A worker who\u2019s offered guaranteed hours can turn the offer down and stay on their existing contract if they\u2019d rather keep the flexibility, something the government has been explicit about protecting for people who genuinely want it, students, people with caring responsibilities, and others who benefit from variable hours.<\/p>\n<p class=\"wp-block-paragraph\">The scale of who this affects is worth grounding in real numbers. ONS data puts the current zero-hours workforce at <strong>around 1.2 million people, roughly 3.6% of all UK employment<\/strong>. It\u2019s not spread evenly. <a href=\"https:\/\/www.cipd.org\/globalassets\/media\/knowledge\/knowledge-hub\/reports\/zero-hours-contracts-report-aug-2022_tcm18-110465.pdf\">CIPD\u2019s own research<\/a> and <a href=\"https:\/\/www.ukhospitality.org.uk\/zero-hours-contract-reforms-what-they-mean-for-hospitality-businesses\/\">UKHospitality<\/a> both confirm the same concentration independently: hospitality, retail, transport, arts and entertainment, and health and social care carry the bulk of it.<\/p>\n<h3 class=\"wp-block-heading\">What\u2019s Actually Still Being Decided<\/h3>\n<p class=\"wp-block-paragraph\">Here\u2019s the part that makes \u201cwhat we know so far\u201d the honest title for this piece rather than a hedge: the actual mechanics of all three rights are still genuinely open.<\/p>\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.bakermckenzie.com\/en\/insight\/publications\/2026\/06\/united-kingdom-reforms-to-zero-hours-and-similar-contracts\">Baker McKenzie\u2019s analysis<\/a> of the government\u2019s consultation, which closed on <strong>25 August 2026<\/strong>, confirms the scale of what\u2019s still unresolved:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>The low-hours threshold<\/strong>: the consultation considered a range from 8 to 48 hours a week, with the government\u2019s own stated preference sitting between 8 and 20<\/li>\n<li><strong>What counts as \u201creasonable notice\u201d<\/strong>: somewhere between 1 and 4 weeks, still to be fixed in regulations<\/li>\n<li><strong>How the guaranteed-hours offer gets calculated<\/strong>: mean or median average hours over the reference period, a genuinely different outcome depending on which method is chosen<\/li>\n<li><strong>The reference period itself<\/strong>: <a href=\"https:\/\/www.ukhospitality.org.uk\/zero-hours-contracts-the-new-frontier\/\">UKHospitality confirms<\/a> the government\u2019s stated preference is <strong>12 weeks<\/strong>, though sector voices are already pushing for longer, arguing that 26 weeks would give a more accurate picture of genuinely variable work<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">None of this has a final answer yet. The consultation has closed, but the regulations that will actually settle these numbers haven\u2019t been published, which means any specific figure quoted right now, including the government\u2019s own stated preferences, should be read as a starting point for discussion, not a confirmed rule.<\/p>\n<h3 class=\"wp-block-heading\">What Doesn\u2019t Trigger a Payment (The Parts Already Decided)<\/h3>\n<p class=\"wp-block-paragraph\">Not everything about this reform is still up in the air. A few specific mechanics are already settled, confirmed directly in <a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/6a1d6024c7335e2ca6daad8c\/zero-hours-contracts.pdf\">GOV.UK\u2019s factsheet<\/a>, and worth knowing precisely.<\/p>\n<p class=\"wp-block-paragraph\">The right to reasonable notice, and the right to a short-notice cancellation payment, both apply specifically to <strong>employer-initiated<\/strong> changes. If a worker tells their employer at short notice that they can no longer work a shift, or simply doesn\u2019t turn up, that\u2019s a worker-initiated cancellation, not an employer-initiated one, and no payment is owed. The same logic applies if two workers voluntarily agree between themselves to swap a shift at short notice: the worker giving up the shift isn\u2019t entitled to a payment either.<\/p>\n<p class=\"wp-block-paragraph\">This distinction matters practically, because it means the new rights aren\u2019t a blanket guarantee against every kind of shift disruption. They\u2019re specifically aimed at situations where the employer is the one changing the plan, not the worker.