California (September 28, 2026) Tak Lun Ng, proceeding pro se<\/em>, sued United Financial Casualty Company over a March 2, 2021 automobile accident and the insurer\u2019s March 24, 2021 refusal to pay him.<\/p>\nHe appeared to assert breach of contract, fraud, negligence, premises liability, product liability, and related theories. United removed the action from state court and moved to dismiss.<\/p>\n
Ng missed that deadline but later filed several documents, including a motion for leave to amend, all of which the court reviewed.<\/p>\n
LAW<\/span><\/strong><\/h2>\nUnder Federal Rules of Civil Procedure, a complaint must provide a short and plain statement containing enough factual matter to state a facially plausible claim; legal conclusions, speculation, and conclusory recitations are insufficient. Pro se<\/em> pleadings are construed liberally.<\/p>\nFraud claims must also satisfy Rule 9(b) by pleading the who, what, when, where, and how with particularity. Leave to amend is ordinarily favored but may be denied for bad faith, undue delay, prejudice, prior amendment opportunities, or futility.<\/p>\nDISCUSSION<\/span><\/strong><\/h2>\nThe court concluded that neither the complaint nor Ng\u2019s post-deadline filings supplied coherent factual allegations supporting a viable cause of action. The filings often blended argument with unidentified quotations, included incomprehensible passages, and did not cure the defects identified in the motion to dismiss and order to show cause.<\/p>\n
ANALYSIS<\/span><\/strong><\/h2>\nThe decisive problem was not merely Ng\u2019s missed deadline; it was the absence, across numerous filings, of facts showing that United could be liable under any cognizable theory. The court made no finding of bad faith but found the remaining factors sufficient even under the more permissive standard afforded to a pro se litigant.<\/p>\n
CONCLUSION<\/span><\/strong><\/h2>\nThe court granted United\u2019s motion to dismiss, denied Ng\u2019s motion for leave to amend, dismissed the action without leave to amend, and directed the clerk to enter judgment for United and close the case.<\/p>\n
If grounds for dismissal are apparent from the face of the complaint, a court may also dismiss the case sua sponte<\/em> (meaning on the court\u2019s own initiative) under Rule 12(b)(6) of the Federal Rules of Civil Procedure, regardless of whether the defendant has moved for dismissal on that basis and regardless of whether a plaintiff is proceeding in forma pauperis<\/em>.<\/p>\nRule 9(b) of the Federal Rules of Civil Procedure requires that a party alleging fraud must state with particularity the circumstances constituting fraud.<\/p>\n
The factors of undue delay and prejudice to Defendant weigh in favor of denying leave to amend because Defendant appears to have been embroiled in litigation with Plaintiff and his wife for nearly five years over a 2021 car accident, and again, there is no indication that Plaintiff has or ever had any basis for a meritorious claim.<\/p>\n
Defendants\u2019 Motion to Dismiss was granted, Plaintiff\u2019s Motion for Leave to Amend was denied and the case was dismissed without leave to amend.<\/p>\n
Plaintiffs\u2019 representing themselves without an attorney nor without the training of an attorney, must still plead a proper complaint that provide a short and plain statement containing enough factual matter to state a facially plausible claim. Even though courts give aid to pro se plaintiffs they still require some compliance with the requirements of federal rules that require dismissal of complaints that are highly repetitious, or confused, or consisted of incomprehensible rambling also violate the federal pleading standard.<\/p>\n
