Yet in this case,<br \/>\nexcuses were advanced that cast serious doubt on the system&#8217;s transparency.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto;\"><span style=\"font-family: &quot;Times New Roman&quot;,serif; font-size: 20.0pt; mso-ansi-language: EN-GB; mso-fareast-font-family: &quot;Times New Roman&quot;; mso-fareast-language: EN-GB; mso-font-kerning: 0pt; mso-ligatures: none;\">Consider the<br \/>\nhypothetical: if a High Court judge commits murder, can they hide behind<br \/>\njudicial immunity? Justice Varma\u2019s case illustrates the problem. Following the<br \/>\ncash recovery on March 14, 2025, then CJI Sanjiv Khanna constituted a<br \/>\nthree-member committee\u2014Justices Sheel Nagu, G.S. Sandhawalia, and Anu<br \/>\nSivaram\u2014to probe the incident. Delhi High Court Chief Justice D.K. Upadhyaya<br \/>\nsubmitted a preliminary report, noting that a fire broke out in the judge\u2019s<br \/>\nhouse while he was in Bhopal. But does physical absence absolve responsibility?<br \/>\nIf terrorists store an AK-47 in a judge\u2019s residence, intending to kill, can the<br \/>\njudge escape liability simply by not being present?<o:p\/><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto;\"><span style=\"font-family: &quot;Times New Roman&quot;,serif; font-size: 20.0pt; mso-ansi-language: EN-GB; mso-fareast-font-family: &quot;Times New Roman&quot;; mso-fareast-language: EN-GB; mso-font-kerning: 0pt; mso-ligatures: none;\">The Supreme Court\u2019s<br \/>\nlandmark judgment in K. Veeraswami vs Union of India (1991) is deeply flawed.<br \/>\nIt holds that judges of constitutional courts cannot face criminal<br \/>\nprosecution\u2014including the registration of an FIR\u2014without prior permission of<br \/>\nthe Chief Justice of India. This creates a discriminatory shield unavailable to<br \/>\nordinary citizens. Crime investigation is the domain of experts, and the police<br \/>\nshould be empowered to act after lodging an FIR, without procedural hurdles<br \/>\nthat protect a privileged few.<o:p\/><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto;\"><span style=\"font-family: &quot;Times New Roman&quot;,serif; font-size: 20.0pt; mso-ansi-language: EN-GB; mso-fareast-font-family: &quot;Times New Roman&quot;; mso-fareast-language: EN-GB; mso-font-kerning: 0pt; mso-ligatures: none;\">Take another example:<br \/>\nMPs and MLAs enjoy immunity for what they say or do inside the House. But if<br \/>\none legislator murders another on the floor of Parliament, can they claim<br \/>\nimmunity from trial? Clearly not. Immunity provisions were designed to protect<br \/>\nlegitimate functions, not to shield individuals from accountability for<br \/>\ncognisable offences. If loopholes exist that allow such misuse, they must be<br \/>\namended.<o:p\/><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: normal; mso-margin-bottom-alt: auto; mso-margin-top-alt: auto;\"><span style=\"font-family: &quot;Times New Roman&quot;,serif; font-size: 20.0pt; mso-ansi-language: EN-GB; mso-fareast-font-family: &quot;Times New Roman&quot;; mso-fareast-language: EN-GB; mso-font-kerning: 0pt; mso-ligatures: none;\">True equality before<br \/>\nthe law demands that every citizen\u2014judge, legislator, or layperson\u2014be held<br \/>\naccountable for cognisable offences.
