One <a href=\"https:\/\/thehill.com\/homenews\/administration\/6110237-trump-government-ad-criticism\/\" target=\"_blank\" aria-label=\"Link opens in new window (features)\">features<\/a> President Donald Trump vowing to eradicate \u201ccommunism, socialism, and Marxism\u201d and touting \u201cthe largest tax cut in history.\u201d Another <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/trump-administration-uses-taxpayer-money-to-air-2024-trump-campaign-ad\" target=\"_blank\" aria-label=\"Link opens in new window (recycles)\">recycles<\/a> a 2024 presidential campaign ad, complete with the predictable cast of villains including the \u201cdeep state,\u201d \u201cglobalists,\u201d and the \u201cfake news media.\u201d<\/p>\n<p>The ads glorifying Trump proudly proclaimed that they were paid for by the U.S. government\u2014that is, taxpayers. After intense bipartisan criticism, he now says his super PAC will <a href=\"https:\/\/thehill.com\/homenews\/administration\/6130848-trump-to-pay-patriotic-ads-backlash\/\" target=\"_blank\" aria-label=\"Link opens in new window (pick up the tab)\">pick up the tab<\/a>, but he has <a href=\"https:\/\/www.nytimes.com\/2026\/10\/06\/us\/politics\/trump-taxpayer-funded-ads.html\" target=\"_blank\" aria-label=\"Link opens in new window (no intention)\">no intention<\/a> of paying taxpayers back for the spots that have already aired.\u00a0<\/p>\n<p>That is not acceptable, and it is time for Congress to demand accountability.\u00a0<\/p>\n<p>According to news reports, the Office of Management and Budget <a href=\"https:\/\/www.nytimes.com\/2026\/10\/02\/us\/politics\/trump-ads.html\" target=\"_blank\" aria-label=\"Link opens in new window (redirected)\">redirected<\/a> $20 million from the Department of Homeland Security for these ads at the President\u2019s request. Trump\u2019s announcement that MAGA Inc. will pay for the ads going forward is a necessary concession but does not resolve the underlying violation. Taxpayers should not be on the hook for a single penny of Trump\u2019s partisan ads.<\/p>\n<p>The ads are not public service announcements, and the ethical and legal questions they raise are serious.\u00a0<\/p>\n<p>First, Trump\u2019s super PAC had <a href=\"https:\/\/www.cnbc.com\/2026\/09\/21\/trump-maga-midterm-spending-war-chest.html\" target=\"_blank\" aria-label=\"Link opens in new window (more than $415 million)\">more than $415 million<\/a> on hand at the end of August, according to Federal Election Commission\u00a0filings. His PAC has no shortage of funds to promote him and his political agenda. The White House claimed these ads were educational and \u201cpatriotic\u201d communications made in the public interest. But if that is true, why is a super PAC now paying for the ads?<\/p>\n<p>Second, a federal law called the <a href=\"https:\/\/www.osc.gov\/services\/hatch-act\/overview\/\" target=\"_blank\" aria-label=\"Link opens in new window (Hatch Act)\">Hatch Act<\/a> restricts covered federal employees from using their official positions to influence elections. Though the President himself is exempt from this law, the staffers and agencies that created, funded, and placed these commercials are not. \u00a0<\/p>\n<p>The use of congressionally appropriated funds also raises questions under federal restrictions on domestic \u201cpublicity and propaganda.\u201d Richard Painter, a former White House ethics lawyer under former President George W. Bush,\u00a0<a href=\"https:\/\/apnews.com\/article\/trump-government-ads-taxpayer-funded-psa-propaganda-26ae03010d78221d1d93b06c0818d06d\" target=\"_blank\" aria-label=\"Link opens in new window (called)\">called<\/a> the ads \u201csheer propaganda.\u201d<\/p>\n<p>So far, Republican leaders in Congress have largely declined to demand accountability as the President takes a wrecking ball to the rule of law and pads his and his family\u2019s bank accounts. A few have expressed their \u201cconcern\u201d at this latest offense.\u00a0<\/p>\n<p><a href=\"https:\/\/www.cbsnews.com\/news\/john-kennedy-trump-affordability-iran-midterms\/\" target=\"_blank\" aria-label=\"Link opens in new window (Said)\">Said<\/a> Sen. John Kennedy, R-La., \u201cI don\u2019t think any public official, including President Trump \u2026 should spend public money on private ads for themselves.\u201d Senator\u00a0Thom Tillis, Republican of North Carolina, <a href=\"https:\/\/www.nbcnews.com\/politics\/trump-administration\/trump-tv-ads-customs-border-protection-money-rcna600527\" target=\"_blank\" aria-label=\"Link opens in new window (chimed in)\">chimed in<\/a> that it \u201cfeels like Viktor Orb\u00e1n talking to the Hungarian people.\u201d Representative\u00a0Thomas Massie, Repubilcan of Kentucky, <a href=\"https:\/\/time.com\/article\/2026\/09\/28\/trump-ads-democrats-republicans-bipartisan-criticism-taxpayer-funds\/\" target=\"_blank\" aria-label=\"Link opens in new window (wrote)\">wrote<\/a> that using taxpayer dollars for presidential campaign ads is \u201ccompletely legal \u2026 in banana republics.\u201d<\/p>\n<p>But selective, carefully worded critiques are not oversight. Accountability requires document reviews, hearings, subpoenas, and consequences for illegal actions. In this case, it requires a reimbursement of misappropriated taxpayer dollars.\u00a0<\/p>\n<p>This failure to demand accountability at this moment is part of a broader pattern. Minted gold coins <a href=\"https:\/\/www.usmint.gov\/campaigns\/donald-trump-coin?srsltid=AU7gw4V1yX3Es1TjSZG86YU9seHCmfYoXzRIQkwz2rDP8LjQ0hFnwRcM\" target=\"_blank\" aria-label=\"Link opens in new window (bear Trump&#x2019;s image)\">bear Trump\u2019s image<\/a>. His likeness is <a href=\"https:\/\/travel.state.gov\/en\/passports\/apply\/help\/security-design\/passport-250.html\" target=\"_blank\" aria-label=\"Link opens in new window (printed on)\">printed on<\/a> U.S. passports and National Park passes. Banners on federal buildings <a href=\"https:\/\/apnews.com\/article\/donald-trump-banner-justice-department-pam-bondi-13f3d901c9bd6d179e206475adadc28a\" target=\"_blank\" aria-label=\"Link opens in new window (feature his image)\">feature his image<\/a>. He keeps trying and <a href=\"https:\/\/www.npr.org\/2026\/09\/15\/nx-s1-5969905\/kennedy-center-closing-trump-name\" target=\"_blank\" aria-label=\"Link opens in new window (failing)\">failing<\/a> to put his name on the Kennedy Center.<\/p>\n<p>Trump continually tests how far he can go, and it is the job of Congress to impose limits. The response to his use of tax dollars to fund political propaganda cannot be yet another collective shrug over another shattered norm. What has happened is a violation of the law, but the rule of law is only meaningful when people with power are willing to enforce it.<\/p>\n<p>That is what makes this upcoming election so critical. The question before voters is not merely which party will control Congress. It is whether we will have a Congress that does its duty and serves as a check on a President who treats the U.S. Treasury as his own personal campaign fund\u2014or will we continue to see a Congress ready to bend a knee and serve as a stable of sycophants defending whatever he does.\u00a0<\/p>\n<p>Every member of Congress swears an oath to the U.S. Constitution, not to a President.
