{"id":7069935,"date":"2026-09-30T03:26:20","date_gmt":"2026-09-30T03:26:20","guid":{"rendered":"https:\/\/peraltafinancing.com\/?p=7069935"},"modified":"2026-09-30T03:26:20","modified_gmt":"2026-09-30T03:26:20","slug":"one-loose-end-means-jury-trial-on-fmla-retaliation-claim","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=7069935","title":{"rendered":"One &#8220;loose end&#8221; means jury trial on FMLA retaliation claim"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div itemprop=\"description articleBody\">\n<p>Employers, when we attorneys advise you to \u201ctie up one loose end\u201d before deciding to terminate an employee, it\u2019s not because we&#8217;re trying to make your life harder.<\/p>\n<p>We\u2019re trying to make sure you don\u2019t end up like this employer.<\/p>\n<h2><span style=\"color: #043673;\"><strong>It started out so well . . .<\/strong><\/span><\/h2>\n<p>Our plaintiff (we\u2019ll call her \u201cMelanie\u201d) had a 13-year-old son with cancer. She informed her employer that she would need to take time off to care for him.<\/p>\n<p>There is no doubt that the son\u2019s condition was a qualifying \u201cserious health condition\u201d within the meaning of the Family and Medical Leave Act.<\/p>\n<p>When Melanie requested the leave, her employer promptly gave her all the FMLA paperwork, including a medical certification form for the son. The employer also informed her that part of the medical certification had to be completed by the son\u2019s health care provider and returned in 15 days. Melanie then began her leave.<\/p>\n<p>As of a couple of days after the 15-day deadline, Melanie had still not returned the medical certification form. The Human Resources representative contacted her and said that she needed to get the form turned in. Melanie replied that she would get it completed that day, during her son\u2019s medical appointment with Dr. Julie.<\/p>\n<p>That was the last the employer heard from Melanie that day.<\/p>\n<p>The following day, HR contacted Melanie again and said they needed to have the completed form turned in by close of business that day. Melanie sent in a form. The form had handwritten details about the son\u2019s condition and treatment, and it was illegibly signed by somebody. (Must&#8217;ve been the doctor, am I right?)<\/p>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.constangy.com\/employment-labor-insider\/assets\/htmlimages\/Illegible.AdobeStock_1800946223.jpeg\" width=\"2000\" height=\"521\" alt=\"\" style=\"margin-left: auto; margin-right: auto; display: block;\"\/><span style=\"color: #043673;\"><strong>Not the actual signature. But it was about this bad.<\/strong><\/span><\/p>\n<p>And the section with the health care provider\u2019s contact information (top of Section III) was left blank.\u00a0<\/p>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.constangy.com\/employment-labor-insider\/assets\/htmlimages\/Screenshot%202026-09-17%20at%201.15.33%E2%80%AFPM.png\" width=\"2000\" height=\"846\" alt=\"\" style=\"margin-left: auto; margin-right: auto; display: block;\"\/><span style=\"color: #043673;\"><strong>This is the part I&#8217;m talking about.<\/strong><\/span><\/p>\n<p>The HR representative told Melanie to get Section III completed by the end of the week.<\/p>\n<h2><span style=\"color: #043673;\"><strong>Here\u2019s where things get messed up<\/strong><\/span><\/h2>\n<p>Here\u2019s where things get messed up.<\/p>\n<p>According to Melanie, she couldn\u2019t get in touch with Dr. Julie, who was apparently on maternity leave, and her office was closed. So Melanie contacted her son\u2019s patient advocate from a different medical practice. (The doctors at this second practice were going to provide the son\u2019s treatment if pathology confirmed his initial diagnosis.) According to Melanie, the patient advocate suggested that Melanie list these &#8220;treating&#8221; physicians instead.<\/p>\n<p>So that\u2019s what Melanie did, and she apparently is the one who filled in the top of Section III with these two other doctors&#8217; names and contact information.<\/p>\n<p><span style=\"color: #9d1d86;\"><strong>Editorial comment:<\/strong><\/span> <em>It sounds like Melanie was in a medical-legal bureaucratic hell. I\u2019ve reviewed the court file in part, and it doesn\u2019t look to me like she was dishonest. From what I can tell, the only part she filled out for the treating doctors was the field for their names, addresses, and contact information. It doesn&#8217;t look like she forged any signatures or made up pertinent \u201cfacts\u201d about her son\u2019s condition. Those parts, I think, were completed by Dr. Julie before Dr. Julie went out on leave.<\/em><\/p>\n<p>Anyway, Melanie turned in the medical certification, including the original medical information and illegible signature, the names and contact information for the two treating physicians, and no new signatures.<\/p>\n<p>It appeared to HR that the illegible signature on the form did not match the names of either of the two treating physicians. (How HR was able to read the signature to tell that, I&#8217;ll never know.)<\/p>\n<p>So HR contacted the patient advocate and asked whether the form was \u201clegitimate.