The Government of India recently enacted three core agricultural legislations \u2013 <a href=\"http:\/\/egazette.nic.in\/WriteReadData\/2020\/222039.pdf\">\u00a0The Farmer\u2019s Produce Trade and Commerce (Promotion &amp; Facilitation) Bill<\/a>, <a href=\"http:\/\/egazette.nic.in\/WriteReadData\/2020\/222040.pdf\">The Farmer\u2019s (Empowerment &amp; Protection) Agreement on Price Assurance and Farm Services Act<\/a> and the <a href=\"https:\/\/consumeraffairs.nic.in\/sites\/default\/files\/file-uploads\/acts-and-rules\/EC%28Amendment%29%20Act2020.pdf\">Essential Commodities (Amendment) Act<\/a>, 2020. These Acts have been met with <a href=\"https:\/\/www.aljazeera.com\/news\/2020\/11\/27\/indian-farmers-clash-with-police-in-protest-over-market-reform\">widespread protests<\/a> as they are perceived to favour large corporations by going against the interests of farmers and go beyond the scope of the Centre\u2019s right to make laws on matters in the State list.<\/p>\n<p class=\"has-text-align-justify has-background-light-background-color has-text-color has-background wp-block-paragraph\" style=\"color:#000000;\">After a harrowing journey in the cold, braving tear gas and water cannons, thousands of farmers have congregated in the national capital demanding a recall of the Acts that would deregulate the agricultural sector and make the farmers more susceptible to exploitation by large corporations.\u00a0 The new Acts allow for stockpiling of food, which can lead to rise in prices of essential commodities during times of scarcity. A staggering <a href=\"https:\/\/www.business-standard.com\/article\/economy-policy\/from-lack-of-literacy-to-small-farm-size-how-farmers-are-losing-the-plot-119043001358_1.html\">30% of marginal and small farmers are poor and illiterate<\/a>. They do not possess adequate bargaining power to negotiate with large corporations. Furthermore, the <a href=\"https:\/\/thewire.in\/politics\/farm-bills-rajya-sabha-legislative-scrutiny\">Bills were passed hastily<\/a> through a voice vote, without much deliberation. These Acts do not mandate for a written contract, further aggrieving farmers in case of a violation. Farmers fear that they may lose their safeguards with the enactment of the new legislation.<\/p>\n<h4 class=\"has-foreground-dark-color has-text-color wp-block-heading\"><strong>Did the Central Government have the power to enact these Acts?<\/strong><\/h4>\n<p class=\"has-text-align-justify has-background-light-background-color has-text-color has-background wp-block-paragraph\" style=\"color:#000000;\">India follows a federal structure of government with power being separated between the Union and the State governments. The <a href=\"https:\/\/www.mea.gov.in\/Images\/pdf1\/S7.pdf\">Seventh Schedule of the Constitution<\/a> contains three lists \u2013 Union, State and Concurrent,\u00a0 effectively delegating Legislative powers between the Centre and the States. Agriculture, Markets and Fairs and Trade and Commerce within the State are State subjects. However, it is subject to Entry 33 of the Concurrent List where both States and the Union can legislate. In case of a repugnancy, laws of the Union override State laws.<\/p>\n<p class=\"has-text-align-justify has-background-light-background-color has-text-color has-background wp-block-paragraph\" style=\"color:#000000;\">Entry 33 of the Concurrent List in its present form was added to the Constitution via the <a href=\"http:\/\/legislative.gov.in\/constitution-third-amendment-act-1954\">Constitution (Third Amendment) Act, 1954<\/a>. The term agriculture has not been explicitly stated in the Concurrent List. The Union government has interpreted the term \u2018food items\u2019 to include agriculture. It has used Entry 33 as a tool to infringe on the rights of States to legislate by making laws on matters beyond its jurisdiction. Furthermore, these Acts do not mention, in their Statement of Objects &amp; Reasons, the Constitutional provisions under which Parliament has the power to legislate on the subjects covered.<\/p>\n<p class=\"has-text-align-justify has-background-light-background-color has-text-color has-background wp-block-paragraph\" style=\"color:#000000;\">The Supreme Court in\u00a0<a href=\"https:\/\/indiankanoon.org\/doc\/299584\/\">I.T.C. Limited vs. Agricultural Produce Market Committee (APMC) and Others, 2002<\/a> has upheld the legislative powers and powers to levy tax on agricultural produce of States through intra-State agricultural marketing. In <a href=\"https:\/\/indiankanoon.org\/doc\/1235907\/\">Union of India vs H.S.Dhillon, 1972<\/a>, the Supreme Court held that the constitutionality of Parliamentary laws can be challenged only on two grounds \u2013 if it\u2019s violative of fundamental rights or if the law is made on a subject in the State list.<\/p>\n<p class=\"has-text-align-justify has-background-light-background-color has-text-color has-background wp-block-paragraph\" style=\"color:#000000;\">In Punjab, where the protests and opposition to the Acts are particularly strong, the <a href=\"https:\/\/www.thehindu.com\/news\/national\/other-states\/punjab-govt-presents-3-bills-to-negate-centres-three-agriculture-laws\/article32898619.ece\">State Government has passed laws<\/a> negating the Central laws, essentially removing them from the ambit of the Central laws. It is to be seen if this will stand the test of Constitutional validity. The Opposition is considering using <a href=\"https:\/\/indiankanoon.org\/doc\/665535\/\">Article 254(2) of the Indian Constitution<\/a> which provides for States to enact legislation on a subject in the Concurrent List which conflicts with Central legislation, provided that Presidential assent is received by such legislation. However, this seems unlikely.<\/p>\n<p class=\"has-text-align-justify has-background-light-background-color has-text-color has-background wp-block-paragraph\" style=\"color:#000000;\">Although Federalism is not explicitly set out in the Constitution, the Supreme Court in the case of <a href=\"https:\/\/main.sci.gov.in\/judgment\/judis\/11570.pdf\">S.R. Bommai Vs. Union of India, 1994<\/a> held that it forms the basic structure of the Constitution. Any law that violates the basic structure is held unconstitutional by the Supreme Court. It\u2019s evident that agriculture as a legislative subject is outside the purview of Parliament. The Centre should not use an emergency legal provision to impinge on the rights of States. The Haryana Government\u2019s suppression of peaceful protest is highly condemnable. <a href=\"http:\/\/www.businessworld.in\/article\/Fifth-round-of-talks-between-farmers-and-Centre-begins\/05-12-2020-350228\/\">Talks are ongoing between the Centre and the farmers<\/a>.
