If you were hurt in an accident in North Carolina and the insurance company is hinting that you were partly to blame, pay close attention. In this state, being even slightly at fault can cost you everything. It is one of the harshest fault rules in the country, and most people have never heard of it until it is used against them.<\/p>\n

THE SHORT ANSWER<\/strong>\u2013 North Carolina is one of only a few pure contributory negligence jurisdictions. If you are found even 1% at fault for your own injury, you can generally be barred from recovering anything. Contributory negligence<\/a> is a legal rule about fault. It says that if your own carelessness contributed to your injury, even a little, you may not be able to recover damages from the other party. In most states this idea has been softened, so being partly at fault only reduces your compensation. North Carolina did not soften it. Here, partial fault can be a complete bar to recovery.<\/p>\n

Only a handful of jurisdictions still follow pure contributory negligence: North Carolina, Virginia, Maryland, Alabama, and Washington, D.C. That is why an adjuster may call quickly, sound friendly, and ask for a recorded statement.
