The State of Madhya Pradesh, <\/i><\/b><\/em><\/strong><strong><em>2026 INSC 1050,<\/em><\/strong><strong><em><b><i>\u00a0(decided on 24 September 2026<\/i><\/b><\/em><\/strong>), the <strong><em><b><i>Supreme Court of India<\/i><\/b><\/em><\/strong>, speaking through <strong><em><b><i>Justices Vikram Nath, Sandeep Mehta <\/i><\/b><\/em><\/strong>and <strong><em>Vijay Bishnoi<\/em><\/strong>, considered the conviction of the Appellant for the sexual assault and murder of his approximately six-year-old step Daughter. While the Supreme Court ultimately upheld the conviction, it interfered with the sentence of death and substituted it with imprisonment for the remainder of the Appellant\u2019s natural life without remission.<\/p>\n<p>\u00a0<\/p>\n<p><strong>BRIEF FACTS<\/strong><\/p>\n<p>The Prosecution case was that the Appellant, after marrying the Victim\u2019s Mother, lived with the Victim in the matrimonial home. The Prosecution alleged that the Appellant subjected the child to repeated sexual abuse and subsequently killed her by throttling.<\/p>\n<p>The Mother of the Victim was the principal eyewitness. According to her testimony, she had witnessed the Appellant sexually abusing the Victim and on the relevant day, saw him strangling the Victim. The Prosecution case was supported by medical evidence. The post-mortem examination indicated that the Victim had died from asphyxia caused by throttling and also recorded an injury consistent with recent sexual assault.<\/p>\n<p>The Trial Court convicted the Appellant under Sections 376 (Punishment of Rape) (2)(f), 376(2)(n), 376AB, 302 (Punishment of murder) and 201(Causing disappearance of evidence of offence or giving false information to screen offender) of the Indian Penal Code, 1860 and under Sections 5 and 6 of the Protection of Children from Sexual Offences Act, 2012 and imposed the death penalty for the Offences under Sections 302 and 376AB IPC. The High Court affirmed both the conviction and the death sentence.<\/p>\n<p>\u00a0<\/p>\n<p>Before the Supreme Court, however, an important procedural issue arose. The principal witness had originally been cross-examined by Legal Aid Counsel who had been appointed on the very day of her evidence, leaving little meaningful opportunity for preparation. The Supreme Court therefore directed further cross-examination in 2025.<\/p>\n<p>\u00a0<\/p>\n<p><strong>ISSUES OF LAW<\/strong><\/p>\n<ol>\n<li>Whether the deficiency in the original cross-examination of the principal Prosecution Witness had been adequately cured by the subsequent cross-examination.<\/li>\n<li>Whether the testimony of the Victim\u2019s Mother could safely be relied upon despite alleged omissions, contradictions and improvements.<\/li>\n<li>Whether the medical and other corroborative evidence established the Appellant\u2019s involvement in the sexual assault and murder.<\/li>\n<li>Whether the alleged defects in investigation created a reasonable doubt in favour of the Appellant.<\/li>\n<li>Whether the case satisfied the constitutional and judicial standards necessary for imposing the death penalty.<\/li>\n<li>Whether an intermediate sentence of imprisonment for the remainder of natural life could appropriately substitute the death sentence.<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p><strong>ANALYSIS OF THE JUDGEMENT<\/strong><\/p>\n<p>One of the most significant aspects of the Judgment is the Supreme Court\u2019s treatment of the Appellant\u2019s right to effective legal representation. The Court observed that appointing Legal Aid Counsel on the same day on which the principal Prosecution Witness was examined and cross-examined did not provide sufficient opportunity for meaningful preparation. In a capital case, effective assistance of counsel assumes particular importance because the consequences for the accused are irreversible.<\/p>\n<p>However, instead of ordering an entirely fresh trial, the Supreme Court adopted a narrower corrective approach. It directed further cross-examination of the Victim\u2019s Mother, provided the defence gets access to complete Record and permitted representation through counsel of the Appellant\u2019s choice. The Court ultimately concluded that the defect had been sufficiently addressed and that no continuing prejudice had been demonstrated.<\/p>\n<p>The Court rejected the argument that the Mother\u2019s testimony should be discarded merely because she was related to both the Victim and the Appellant. The Judgment reiterated the distinction between a <em>\u201crelated witness\u201d<\/em>\u00a0and an <em>\u201cinterested witness\u201d. <\/em>A relationship by itself does not establish a motive to falsely implicate an Appellant. The Court also recognized the practical difficulty of proving Offences committed inside a home, particularly sexual offences against children, where independent eyewitnesses are rarely available.<\/p>\n<p>Another important evidentiary principle reaffirmed by the Court was that there is no legal requirement for a particular number of witnesses to establish a fact. A conviction can rest upon a prime witness where that testimony is found to be reliable. The Court also declined to apply the rigid approach that a Witness must be rejected entirely merely because portions of the testimony contain inconsistencies or omissions. Instead, the judicial task is to separate reliable material from exaggeration or error and determine whether the trustworthy portion is sufficiently supported by the remaining evidence.<\/p>\n<p>The Court recognized the exceptionally grave nature of the crime and identified the killing of the Victim to suppress the evidence of sexual assault as a particularly serious aggravating circumstance. Nevertheless, it held that the determination of the appropriate sentence cannot rest solely on the gravity of the offence. The Court examined the Appellant\u2019s individual circumstances, including childhood deprivation, poverty, absence of previous convictions and satisfactory conduct in custody. It also considered the material placed before it concerning the possibility of reformation.<\/p>\n<p>The Court disagreed with an approach that effectively treated the circumstances of the offender as carrying no weight. According to the Judgment, death penalty can be sustained only where, after considering both the crime and the criminal, the alternative life imprisonment is unquestionably inadequate and the possibility of reformation has been excluded. Consequently, the Court found that although the crime was of the highest gravity, the material before it did not establish that the Appellant was beyond the possibility of reformation. It therefore commuted the death sentence to imprisonment for the remainder of his natural life, without remission.<\/p>\n<p>\u00a0<\/p>\n<p><strong>CONCLUSION<\/strong><\/p>\n<p>The Judgment in <em>Waris v. State of Madhya Pradesh<\/em>\u00a0is significant not because it diminishes the seriousness of the crime, but because it demonstrates the structured nature of judicial sentencing. First, a fair trial extends beyond procedural formalities and requires the Appellant to have meaningful and effective legal representation, particularly in cases involving the possibility of an irreversible punishment. Secondly, the death penalty cannot follow automatically from the evilness of an offence. The Court must examine the offender as an individual and determine whether the possibility of reformation has truly been ruled out.<\/p>\n<p>By substituting the death penalty with imprisonment for the remainder of natural life without remission, the Court adopted an intermediate sentencing course recognized in its jurisprudence.
