That means you are on the hook for the entire lease term, which typically spans 12 months but can be longer.\u00a0<\/p>\n<p>If you need to leave your apartment before the end of the lease, you risk losing your security deposit or, even worse, having to pay the rent each month until a new tenant is found.<\/p>\n<p>The reassuring news is that New York landlords have a duty to mitigate damages.\u00a0As such, they must do everything possible to find another tenant at the same rent or at the current market rent, whichever is lower. Alternatively, they can increase the rent in a highly competitive market (such as the current one), thereby letting you\u2014the original tenant\u2014off the hook.<\/p>\n<p>This law is intended to level the playing field between renters and landlords, equally motivating both parties to find a new tenant who meets the building&#8217;s income requirements and can take over the apartment&#8217;s lease.<\/p>\n<hr\/>\n<p dir=\"ltr\"><em>[Editor&#8217;s note: A previous version of this story ran in June 2025.\u00a0We are presenting it again with updated information for September 2026.]<\/em><\/p>\n<hr\/>\n<h3 dir=\"ltr\">How to break your lease<\/h3>\n<p dir=\"ltr\">Despite some challenges, you can make the process work in your favor. A letter sent by registered mail is the typical method; however, your lease should specify how you must communicate. (Don&#8217;t assume an email suffices.) In the termination letter, explain your situation. Be upfront and transparent, and ask about your options.\u00a0<\/p>\n<p dir=\"ltr\">&#8220;Some landlords will act reasonably, so always approach them first. They may ask you to find a replacement or to give them regular access to the apartment so they can show it to prospective tenants themselves,&#8221; said Sam Himmelstein, a longtime tenant rights attorney at Manhattan law firm <a href=\"https:\/\/hmgdjlaw.com\/\">Himmelstein, Gribben &amp; Joseph<\/a>\u00a0(now retired).<\/p>\n<p dir=\"ltr\">Given the frequency of lease breaks, many larger landlords have established general rules and procedures, while smaller, independent landlords tend to respond on a case-by-case basis.\u00a0<\/p>\n<p dir=\"ltr\">&#8220;Big landlords all have a process because they&#8217;ve been asked to do it a thousand times,&#8221; said Phil Horigan, founder of<a href=\"https:\/\/www.leasebreak.com\/\"> Leasebreak,<\/a> a free listing site for short-term rentals and lease breaks. &#8220;They&#8217;ll say, &#8216;Sure, we allow it. And there&#8217;s a very specific way to do it.'&#8221;\u00a0<\/p>\n<p dir=\"ltr\">Know that &#8220;allow&#8221; does not mean &#8220;don&#8217;t worry about the rent you&#8217;re contractually obligated to pay.&#8221; As long as there&#8217;s no lost rent, you may be fine, said Rory Bolger, a broker at <a href=\"https:\/\/www.bhsusa.com\/real-estate-agent\/rory-bolger\">Brown Harris Stevens.<\/a> For instance, a larger landlord may have another renter who needs to relocate.<\/p>\n<p dir=\"ltr\">Other landlords might let you out with a fee, while some management companies will let you break the lease penalty-free if you move into another building in their network.<\/p>\n<p dir=\"ltr\">The goal is to get your landlord to sign a &#8220;surrender of lease&#8221; agreement\u00a0that legally releases you from the contract.<\/p>\n<div class=\"inline-protip\"><label>Pro Tip<\/label><\/p>\n<div class=\"inline-protip-inner\">\n<div class=\"inside\"><span class=\"intro\">Pro Tip:<\/span><\/p>\n<p class=\"inline-protip-editable\">Want peace of mind when looking for a sublet \/ short-term rental? These requirements typically include earning an annual salary of <a href=\"https:\/\/www.brickunderground.com\/rent\/ways-to-get-around-40-x-income-requirements-to-rent-in-nyc\">40 times the monthly rent,<\/a>\u00a0a good credit history, and\u00a0<a href=\"https:\/\/www.brickunderground.com\/rent\/realty-bites-how-do-i-show-proof-of-income-to-rent-a-nyc-apartment-if-im-self-employed-nyc\">proof of employment.<\/a>\u00a0<\/p>\n<p dir=\"ltr\">A landlord can withhold consent if they have a valid reason for the refusal, which might relate to the new tenant&#8217;s financial history or how the apartment will be used\u2014for example, as a therapist&#8217;s office.\u00a0<\/p>\n<p dir=\"ltr\">The <a href=\"https:\/\/www.metcouncilonhousing.org\/help-answers\/if-you-want-to-break-your-lease\/\">Met Council on Housing,<\/a>\u00a0a NYC tenant&#8217;s rights organization, has a guide to what constitutes a reasonable or unreasonable refusal. Their site also outlines your right to suggest another qualified tenant to take your place if you intend to leave your apartment permanently, a process known as an assignment.