Duty-free de minimis treatment under <\/span><a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2023-title19\/pdf\/USCODE-2023-title19-chap4-subtitleII-partI-sec1321.pdf\"><span data-contrast=\"none\">19 U.S.C. 1321<\/span><\/a><span data-contrast=\"none\"> will not be available for products subject to these additional tariffs. Tariffs will be on top of any other in place (301, 232, ADD, etc.) The Federal Register Notice for Canada can be found <\/span><a href=\"https:\/\/public-inspection.federalregister.gov\/2025-02291.pdf\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"none\"> and the Federal Register Notice for China can be found <\/span><a href=\"https:\/\/public-inspection.federalregister.gov\/2025-02293.pdf\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"none\">. <\/span><span data-contrast=\"none\">Customs and Border Protection<\/span><span data-contrast=\"none\"> (CBP)<\/span><span data-contrast=\"none\"> issued guidance on the <\/span><span data-contrast=\"none\">additional<\/span><span data-contrast=\"none\"> tariffs on import<\/span><span data-contrast=\"none\">s<\/span><span data-contrast=\"none\"> from China and Canada which can be found <a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3d062f4?wgt_ref=USDHSCBP_WIDGET_2\">here<\/a> and\u00a0 <\/span><a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3d062f3?wgt_ref=USDHSCBP_WIDGET_2\"><span data-contrast=\"none\">here.<\/span><\/a><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\"> CBP also issued guidance on the processing of de minimis shipments, available <a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3d072a2?wgt_ref=USDHSCBP_WIDGET_2\">here<\/a>.<\/span><\/p>\n<h4><b><span data-contrast=\"none\">Policy Rationale &amp; International Response<\/span><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/h4>\n<p><a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/02\/fact-sheet-president-donald-j-trump-imposes-tariffs-on-imports-from-canada-mexico-and-china\/\"><span data-contrast=\"none\">The Administration said<\/span><\/a><span data-contrast=\"none\"> the tariffs are aimed at curbing the flow of undocumented immigrants and drugs into the U.S. The <a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/02\/fact-sheet-president-donald-j-trump-imposes-tariffs-on-imports-from-canada-mexico-and-china\/\">White House Fact Sheet<\/a> said the tariffs will hold Mexico, Canada, and China accountable to their promises of halting illegal immigration and stopping fentanyl and other drugs from flowing across the border. The tariffs will remain in effect \u201cuntil the crisis is alleviated.\u201d<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Canada and China immediately vowed to impose retaliatory tariffs and countermeasures. Canadian Prime Minister, Justin Trudeau, <\/span><a href=\"https:\/\/www.canada.ca\/en\/department-finance\/news\/2025\/02\/list-of-products-from-the-united-states-subject-to-25-per-cent-tariffs-effective-february-4-2025.html\"><span data-contrast=\"none\">announced<\/span><\/a><span data-contrast=\"none\">\u202ftariffs starting at\u202f25 percent on approximately $30 billion worth of U.S. goods, with $85 billion more to follow within three weeks. China <a href=\"https:\/\/www.cnn.com\/2025\/02\/04\/business\/china-us-trade-retaliation-hnk-intl\/index.html\">announced<\/a> it would implement a 10% tariff on crude oil, agricultural machinery and large-engine cars, as well as a 15% tariff on coal and liquefied natural gas. China\u2019s commerce ministry also said they\u202fwould file a case\u202fagainst the U.S. at the World Trade Organization.<\/span><\/p>\n<p><span data-contrast=\"none\">Following a meeting between President Trump and Mexico President Claudia Sheinbaum, <\/span><a href=\"https:\/\/www.cnbc.com\/2025\/02\/03\/trump-tariffs-mexico-canada-china-sheinbaum-responds.html\"><span data-contrast=\"none\">tariffs on Mexico will be paused<\/span><\/a><span data-contrast=\"none\"> for one month. Sheinbaum vowed to immediately reinforce Mexico\u2019s northern border with 10,000 National Guard soldiers to curb drug trafficking from Mexico to the U.S. Following a meeting between President Trump and Canada Prime Minister Justin Trudeau, tariffs on Canada will be paused for one month. Trudeau <a href=\"https:\/\/x.com\/JustinTrudeau\/status\/1886529228193022429\">announced<\/a> Canada will implement their $1.3 billion border plan which includes reinforcing the border and increased resources to stop the flow of fentanyl. CBP subsequently issued issued <a href=\"https:\/\/content.govdelivery.com\/bulletins\/gd\/USDHSCBP-3d06ed6?wgt_ref=USDHSCBP_WIDGET_2\">guidance<\/a> pausing the application of additional duties on imports from Canada.<\/span><\/p>\n<h4><b><span data-contrast=\"none\">What Importers Should Do:<\/span><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/h4>\n<p><span data-contrast=\"none\">While these increases will undoubtedly\u202fhave a significant impact on any business involved in importing goods into the U.S. from these countries, importers are not without options.<\/span><\/p>\n<p><span data-contrast=\"none\">Now is the time importers should audit their operations and compliance program and\u202fensure they are\u202foperating in the most efficient way possible. There are also several ways to legally minimize\u202ftariffs.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><b><i><span data-contrast=\"auto\">Duty Drawback<\/span><\/i><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">If you import products into the U.S. only to export them to another country, you may be entitled to compensation for the duties paid upon importation to the <\/span><a href=\"https:\/\/www.cbp.gov\/trade\/programs-administration\/entry-summary\/drawback\"><span data-contrast=\"none\">U.S. Duty Drawback<\/span><\/a><span data-contrast=\"auto\"> provides for the refund of up to 99% for certain duties, internal revenue taxes, and fees collected by CBP upon importation. The drawback may be granted only after the subjected item(s) have been either exported or destroyed (under CBP supervision). Note: importers may not utilize duty drawbacks to mitigate the new tariffs discussed above.