A few hundred feet away, the fire climbed up the mountain and a cloud of red and gray smoke obscured the view. He drove out of his city, ash raining down on the sidewalks below, in complete shock. \u201cIt felt like my world had been thrown off its center,\u201d he said.<\/p>\n<p class=\"wp-block-paragraph\">The catastrophic Palisades fire, along with the Eaton fire, razed more than 50,000 acres in southern California. Experts say they were fueled by <a href=\"https:\/\/earth.org\/hotter-drier-and-more-flammable-new-study-finds-climate-change-played-a-role-in-la-fires\/#:~:text=Hot%2C%20dry%2C%20and%20windy%20conditions,a%20new%20study%20has%20confirmed.\" target=\"_blank\" rel=\"noreferrer noopener\">climate change.<\/a> Galvanized by the disaster, Jackson founded a Sunrise Movement chapter in Foothills, the area that includes Pasadena and Altadena, to advocate for environmental justice in his community. And, exactly a year after the blaze narrowly missed his house, Jackson met with contingents from the national Sunrise Movement in Altadena for a rally to demand accountability and transparency from local leadership.<\/p>\n<p class=\"wp-block-paragraph\">As he marched through Altadena twelve months later, Jackson said the streets looked eerily similar to how they did in the immediate aftermath of the fires: \u201cThe debris might have been cleaned up, but there were still dozens and dozens of empty lots reduced to the foundation.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Estimates have ballooned to more <a href=\"https:\/\/www.latimes.com\/business\/story\/2025-01-24\/estimated-cost-of-fire-damage-balloons-to-more-than-250-billion\" target=\"_blank\" rel=\"noreferrer noopener\">than $250 billion<\/a> in damage, making the fire one of the costliest in US history. \u201cRecovery is happening very slowly, and for a lot of residents, it\u2019s really expensive,\u201d said Jackson. But to him, and the other young people touched by the fires, the solution is clear: make fossil fuel companies pay.<\/p>\n<p class=\"wp-block-paragraph\">California\u2019s youth have pushed for a state bill that would do just that. The Polluters Pay Climate Superfund Act is modeled after federal legislation that requires companies to clean up toxic spills and hazardous waste sites. The proposal, which has analogous statutes in Vermont and New York, aims to hold fossil fuel companies, not taxpayers, financially responsible for climate change damages like the LA fires.<\/p>\n<p class=\"wp-block-paragraph\">To youth advocates, the bill is common sense. \u201cIf you make a mess, you should be the one to clean it up,\u201d said Sofia Carrasco, a high school activist with San Diego 350\u2019s <em>Youth v. Oil <\/em>Campaign.<\/p>\n<div id=\"current-issue-block_eea5f8b9da575ca638ca8819226be618\" class=\"current-issue  float-l-w-2\">\n<h4 class=\"current-issue__title\">\n                    Current Issue<br \/>\n            <\/h4>\n<p>    <a href=\"https:\/\/www.thenation.com\/issue\/october-2026-issue\/\" class=\"current-issue__cover\"><br \/>\n        <img decoding=\"async\" src=\"https:\/\/www.thenation.com\/wp-content\/uploads\/2026\/09\/10-26-Cover_online-1.jpg\" alt=\"Cover of October 2026 Issue\"\/><br \/>\n    <\/a><\/p>\n<\/div>\n<p class=\"wp-block-paragraph\">The act has become the flagship policy goal for environmental advocacy organizations like Sunrise Movement and 350.org, who are touting it as a mechanism to address the <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/sep\/25\/california-climate-emergency-affordability-crisis-study\" target=\"_blank\" rel=\"noreferrer noopener\">growing costs of climate change<\/a>. Amid California\u2019s projected <a href=\"https:\/\/lao.ca.gov\/Publications\/Report\/5101\" target=\"_blank\" rel=\"noreferrer noopener\">$3 billion budget deficit<\/a>, it offers a new source of funding for the state. Around 40 percent of the funds would also be specifically earmarked for <a href=\"https:\/\/oehha.ca.gov\/calenviroscreen\/sb535\" target=\"_blank\" rel=\"noreferrer noopener\">disadvantaged communities<\/a> most burdened by environmental impacts, like air pollution.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe biggest thing we hear when we try to implement some sort of solution is that we don\u2019t have the money,\u201d said Mani Bekele, a San Jose high schooler and climate activist. \u201cThis bill provides an answer to that question, \u2018where\u2019s the money going to come from?\u2019\u201d<\/p>\n<p class=\"wp-block-paragraph\">Unsurprisingly, the superfund bill is not nearly as popular among legislators. In April 2025, Senator Caroline Menjivar and Assemblywoman Dawn Addis, who authored twin bills in both legislative chambers, canceled scheduled committee hearings for the legislation <a href=\"https:\/\/capitalandmain.com\/push-to-make-big-oil-pay-for-climate-damage-losing-steam-in-california-legislature\" target=\"_blank\" rel=\"noreferrer noopener\">in hopes of receiving more support<\/a> later in the year. But the bill continued to stall afterwards until it passed its January 2026 deadline and officially died.