large and with as much power as the U.S. Attorney\u2019s Office for the District.<\/p>\n

In this respect, Martin is just like Jeffrey Clark.\u00a0 Clark was the bland, mid-level bureaucrat who was almost promoted to U.S. Attorney General during the first Trump Administration because of his willingness to do Trump\u2019s bidding when saner minds balked.\u00a0<\/p>\n

It is not just that Martin was physically present at the J6 insurrection and likened it to the fun at Mardi Gras.\u00a0<\/p>\n

It is not just that Martin feels the need to ingratiate himself publicly with the unelected and \u201cHeil Hitler\u201d saluting Elon Musk.\u00a0 Yes, Mr. Martin, we know you want to impress Donald Trump.\u00a0 We know you want the job on a permanent basis.\u00a0 But where is your self-respect?<\/p>\n

No.\u00a0 It is not just those things.<\/p>\n

It is also that he specifically cites two groups \u2013 Antifa and Black Lives Matter \u2013 without any evidence that either group was involved in the activities in question.\u00a0<\/p>\n

This would be a major \u201cno-no\u201d for any prosecutor concerned about accusations of selective prosecution.\u00a0\u00a0 And, as far as I know, the only people accused of threatening Musk\u2019s people are disgruntled federal employees and the Members of Congress who support them.\u00a0<\/p>\n

And, most importantly, it is that Martin concludes his letter with those three words: \u201cNo matter what.\u201d<\/p>\n

The \u201cwhat\u201d in this statement can only be read to include people\u2019s constitutional protections.\u00a0<\/p>\n

As one of my colleagues has put it:\u00a0 \u201cInsurrection Ed is a selective prosecution appeal just waiting to be filed.\u201d<\/p>\n<\/div>\n\n","protected":false},"excerpt":{"rendered":"