<\/p>\n<p dir=\"ltr\">In this arrangement, the landlord can agree to\u00a0<a href=\"https:\/\/www.brickunderground.com\/rent\/difference-between-sublet-assignment-nyc-apartment-lease-break-landlord-transfer\">assign the lease<\/a> to the new tenant and then release you from your responsibilities. Once you submit the qualified replacement, the landlord must act within 30 days\u2014and provide a reasonable explanation if they turn down a renter.<\/p>\n<p dir=\"ltr\">Under NYC housing law, you have a similar right to request to sublet your apartment if you live in a building with at least four units. Again, the landlord must respond within 30 days\u2014or 30 days after receiving any additional information the landlord requests; failure to do so is considered consent by default.\u00a0<\/p>\n<p dir=\"ltr\">With a sublet, however, you remain responsible for all lease obligations, including rent, according to Himmelstein.<\/p>\n<p dir=\"ltr\">&#8220;And if the landlord reasonably refuses to consent to the assignment\u2014and it is often unclear what that looks like\u2014the tenant cannot proceed with the assignment. If the landlord <em>unreasonably<\/em> refuses to consent to the sublet, then you can proceed with the subletting, but the landlord might challenge it in court,&#8221; Himmelstein added.<\/p>\n<p dir=\"ltr\">Horigan cited another hiccup with these consent scenarios: The 30-day timeframe is impractical in a competitive rental market.<\/p>\n<p dir=\"ltr\">&#8220;There are few\u2014if any\u2014renters that can wait 30 days for a landlord to make a decision,&#8221; he said. If you don&#8217;t receive a response, he recommends following up with the property owner or leasing agent and working with them directly to achieve the desired outcome.<\/p>\n<p dir=\"ltr\">One final caveat: The right to assign your lease doesn&#8217;t apply if you rent in a co-op or condo building, where you typically rent from an individual owner who is not considered a landlord under NYC law. What&#8217;s more, <a href=\"https:\/\/www.brickunderground.com\/guides\/how-to-buy\/sublet-restrictions-in-a-co-op-vs-condo\">every\u00a0board has its own rules<\/a>\u2014including\u00a0refusing to let an owner re-rent to a new tenant for a lease that&#8217;s shorter than 12 months, or allowing only one tenant per 12-month period.<\/p>\n<p dir=\"ltr\">Read:\u00a0<a href=\"https:\/\/www.brickunderground.com\/buy\/ask-an-expert-respond-to-co-op-board-false-accusation-illegal-sublet-nyc\">&#8220;My co-op board falsely accused me of illegally subletting my unit. What should I do?&#8221;<\/a> for a first-hand account of what you could face if you go this route.<\/p>\n<h4 dir=\"ltr\">3) Avoid breaking your lease in winter, if possible<\/h4>\n<p dir=\"ltr\">The slowest time for rentals is November through February or March, so breaking your lease will be more complicated during this period. First, you and your landlord will find it much easier to get a replacement tenant in the summer. Secondly, Horigan said rents can be anywhere from 10 to 30 percent lower in winter, and the landlord may have to offer more concessions to fill the place.\u00a0<\/p>\n<p dir=\"ltr\">&#8220;Generally, an environment where rent prices are increasing is a better time to break your lease because landlords are incentivized to get new tenants sooner at higher prices,&#8221; Horigan said.\u00a0<\/p>\n<p dir=\"ltr\">But summer is also when landlords often face more vacancies due to apartment turnovers.<\/p>\n<p dir=\"ltr\">&#8220;If a building has five one-bedroom units available for July and you are going to throw another one in the mix, that doesn&#8217;t help the landlord at all,&#8221; Bolger said.\u00a0<\/p>\n<p dir=\"ltr\">On the flip side, if your lease ends in the slower winter months and you want to break it during summer, a landlord might appreciate it if you can find a new 12-month renter with a summer start when prices are much higher. &#8220;The smaller landlords are not always thinking about this opportunity, so it can help get them to work with you,&#8221; Horigan said.\u00a0\u00a0<\/p>\n<p dir=\"ltr\">Most people start looking for a place to rent as early as two or three months in advance. &#8220;The best starting place is to have the apartment marketed 60 days before a lease break,&#8221; Bolger said.