No.10438\/2026<\/span><\/p>\n<p style=\"text-align: justify;\"><b><span style=\"font-size: large;\">LISHAM IBUNGOTOMBA SINGH Vs\u00a0STATE OF WEST BENGAL\u00a0<\/span><\/b><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">Date : 01-09-2026 This matter was called on for hearing today.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">CORAM :<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">HON&#8217;BLE MR. JUSTICE J.B. PARDIWALA<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">HON&#8217;BLE MR. JUSTICE K. VINOD CHANDRAN<\/span><\/p>\n<p><span><span style=\"font-size: large;\"><a name=\"more\"\/><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">UPON hearing the counsel the Court made the following<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">1. It is shocking to note that the petitioner is in judicial<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">custody as an under-trial accused past eight years and six<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">months. Till this date, only six witnesses have been examined.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #38761d; font-size: large;\"><b>2. We would have definitely considered the plea for bail<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #38761d; font-size: large;\"><b>only on the ground that the petitioner is in judicial custody as<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #38761d; font-size: large;\"><b>an under trial prisoner past more than eight years, however,<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #38761d; font-size: large;\"><b>what has deterred us in exercising our discretion are the<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #38761d; font-size: large;\"><b>antecedents of the petitioner of the very same nature with which<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #38761d; font-size: large;\"><b>he has been charged with in the presence case.<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">3. Let the trial proceed further expeditiously.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">4. The Trial Court shall see to it that the entire trial is<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">completed within a period of six months from today without fail.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">5. The disposal of the trial shall be informed to this<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">Court.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">6. With the aforesaid, the Special Leave Petition stands<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">disposed of.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: large;\">7.
