The new Act will replace the Holidays Act 2003 from <strong>6 August 2028<\/strong>.<\/p>\n<p class=\"wp-block-paragraph\">For now, the current Holidays Act continues to apply. But the Ministry of Business, Innovation and Employment (MBIE) has recommended that employers, accountants and bookkeepers start preparing for the transition today. That includes checking payroll data and employee records, and making sure you\u2019re using the current leave setup available in their payroll software.<\/p>\n<p class=\"wp-block-paragraph\">Changes to payroll legislation can create a lot of questions for small businesses and their advisors. Xero has closely followed the Employment Leave reforms and, now that the legislation is confirmed, is preparing Xero Payroll for the changes and helping customers transition smoothly when they take effect.<\/p>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Whats_changing\"\/><strong>What\u2019s changing?<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p class=\"wp-block-paragraph\">The Employment Leave Act is intended to simplify how leave is earned, taken and paid in New Zealand.<\/p>\n<p class=\"wp-block-paragraph\">Among the changes, the new system will introduce:<\/p>\n<ul class=\"wp-block-list\">\n<li>Hours-based accrual for annual and sick leave from day one<\/li>\n<li>Sick leave that is proportionate to an employee\u2019s contracted hours<\/li>\n<li>New rules for classifying hours worked into standard, casual and additional hours which impact leave accruals \/ payment<\/li>\n<li>Simpler leave payment calculations<\/li>\n<li>New requirements for leave records and pay statements<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">Employment New Zealand has published<a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/changes-to-leave-coming-in-2028\/how-employers-can-get-ready-for-the-changes-coming-in-2028\" target=\"_blank\" rel=\"noreferrer noopener\"> detailed guidance<\/a> on what the changes mean and how employers can prepare, as well as a<a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/changes-to-leave-coming-in-2028\/suggested-preparation-for-payroll-providers-employers-and-employees\" target=\"_blank\" rel=\"noreferrer noopener\"> suggested preparation timeline<\/a>. For more detail on the reform itself, MBIE has also published an <a href=\"https:\/\/www.mbie.govt.nz\/business-and-employment\/employment-and-skills\/employment-legislation-reviews\/holidays-act-reform-employment-leave-act\">overview<\/a> of the Holidays Act reform and Employment Leave Act 2026.<\/p>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_Xero_doing\"\/><strong>What is Xero doing?<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p class=\"wp-block-paragraph\">Now that the legislation is confirmed, we\u2019re putting our response into practice.<\/p>\n<p class=\"wp-block-paragraph\"><strong>We\u2019re already working through the changes needed in Xero Payroll to help our customers get ready for the 6 August 2028 commencement date.<\/strong> We\u2019ll share more detail as that work progresses, including what will change in Xero Payroll and any steps customers, accountants and bookkeepers will need to take.<\/p>\n<p class=\"wp-block-paragraph\">In the meantime, the current Holidays Act continues to apply, and there are useful things businesses can start doing now to make the transition easier.<\/p>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Start_with_accurate_up-to-date_payroll_data\"\/><strong>Start with accurate, up-to-date payroll data<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p class=\"wp-block-paragraph\">Good payroll data will make the eventual transition easier.<\/p>\n<p class=\"wp-block-paragraph\">Employment New Zealand recommends reviewing payroll and employment data during the preparation period to identify gaps or entitlements that may affect implementation and leave conversion.<\/p>\n<p class=\"wp-block-paragraph\">That means making sure employee information is current and addressing known issues in payroll or leave records rather than carrying them forward into the transition.<\/p>\n<p class=\"wp-block-paragraph\">For accountants and bookkeepers running payroll on behalf of clients, it\u2019s also worth identifying which client organisations may need attention well before 2028.<\/p>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Using_Xero_Payroll_Check_whether_you_need_to_update_your_leave_setup\"\/><strong>Using Xero Payroll? Check whether you need to update your leave setup<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p class=\"wp-block-paragraph\">Organisations that started using Xero Payroll from 5 August 2024 already use our current employment types and leave setup.<\/p>\n<p class=\"wp-block-paragraph\">Some organisations that started using Xero Payroll before then still need to move from the older leave setup to the current experience.<\/p>\n<p class=\"wp-block-paragraph\">If that\u2019s you, Xero has a <a href=\"https:\/\/payroll.xero.com\/Employee\/NZ\/holidays-act\" target=\"_blank\" rel=\"noreferrer noopener\">conversion tool<\/a> to guide you through the change. It helps you:<\/p>\n<ul class=\"wp-block-list\">\n<li>Check whether any employee settings need updating<\/li>\n<li>Review and confirm employment types<\/li>\n<li>Review how existing leave balances will be converted<\/li>\n<li>Complete the move with step-by-step guidance in Xero<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">Most organisations complete the conversion in around three minutes.<\/p>\n<p class=\"wp-block-paragraph\">Completing the conversion now means your organisation is using Xero\u2019s current approach to employment types and leave under the Holidays Act, putting you in a better position as preparation for the Employment Leave Act progresses.<\/p>\n<p class=\"wp-block-paragraph\"><strong>How the current conversion prepares you for future changes<\/strong><\/p>\n<p class=\"wp-block-paragraph\">Customers still using Xero\u2019s older leave setup will need to move to the current leave units and employment types experience before transitioning to the future Employment Leave Act requirements.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Moving leave records from hours to weeks and days may seem unnecessary when the Employment Leave Act will introduce a new hours-based framework from 6 August 2028.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">However, the current Holidays Act and the incoming Employment Leave Act work differently. The new Act introduces different rules for how leave is earned, taken, paid and recorded, so the older setup cannot simply carry over to the new model.<\/p>\n<p class=\"wp-block-paragraph\">Making the move now allows you to review your employee settings and leave balances well before 2028, putting your payroll records in a better position for the future transition.