\u00a0\u00a0<\/p>\n<h3 dir=\"ltr\">What to know about your security deposit\u00a0<\/h3>\n<p dir=\"ltr\">As a result of <a href=\"https:\/\/www.brickunderground.com\/rent\/difference-between-last-months-rent-and-security-deposit\">changes to the rent laws <\/a>in 2019, landlords must do what they can to find a tenant to replace you. The goal is to incentivize both tenants and landlords equally. Therefore, your security deposit isn&#8217;t necessarily at risk.\u00a0<\/p>\n<p dir=\"ltr\">As\u00a0<span style=\"margin: 0px; padding: 0px;\">Ellen Davidson, a staff attorney at the<a href=\"https:\/\/www.legalaidnyc.org\/\" target=\"_blank\">\u00a0Legal Aid Society in New York, <\/a>explained, i<\/span>f landlords could keep the security deposit whenever a tenant broke their lease, they would be less motivated to mitigate damages by re-renting the apartment. It could be argued that landlords cannot retain your security deposit simply because you break your lease, though they may use it to cover unpaid utility bills or damage to the apartment.\u00a0<\/p>\n<p dir=\"ltr\">The law may also make you less likely to be sued for breaking a lease, but damages could still be imposed to cover repainting, paying a brokerage to re-rent the apartment, and lost rent\u2014all of which might come out of your deposit.\u00a0<\/p>\n<p dir=\"ltr\">Keep in mind that landlords need to provide you with a walk-through at the end of a tenancy, itemize any damage, allow you to make any repairs, and pay you your money back, less any repair costs, within 14 days of the tenancy end. If they don&#8217;t, the landlord forfeits any right to your security deposit.\u00a0<\/p>\n<p dir=\"ltr\">Know, too, that if you were offered <a href=\"https:\/\/www.brickunderground.com\/rent\/how-to-negotiate-rent-when-signing-lease-concessions-months-free-landlord-nyc\">one or two months free<\/a> when you signed the lease, this perk is unlikely to be extended to the incoming tenant. If the free months are at the end of your lease term, you will likely have to forfeit them when re-renting the apartment.\u00a0<\/p>\n<p dir=\"ltr\">And if you are tempted to recover the hefty brokerage fee you just paid when moving in, think again. &#8220;This is something I&#8217;ve seen recently, and while this is certainly understandable, tenants should know they are not legally allowed to charge commissions if they are not a licensed real estate agent,&#8221; Horigan said.<\/p>\n<p dir=\"ltr\">You can, however, hire an agent to help market your apartment to renters. Horigan said part of Leasebreak&#8217;s service matches agents with tenants for this reason. &#8220;But now, under the newly enacted <a href=\"https:\/\/www.brickunderground.com\/rent\/broker-fee-fare-act-start-june-11-rebny-lawsuit-preliminary-injunction\">FARE Act,<\/a> you should be prepared to pay the agent a brokerage fee,&#8221; he noted.\u00a0<\/p>\n<h3 dir=\"ltr\">Be prepared to pay a penalty for breaking a lease<\/h3>\n<p dir=\"ltr\">Even if your security deposit is likely refundable when your apartment is clean, undamaged, and you have a working set of keys, you may still face a penalty for breaking your lease.<\/p>\n<p dir=\"ltr\">Unless you negotiated it before you began renting, your lease likely doesn&#8217;t include a lease-break policy. If it does, however, it might lay out specific monetary penalties if you break the lease in the slower winter months or if you&#8217;re not flexible about showing the apartment to new renters.\u00a0<\/p>\n<p dir=\"ltr\">You may also face additional fees for cleaning or painting costs. One argument against that is based on the maintenance housing code, which requires landlords to\u00a0<a href=\"https:\/\/www.brickunderground.com\/rent\/realty-bites-getting-rental-apartment-painted-three-years-landlords-housing-maintenance-code-nyc\">paint every three years,<\/a>\u00a0but Davidson said &#8220;that rule is not regularly followed&#8221; and might not hold water.\u00a0<\/p>\n<p dir=\"ltr\">Relatedly, Horigan said landlords often do not paint and clean the apartment before the new tenant takes occupancy in a lease break situation. Instead, the apartment comes &#8220;as is.&#8221;<\/p>\n<p dir=\"ltr\">&#8220;To avoid any confusion, you should confirm with your landlord if the apartment will be painted and cleaned before move-in so you can properly communicate this information to the incoming tenant,&#8221; he said.\u00a0<\/p>\n<p dir=\"ltr\">It&#8217;s also worth investigating what your landlord is marketing your apartment for. If you were paying $2,500 and it is listed for $3,000, the landlord is violating the duty to mitigate damages.