The three-judge bench comprising <strong>Chief Justice Surya Kant<\/strong>, <strong>Justice Joymalya Bagchi<\/strong>, and <strong>Justice V. Mohana<\/strong> upheld the <strong>Telangana High Court\u2019s September 18 order<\/strong> that had disqualified him under the <strong>Tenth Schedule<\/strong> of the Constitution. The apex court found no grounds for interference and ruled that the High Court had correctly interpreted the provisions of the anti-defection law.<\/p>\n<p><strong>Danam Nagender<\/strong> was elected as a <strong>Bharat Rashtra Samithi (BRS)<\/strong> legislator from the <strong>Khairatabad constituency<\/strong> in the <strong>2023 Assembly elections<\/strong>. He subsequently switched allegiance to the <strong>Congress party<\/strong> and contested the <strong>2024 Lok Sabha election<\/strong> from the <strong>Secunderabad constituency<\/strong> on a Congress ticket without resigning from his Assembly seat. The <strong>High Court<\/strong> had declared the disqualification effective from <strong>April 23, 2024<\/strong>, the date when he filed his nomination papers for the parliamentary polls, and declared the <strong>Khairatabad seat vacant<\/strong>.<\/p>\n<p>During the Supreme Court hearing, <strong>Justice Bagchi<\/strong> made sharp observations about the case, comparing Nagender\u2019s actions to treating his MLA seat as a <strong>\u201cfixed deposit\u201d<\/strong> while attempting the <strong>\u201cshare market\u201d<\/strong> of a Lok Sabha contest. The court also questioned whether a <strong>\u201cghar wapasi\u201d<\/strong> or return to the original party could reverse the voluntary giving up of membership under <strong>Paragraph 2(1)(a)<\/strong> of the anti-defection law. The dismissal of the petition now clears the path for a by-election to be held in the <strong>Khairatabad constituency<\/strong> in <strong>Hyderabad<\/strong>.<\/p>\n<p>Opposition parties <strong>BJP<\/strong> and <strong>BRS<\/strong> welcomed the Supreme Court\u2019s decision, describing it as a victory for constitutional principles and a strong message against political defection.