\u201d The patient advocate checked, and replied that neither of the two treating physicians had signed the form. The advocate recommended that HR check with Dr. Julie, and provided Dr. Julie\u2019s phone number.<\/p>\n<p>So HR followed up with Dr. Julie, right?<\/p>\n<p>Wrong.<\/p>\n<p>Well, HR asked Melanie about the apparent discrepancies, right?<\/p>\n<p>Wrong.<\/p>\n<p>Based on its investigation which did not include this follow-up, HR determined that Melanie had falsified her medical certification form and fired her that very day.<\/p>\n<h2><span style=\"color: #043673;\"><strong>You&#8217;ll never guess what happened next!<\/strong><\/span><\/h2>\n<p>Melanie sued for FMLA retaliation. The employer filed a motion for summary judgment. <u><a href=\"https:\/\/www.constangy.com\/employment-labor-insider\/assets\/htmldocuments\/Jones%20v.%20Axios%20SJ%20Order%209.11.26.pdf\">In a decision issued last Friday<\/a><\/u>, the court denied the employer&#8217;s motion, meaning that Melanie&#8217;s case will go to trial if it doesn\u2019t settle.<\/p>\n<p>The court correctly acknowledged that bad timing alone wasn&#8217;t enough to defeat the employer. And, under the \u201cgood-faith honest belief\u201d rule, the employer wouldn\u2019t necessarily lose just because it turned out to be wrong about the alleged falsification (if indeed it was wrong).<\/p>\n<p>But, according to the court, it <em>was<\/em> a problem that there was bad timing coupled with the failure to follow that last lead provided by the patient advocate \u2013 in other words, failing to call Dr. Julie to determine whether she had signed the form. And failing to ask Melanie about it before firing her.<\/p>\n<p>In another twist, Melanie\u2019s attorney pointed out to the court that the signature on the medical certification appeared to be a \u201cJ\u201d followed by illegible scribble.<\/p>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.constangy.com\/employment-labor-insider\/assets\/htmlimages\/Doctor%20Bad%20Handwriting.AdobeStock_715321784.jpeg\" width=\"2000\" height=\"2000\" alt=\"\" style=\"margin-left: auto; margin-right: auto; display: block;\"\/><span style=\"color: #043673;\"><strong>For illustrative purposes only. Not the actual signature.<\/strong><\/span><\/p>\n<p><span style=\"color: #9d1d86;\"><strong>Editorial comment:<\/strong><\/span> <em>The real certification form is in the court file. It looks like a great big \u201cJ\u201d with a wavy line following it. <\/em><span style=\"color: #9d1d86;\"\/><\/p>\n<p>As already noted, the diagnosing\/referring physician, the one on maternity leave, is named \u201cJulie.\u201d One of the treating physicians from the other medical practice is named \u201cJonathan.\u201d<\/p>\n<p>The court said that the \u201cJ [wavy line]\u201d signature could indicate that the form was signed by Dr. <em>Jonathan<\/em>. In other words, maybe the employer didn\u2019t have a reasonable basis to suspect that a treating physician hadn\u2019t signed the certification!<\/p>\n<p><span style=\"color: #9d1d86;\"><strong>Editorial comment:<\/strong><\/span> <em>I\u2019m not sure I agree with the court on this point since the same signature was on the original form, and it was dated a few weeks earlier . . . but whatever.<\/em><\/p>\n<p>Anyway, whether this was retaliation against Melanie for wanting to take FMLA leave or just an HR snafu is far from clear. But I do agree with the court that the employer would probably not be facing a jury trial if it had (1) tried to follow up with Dr. Julie, and (2) followed up with Melanie before making the decision to fire her for falsification.<\/p>\n<p>My standard summary judgment disclaimer is available <u><a href=\"https:\/\/www.constangy.com\/employment-labor-insider\/robins-quickie-guide-to-motions-to-dismiss-summary-judgment-and-trial\">here<\/a><\/u>.<\/p>\n<h2><span style=\"color: #043673;\"><strong>Moral<\/strong><\/span><\/h2>\n<p>Employers, when documentation submitted by an employee looks suspicious, do follow <em>all<\/em> possible leads before assuming falsification was involved and terminating the employee. This applies not only to weird-looking FMLA paperwork, but also to time records and all other documentation where employees are required to be truthful.<\/p>\n<p>And another thing: Compliance with technical FMLA medical certification requirements can be a nightmare for employees, who aren&#8217;t lawyers and are already dealing with the stress of their own or their family member&#8217;s serious health condition. And doctors <em>hate<\/em> filling out these forms. Some even charge their patients for doing it. Given all that, employers should consider cutting employees some slack on the legal deadlines. And even if the employees fill in names and contact information so the doctors don&#8217;t have to do it themselves, that shouldn&#8217;t be the end of the world as long as the doctors themselves have confirmed the substantive parts of the form.\u00a0<\/p>\n<\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>Employers, when we attorneys advise you to \u201ctie up one loose end\u201d before deciding to terminate an employee, it\u2019s not because we&#8217;re trying to make your life harder.
