{"id":7063492,"date":"2026-09-21T23:11:44","date_gmt":"2026-09-21T23:11:44","guid":{"rendered":"https:\/\/peraltafinancing.com\/activist\/block-trumps-push-to-lock-up-disabled-people\/"},"modified":"2026-09-21T23:11:44","modified_gmt":"2026-09-21T23:11:44","slug":"block-trumps-push-to-lock-up-disabled-people","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=7063492","title":{"rendered":"Block Trump\u2019s Push to Lock up Disabled People"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"content\" data-transition=\"content\" data-loop=\"false\" itemprop=\"articleBody\">\n<div>\n<p class=\"lead\">During the same summer in which Americans marked the 250th anniversary of the signing of the Declaration of Independence, disabled Americans have faced a renewed threat to their freedom: an effort by the administration of President Donald Trump to reopen the door to forced institutionalization.<\/p>\n<p>On June 18, Trump\u2019s Department of Justice (DOJ) issued a <a href=\"https:\/\/www.justice.gov\/olc\/media\/1446701\/dl\" target=\"_blank\" aria-label=\"Link opens in new window (memorandum opinion)\">memorandum opinion<\/a> concluding that neither Section 504 of the <a href=\"https:\/\/www.dol.gov\/agencies\/oasam\/centers-offices\/civil-rights-center\/statutes\/section-504-rehabilitation-act-of-1973\" target=\"_blank\" aria-label=\"Link opens in new window (Rehabilitation Act)\">Rehabilitation Act<\/a> nor Title II of the <a href=\"https:\/\/www.ada.gov\/\" target=\"_blank\" aria-label=\"Link opens in new window (Americans with Disabilities Act)\">Americans with Disabilities Act<\/a>\u00a0(ADA) requires states to integrate individuals with disabilities into community settings. Even more alarming, it asserts that states can offer any \u201cnonarbitrary rationale\u201d for keeping someone institutionalized, including budget constraints.<\/p>\n<p>This makes me shudder. I was part of a team of community-based providers brought in to help disabled people transition out of the notorious <a href=\"https:\/\/jkheneghan.com\/city\/brookrun\/hospital\/\" target=\"_blank\" aria-label=\"Link opens in new window (Brook Run Hospital)\">Brook Run Hospital<\/a> in Atlanta, Georgia, when it was finally closed in 1997. Witnessing the grim reality within those execrable halls, I learned how being forced to live in an institution scars both the body and soul. We cannot let this happen again. And yet, that is exactly the direction in which the Trump Administration is trying to take us.<\/p>\n<p>A month after issuing its opinion, the DOJ published a <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/07\/20\/2026-14566\/clarification-on-department-of-justice-guidance-titled-statement-of-the-department-of-justice-on\" target=\"_blank\" aria-label=\"Link opens in new window (Federal Register notice)\">Federal Register notice<\/a> declaring that it will no longer rely on its decade-old enforcement guidance set by the U.S. Supreme Court in its\u00a01998 <em><a href=\"https:\/\/tile.loc.gov\/storage-services\/service\/ll\/usrep\/usrep527\/usrep527581\/usrep527581.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (Olmstead)\">Olmstead<\/a><\/em> decision. It argued that the guidance might not survive review under a narrower reading of the ADA.<\/p>\n<p>Then, on August\u00a031, the DOJ, on behalf of the Department of Health and Human Services and in conjunction with the states of Texas, Florida, and Alaska, <a href=\"https:\/\/dredf.org\/wp-content\/uploads\/2026\/09\/124.-Corrected-Jt-Mot-for-Entry-Final-J-Access-Pass.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (asked the court)\">asked the court<\/a> to eliminate all aspects of Section 504 regulations that mention community integration for disabled people.<\/p>\n<p>These efforts <a href=\"https:\/\/www.npr.org\/2026\/06\/20\/nx-s1-5865100\/doj-memo-trump-disability-civil-rights-institutionalization\" target=\"_blank\" aria-label=\"Link opens in new window (reopen)\">reopen<\/a> a door we thought was closed long ago to forcibly segregating disabled people into institutions. And it is happening even though this is a more costly way to go. In 2022, <a href=\"https:\/\/publications.ici.umn.edu\/risp\/data-bytes\/medicaid-funded-servic-for-people-with-IDD-from-institutions-to-home-and-community-based-services-between-1982-and-2020#:~:text=the%20average%20cost%20rose,per%20person%20per%20year.\" target=\"_blank\" aria-label=\"Link opens in new window (according to)\">according to<\/a> the University of Minnesota\u2019s Residential Information Systems Project, the cost of institutional care in the U.S. averaged $159,520 per person per year, versus $55,812 for community-based care.<\/p>\n<p>The deeper danger here is not economic, but ideological. The push for institutionalization is based on the ableist argument that disabled bodies are burdensome to society. When societies accept this argument, those in power can justify segregating disabled people from everyone else.<\/p>\n<p>Ableism does not stop there. Once those in power succeed in using ableist logic to marginalize disabled people, they expand it to scale back the rights of nondisabled people, too. As historian Douglas Baynton <a href=\"https:\/\/courses.washington.edu\/intro2ds\/Readings\/Baynton.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (documented)\">documented<\/a>, arguments for denying women the right to vote rested on the false claim that they were emotionally disabled; arguments for denying Black Americans civil rights rested on the false claim that they were cognitively disabled. The same logic was used to curtail the rights of LGBTQ+ Americans through the false claim that they were psychiatrically disabled.\u00a0<\/p>\n<p>In each case, the rollback of rights for a nondisabled group relied on ableist arguments, and these rollbacks coincided with periods of high institutionalization rates for disabled people. Societies that forcibly institutionalize disabled people normalize logic that can then be used to roll back the rights of nondisabled groups by expanding the definition of who counts as \u201cdisabled.\u201d<\/p>\n<p>In response, a group of<a href=\"https:\/\/dredf.org\/statement-texas-v-kennedy-september-2026\/\" target=\"_blank\" aria-label=\"Link opens in new window ( disability lawyers)\"> disability lawyers<\/a> has been carefully tracking the DOJ\u2019s actions, with the newly formed<a href=\"https:\/\/ncil.org\/community\/?utm_source=Main+AAPD+Mailing+List&amp;utm_campaign=d290bcd64a-EMAIL_CAMPAIGN_2026_08_06_01_06_COPY_01&amp;utm_medium=email&amp;utm_term=0_7d4fdb3943-f9e320fdc9-49994629\" target=\"_blank\" aria-label=\"Link opens in new window ( Defend Community Integration Coalition (DCIC))\"> Defend Community Integration Coalition (DCIC)<\/a> spearheading the grassroots effort to fight for the right of disabled people to live in the community. As of early September, <a href=\"https:\/\/www.durbin.senate.gov\/imo\/media\/doc\/doj_olmstead_letter.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (100 members of Congress)\">100 members of Congress<\/a> and <a href=\"https:\/\/www.governor.ny.gov\/sites\/default\/files\/2026-09\/Governors_Letter_on_Olmstead_9-2026.pdf\" target=\"_blank\" aria-label=\"Link opens in new window (eighteen state governors)\">eighteen state governors<\/a> have affirmed their commitment to community integration and urged the DOJ to halt its efforts.\u00a0<\/p>\n<p>Ableism is never satiated. If states are permitted to follow the guidance of the DOJ and begin forcibly institutionalizing disabled people once again, this loss of rights will expand to where it harms us all. We must work together to fight ableist policies by protecting the civil rights of both disabled and nondisabled Americans.