<\/p>\n<h3 class=\"wp-block-heading\">How This Applies to Agency Workers<\/h3>\n<p class=\"wp-block-paragraph\">Agency workers get the same three rights, but the mechanics work slightly differently given the three-way relationship between worker, agency, and hirer, confirmed directly in <a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/6a1d6024c7335e2ca6daad8c\/zero-hours-contracts.pdf\">GOV.UK\u2019s factsheet<\/a>:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>The hirer<\/strong> is responsible by default for making the guaranteed hours offer, reflecting the hours the worker actually worked under that hirer\u2019s direction during the reference period. If accepted, the worker moves onto a contract directly with the hirer, not the agency.<\/li>\n<li><strong>The agency<\/strong> is responsible for making short-notice payments directly to the worker, specifically so the worker isn\u2019t left waiting while a dispute over liability gets sorted out. The agency can then recoup that payment from the hirer afterward.<\/li>\n<li>The same worker-initiated exclusion from the section above applies here too, neither the agency nor the hirer owes a payment if the worker cancels the shift themselves.<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">The scale here is real. An estimated <strong>900,000 people<\/strong> were working in temporary agency jobs in the UK as of March 2024, with around <strong>140,000<\/strong> of them also on a zero-hours arrangement. A 2021 Agency Worker Survey found genuine appetite for change: <strong>55% of agency workers had requested a permanent contract<\/strong> between January 2019 and September 2020, most commonly citing job security and a more consistent working pattern as their reasons.<\/p>\n<h3 class=\"wp-block-heading\">What Happens If an Employer Gets This Wrong<\/h3>\n<p class=\"wp-block-paragraph\">The consequences for breaching these rights aren\u2019t uniform across all three:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Guaranteed hours<\/strong>: <a href=\"https:\/\/www.trowers.com\/insights\/2025\/july\/zero-hours-ending-one-sided-flexibility\">Trowers &amp; Hamlins confirms<\/a> a dismissal because a worker accepted, or refused, a guaranteed hours offer is <strong>automatically unfair<\/strong>, with <strong>no minimum length of service required<\/strong> to bring the claim. <a href=\"https:\/\/www.darwingray.com\/zero-hours-contracts-how-the-employment-rights-act-2025-will-change-the-nature-of-casual-work\/\">Darwin Gray independently confirms<\/a> the same mechanism.<\/li>\n<li><strong>Reasonable notice<\/strong>: a breach here doesn\u2019t carry the same automatic unfair dismissal protection. It\u2019s treated as a detriment instead, still enforceable through an employment tribunal, but a genuinely narrower category of protection than the one attached to guaranteed hours specifically.<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">That distinction matters for how seriously each right needs to be treated operationally. Getting a guaranteed hours decision wrong carries the heaviest, most immediate legal consequence of the three.<\/p>\n<h3 class=\"wp-block-heading\">What Employers Should Do Now<\/h3>\n<p class=\"wp-block-paragraph\">None of the open questions above are a reason to wait until the regulations land.<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Identify every worker currently on a zero-hours or low-hours contract now<\/strong>, rather than waiting to find out later which of them will qualify once the threshold is finally set.<\/li>\n<li><strong>Start tracking actual worked patterns<\/strong>, since whatever reference period and calculation method get confirmed, the underlying data, how many hours someone genuinely works, week to week, is what any future guaranteed-hours offer will be built on.<\/li>\n<li><strong>Watch for the two-tier workforce risk.<\/strong> <a href=\"https:\/\/www.brabners.com\/insights\/leisure-hospitality\/guaranteed-hours-contracts-how-employers-should-prepare\">Brabners flags<\/a> a real possibility: employers shifting toward fixed-term contracts specifically to avoid the guaranteed hours obligation, creating one group of workers with genuine security and another without it. That\u2019s a real operational choice worth thinking through deliberately, not drifting into by accident.<\/li>\n<li><strong>Build a review point into whatever policy you draft now<\/strong>, since the specific thresholds, notice periods, and calculation method are all still provisional.