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><b><i><span data-contrast=\"auto\">Tariff Engineering<\/span><\/i><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Tariff engineering involves altering the condition of a good before it is imported so that it is legally classified under a favorable <\/span><a href=\"https:\/\/diaztradelaw.com\/product\/basics-on-tariff-classification-including-2022-update\/\"><span data-contrast=\"none\">Harmonized Tariff Schedule of the U.S<\/span><\/a><span data-contrast=\"auto\">. (HTSUS) classification to benefit from a lower duty rate. Since CBP can only levy tariffs based on the condition of goods at the time of importation, tariff engineering gives importers the opportunity to redefine their imported products and pay lower duties.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><b><i><span data-contrast=\"auto\">Country of Origin Change<\/span><\/i><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">While potentially costly to initially relocate, changing the <\/span><a href=\"https:\/\/www.cbp.gov\/trade\/rulings\/informed-compliance-publications\/marking-country-origin-us-imports\"><span data-contrast=\"none\">country of origin<\/span><\/a><span data-contrast=\"auto\"> will allow you to import the exact same item(s) without paying the additional duties. If considering this option, one must be cognizant of the list of nations that have a free-trade agreement with the United States. Even though another nation may not be subjected to substantial duties, shifting your supply chain to a nation that has a formal, free and fair-trade agreement with the U.S. ensures accountability and reliability.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Per the \u201cAmerica First Trade Policy\u201d memorandum issued by the White House on January 20, 2025, all free trade agreements are under review by the United States Trade Representative, with a report expected by April 1, 2025.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><b><i><span data-contrast=\"auto\">First Sale<\/span><\/i><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/diaztradelaw.com\/using-middleman-learn-lower-customs-value-using-first-sale-2\/\"><span data-contrast=\"none\">First Sale<\/span><\/a><span data-contrast=\"auto\"> is a system that decreases the dutiable value of imported goods by authorizing importers to use the price paid in the first sale.\u00a0 It allows an earlier sale to be used in declaring customs value as long as that sale can be documented as a sale for exportation to the United States and the importer meets all other Customs requirements.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Consequently, that equivalent value is assigned according to the transaction between the manufacturer and the middleman, not between the middleman and the new buyer.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><b><i><span data-contrast=\"auto\">Duty Deferral<\/span><\/i><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">If an importer cannot lower the tariff burden, they can consider deferring the cost of duties through Foreign Trade Zones and\/or Bonded Warehouses. Note: importers may not utilize foreign trade zones to defer the recently imposed tariffs discussed above.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span style=\"text-decoration: underline;\">Foreign Trade Zones<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/diaztradelaw.com\/services\/importing\/foreign-trade-zone-ftz-applications\/\"><span data-contrast=\"none\">Foreign Trade Zones<\/span><\/a><span data-contrast=\"auto\"> (FTZs), although technically within the geographic limits of the U.S., are secured areas considered outside U.S. Customs territory. Foreign and domestic merchandise may be admitted into an FTZ for operations such as storage, exhibition, assembly, manufacture, redistribution, processing, and more. FTZs allow users to defer, reduce, or eliminate Customs duties. <\/span><span data-contrast=\"none\">Prior to any manipulation or manufacture<\/span><span data-contrast=\"none\"> of merchandise<\/span><span data-contrast=\"none\">, which would change its tariff classificatio<\/span><span data-contrast=\"none\">n, <\/span><span data-contrast=\"none\">impor<\/span><span data-contrast=\"none\">ters<\/span><span data-contrast=\"none\"> may also apply for merchandise in t<\/span><span data-contrast=\"none\">he zone to be given <\/span><span data-contrast=\"none\">priv<\/span><span data-contrast=\"none\">i<\/span><span data-contrast=\"none\">leged<\/span><span data-contrast=\"none\"> foreign status. <\/span><span data-contrast=\"none\">Merchandise with privileged foreign status is classified and appraised and duties and taxes are determined as of the date the application is filed.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span style=\"text-decoration: underline;\">Bonded Warehouse\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Unlike FTZs, bonded warehouses are within U.S. customs territory. A customs-bonded warehouse is a secured area in which imported merchandise may be stored without payment of duty for up to 5 years.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Importers may repackage, sort, or label imports at these locations under the supervision of U.S. customs officials. Manipulation of merchandise is generally prohibited unless approved by U.S. Customs.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><b><i><span data-contrast=\"auto\">Negotiate DDP Incoterm<\/span><\/i><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/diaztradelaw.com\/wp-content\/uploads\/2021\/05\/Incoterms.pdf\"><span data-contrast=\"none\">International commercial terms<\/span><\/a><span data-contrast=\"auto\"> (\u201cIncoterms\u201d) are published by the International Chamber of Commerce (ICC) as a commitment to facilitate international trade and promote open markets. The ICC developed Incoterms to provide a common language for traders and to establish a global system of rules to govern trade. Incoterms are not law, and instead are designed to prevent confusion between global traders by clarifying contract obligations of buyers and sellers.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Negotiating Incoterms with partners is another way to minimize import costs. Importers should review their contracts and negotiate a \u201cdelivery duty paid\u201d (DDP) incoterm. DDP terms place the responsibility (including export and import clearance, transport costs, import duties, and packaging costs) for the delivery of goods on the seller. The seller acts as the importer of record and has the ability to deduct costs like freight, duty, and insurance from the dutiable value.