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s not unusual for meaningful legislation to take time,\u201d said Christina Scaringe, California policy director for the Center for Biological Diversity, a sponsor of the bill. In New York, a similar climate superfund law <a href=\"https:\/\/www.pillsburylaw.com\/en\/news-and-insights\/climate-superfund-new-york.html\" target=\"_blank\" rel=\"noreferrer noopener\">died in assembly<\/a> after its first introduction, but later passed into law in 2024. \u201cWhile the 2025 bill vehicles may now be dead, the campaign is growing and the work continues.\u201d<\/p>\n<div id=\"cta-block_0c3047e28b3bcbbc82b0320c6da966f6\" class=\"cta float-l-w-2\">\n<p class=\"wp-block-paragraph\">Scaringe attributes the bill\u2019s failure to fossil fuel lobbyists who, along with building trade unions, say the act will drive up gas and electricity prices.<\/p>\n<p class=\"wp-block-paragraph\">\u201cHigher costs lead to increased energy prices, adding financial strain on working class families who are already struggling to survive in our nation\u2019s <a href=\"https:\/\/www.cnbc.com\/2025\/07\/11\/americas-most-expensive-places-to-live-top-states-for-business-rankings.html\" target=\"_blank\" rel=\"noreferrer noopener\">most expensive<\/a> state,\u201d said Keith Dunn, a representative for the California\u2019s State Building and Construction Trades Council\u2014a union notorious for allying with fossil fuel interests and staunchly <a href=\"https:\/\/calmatters.org\/politics\/2023\/12\/california-big-oil\/\" target=\"_blank\" rel=\"noreferrer noopener\">opposing environmental bills<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">Economists in a 2022 <a href=\"https:\/\/policyintegrity.org\/files\/publications\/Polluter_Pays_Policy_Brief_v2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">NYU\u2019s Institute for Policy Integrity<\/a> study found that, contrary to what industry voices have argued, the climate superfund bill in New York likely wouldn\u2019t drive up costs at the pump, since oil companies would still have incentives to keep their prices at competitive market levels.<\/p>\n<p class=\"wp-block-paragraph\">But, that positive prediction has not tempered the concerns of California\u2019s biggest fossil fuel players. \u201cOil companies have an incentive to overestimate the impact [the bill] would have on consumers,\u201d said Ethan Elkind, Climate Program Director at UC Berkeley Law.<\/p>\n<p class=\"wp-block-paragraph\">In the first quarter of the year, superfund opponents spent <a href=\"https:\/\/www.latimes.com\/environment\/story\/2025-07-07\/why-californias-make-polluters-pay-plan-stalled-again\" target=\"_blank\" rel=\"noreferrer noopener\">10 times<\/a> the amount environmental groups did to lobby against the bill. \u201cThese fossil fuel giants\u2026are working overtime to kill superfund bills,\u201d said Scaringe. \u201cThe policy is effective and well-grounded in law and science, but these industries recognize the threat of potential accountability.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Their capacity for big spending paired with their hostility towards green legislation makes challenging fossil fuel interests daunting. Menjivar\u2019s office. Additionally, there was no consensus on what version could move forward as an alternative.<\/p>\n<p class=\"wp-block-paragraph\">Jackson and other students across California are hoping the bill can be reintroduced in 2027. In the meantime, they\u2019re doubling down on their advocacy in hopes of showing legislators how much public support is behind the bill.<\/p>\n<p class=\"wp-block-paragraph\">Across the state, students have lobbied their city councils to pass resolutions endorsing the climate superfunds, a symbolic gesture of support that they hope will sway state legislators. So far, 28 cities, counties, and school boards have passed a resolution supporting the bill.<\/p>\n<p class=\"wp-block-paragraph\">Jackson, who is working with the Sunrise Movement to pass his own resolution in Pasadena, says that these kinds of actions keep the moment alive. \u201cWe don\u2019t want to see the bill as dying or dead,\u201d said Jackson. \u201cInstead, it is an opportunity to tell lawmakers that we are not going to go down quietly and a reminder to big oil that this is not a win for them.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Elkind says the bill\u2019s future will \u201cboil down to coalition politics\u201d and whether supporters can gather enough public support. \u201cUltimately, the politicians have to answer to the voters. So, if there\u2019s something that the public is paying attention to, [politicians] are going to do what\u2019s popular, not what interest groups want,\u201d said Elkind.<\/p>\n<p class=\"wp-block-paragraph\">Encouragingly, despite their best efforts, fossil fuel companies have not managed to curb overwhelming public support for this kind of legislation. <a href=\"https:\/\/www.filesforprogress.org\/datasets\/2025\/9\/dfp-ffm-mpp-poll.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">According to nationwide polling<\/a> conducted by Data for Progress, 77 percent of Americans support a climate superfund bill. \u201cThe fossil fuel lobby [has] a lot of money to influence and lobby the state legislature,\u201d said Bekele. \u201cThey have that resource.
