For some, however, the courtroom eventually becomes more than a place to argue cases\u2014it becomes the place from which they hope to administer justice.<\/p>\n<p>But how does an advocate actually move from the Bar to the Bench?<\/p>\n<p>Unlike entry-level judicial service, there is no examination through which a practising advocate can simply apply to become a High Court judge. Appointment is a constitutional process involving eligibility, institutional recommendations and consultation between the judiciary and the government.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"The_Constitutional_Starting_Point\"\/><strong>The Constitutional Starting Point<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p>The basic qualification is found in <a href=\"https:\/\/indiankanoon.org\/doc\/1682952\/\">Article 217<\/a> of the Constitution of India.<\/p>\n<p>A person can be appointed as a High Court judge if they are a citizen of India and have either:<\/p>\n<ul>\n<li>held judicial office in India for at least 10 years, or<\/li>\n<li>been an advocate of a High Court, or of two or more High Courts in succession, for at least 10 years.<\/li>\n<\/ul>\n<p>Therefore, for an advocate, the journey towards the High Court does not begin with a separate \u201cHigh Court judge examination\u201d. It begins with building a substantial professional career at the Bar.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Who_Initiates_the_Process\"\/><strong>Who Initiates the Process?<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p>The appointment process is governed by Article 217 and the Memorandum of Procedure (MoP) developed following the Supreme Court\u2019s decisions on judicial appointments.<\/p>\n<p>Under the existing procedure, the process for a High Court appointment is initiated by the Chief Justice of the concerned High Court. The High Court Collegium considers suitable names and forwards its recommendations. These recommendations subsequently move through the Supreme Court Collegium and the Union Government before appointment.<\/p>\n<p>Thus, an advocate does not submit an ordinary job application for the position. Their candidature emerges through the institutional recommendation process.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_Does_the_Collegium_Look_At\"\/><strong>What Does the Collegium Look At?<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p>The constitutional qualification of ten years is only the basic eligibility requirement. A lawyer\u2019s professional record becomes important in considering suitability.<\/p>\n<p>For an advocate, this can involve the nature and quality of their legal practice, professional standing, experience before courts, knowledge of law, integrity and overall suitability for judicial office.<\/p>\n<p>The objective is not simply to identify someone who has practised law for the required number of years, but to identify individuals capable of making the transition from advocacy to impartial adjudication.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"From_Arguing_a_Case_to_Deciding_One\"\/><strong>From Arguing a Case to Deciding One<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p>The transition from advocate to judge represents a fundamental change in professional responsibility.<\/p>\n<p>An advocate\u2019s role is to present the client\u2019s case as effectively as possible within the law. A judge, on the other hand, must consider competing arguments independently and decide the dispute impartially.<\/p>\n<p>The skills developed at the Bar\u2014legal research, interpretation, courtroom experience, understanding of evidence and familiarity with litigation\u2014can therefore become valuable foundations for judicial work.<\/p>\n<p>But judicial office demands a different perspective: the ability to hear both sides and decide without representing either.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"The_Collegium_System\"\/><strong>The Collegium System<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p>The present system is commonly referred to as the Collegium system. It developed through the Supreme Court\u2019s decisions in the Second and Third Judges Cases and continues to operate after the Supreme Court struck down the National Judicial Appointments Commission (NJAC) framework in 2015.<\/p>\n<p>For High Court appointments, the process therefore involves both the High Court Collegium and the Supreme Court Collegium, followed by the government\u2019s role in processing and formally appointing recommended candidates.<\/p>\n<p>The Department of Justice stated in March 2026 that appointments to the High Courts are made under Articles 217 and 224 according to the existing Memorandum of Procedure. At that time, it reported that vacancies and recommendations for High Court appointments remained at various stages of processing.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Additional_Judge_to_Permanent_Judge\"\/><strong>Additional Judge to Permanent Judge<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p>An advocate may initially be appointed as an Additional Judge under Article 224 rather than immediately as a permanent judge. Additional judges can be appointed for the period specified under the Constitution when there is a temporary increase in the court\u2019s business or arrears of work.<\/p>\n<p>The Department of Justice\u2019s current appointment records demonstrate that both advocates and judicial officers continue to be appointed as Additional Judges of different High Courts.<\/p>\n<p>The distinction matters because appointment to the Bench can therefore involve different stages rather than an automatic transition from practising advocate to permanent High Court judge.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"The_Road_from_the_Bar\"\/><strong>The Road from the Bar<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p>For a young law student, the pathway can therefore be broadly understood as:<\/p>\n<p>Law Degree \u2192 Enrolment as Advocate \u2192 Substantial Legal Practice \u2192 Eligibility under Article 217 \u2192 Consideration by High Court Collegium \u2192 Supreme Court Collegium \u2192 Government Processing \u2192 Appointment as High Court Judge<\/p>\n<p>There is, however, no guaranteed timeline between these stages. Meeting the ten-year eligibility requirement only makes an advocate constitutionally qualified to be considered; it does not create an automatic entitlement to appointment.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Why_the_Bar_Matters\"\/><strong>Why the Bar Matters<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p>The presence of practising advocates on the Bench serves an important institutional purpose. Lawyers who have spent years inside courtrooms have firsthand experience of litigation, procedure, evidence, arguments and the practical consequences of judicial decisions.<\/p>\n<p>At the same time, appointment to the Bench requires a transformation in professional outlook. The lawyer who once fought for one side must become the judge responsible for giving both sides a fair hearing.<\/p>\n<p>That is perhaps the most significant transition from the Bar to the Bench.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Conclusion\"\/><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p>Becoming a High Court judge is not simply the next promotion in a lawyer\u2019s career. It is a constitutional appointment carrying a fundamentally different responsibility.<\/p>\n<p>For advocates, ten years of practice provides the constitutional threshold, not the destination.