\u00a0If the new rent is lower, you may have to pay the difference between your rent and the new rent.<\/p>\n<p dir=\"ltr\">In reality, landlords are unlikely to go after tenants for a few thousand dollars in lost rent\u2014especially if you are moving out of the city (or country), making a lawsuit impractical.\u00a0<\/p>\n<h3 dir=\"ltr\">What to know about the tenant blacklist<\/h3>\n<p dir=\"ltr\">Let&#8217;s say your current landlord pushes back on breaking the lease and demands penalties. If you fight back and end up in NYC Housing Court, you could end up on the <a href=\"https:\/\/www.brickunderground.com\/blog\/2014\/05\/tenant_blacklist\">tenant blacklist.<\/a><\/p>\n<p dir=\"ltr\">Rent laws say landlords can&#8217;t use the tenant blacklist alone to deny someone an apartment. That means you should, in theory, not have a problem renting in another building in NYC.<\/p>\n<p dir=\"ltr\">In practice, though, the ban on using housing court information is riddled with loopholes and &#8220;unenforceable,&#8221; Frisch said. He explained that landlords will still find ways to vet incoming tenants, and because landlords cannot take more than one month&#8217;s rent as a security deposit (a common workaround in the past for renters who do not meet the financial criteria), they are less likely to accept applicants with less-than-stellar <a href=\"https:\/\/www.brickunderground.com\/rent\/what-landlords-look-credit-check-report-score-rental-application-nyc\">credit scores.<\/a><\/p>\n<h3 dir=\"ltr\">How to make a case for a constructive eviction<\/h3>\n<p dir=\"ltr\">All the above information applies to when you are moving out voluntarily, rather than because your apartment has become a living hell\u2014or at least, what a reasonable person would consider uninhabitable.\u00a0<\/p>\n<p dir=\"ltr\">In that scenario, you may have a case for <a href=\"https:\/\/www.brickunderground.com\/rent\/constructive-eviciton-situations-it-applies-to-landlords-renters-nyc\">constructive eviction,<\/a> in which you claim the landlord has failed to uphold the <a href=\"https:\/\/www.brickunderground.com\/rent\/bricktionary-what-is-a-warranty-of-habitability-nyc\">warranty of habitability. <\/a>\u00a0<\/p>\n<p dir=\"ltr\"><span style=\"font-size: 1.15rem;\">For example, a landlord&#8217;s refusal to correct issues like bed bugs,\u00a0<\/span><a href=\"https:\/\/www.brickunderground.com\/blog\/2010\/12\/is_your_apartment_making_you_sick_top_3_places_to_look_for_mold\" style=\"font-size: 1.15rem;\" target=\"_blank\">mold,<\/a>\u00a0<span style=\"font-size: 1.15rem;\">or\u00a0<\/span><a href=\"https:\/\/www.brickunderground.com\/rent\/new-lead-exposure-laws-on-inspections-remediation-landlords-rentals-children-nyc\" style=\"font-size: 1.15rem;\" target=\"_blank\">lead paint <\/a><span style=\"font-size: 1.15rem;\">can constitute harassment,\u00a0<\/span><span style=\"margin: 0px; padding: 0px;\">and the law may allow<\/span>\u00a0tenants to sue for legal fees in these situations.<\/p>\n<p dir=\"ltr\">To claim constructive eviction, you must first vacate the premises. This is risky because if you do not prevail, you will have to pay the rent. So before you move out, build your case by taking photos of the problem and keeping a record of all efforts (in writing!) to get your landlord to resolve it.\u00a0<\/p>\n<p dir=\"ltr\">Your detective work could also include\u00a0<span style=\"margin: 0px; padding: 0px;\">checking with the Department of Buildings to\u00a0<span style=\"margin: 0px; padding: 0px;\">see whether\u00a0<a href=\"http:\/\/www1.nyc.gov\/site\/buildings\/codes\/code-tools.page\" target=\"_blank\">the building has\u00a0<\/a><span style=\"margin: 0px; padding: 0px;\"><a href=\"http:\/\/www1.nyc.gov\/site\/buildings\/codes\/code-tools.page\" target=\"_blank\">violations,<\/a>\u00a0whether apartments have been\u00a0<a href=\"https:\/\/www.brickunderground.com\/rent\/how-find-out-apartment-legally-deregulated-rent-stabilized\" target=\"_blank\">illegally deregulated,<\/a>\u00a0whether the building&#8217;s facade is damaged, whether the boiler is inefficient<\/span>, or whether<\/span>\u00a0the\u00a0<a href=\"https:\/\/www.brickunderground.com\/live\/whats-a-certificate-of-insurance-nyc\" target=\"_blank\">certificate of occupancy<\/a>\u00a0doesn&#8217;t match the building&#8217;s intended\u00a0<\/span>use.<\/p>\n<p dir=\"ltr\">You may also want to consult experts to confirm the presence of mold, <a href=\"https:\/\/www.brickunderground.com\/rent\/ask-altagracia-ceiling-leak-break-lease-bathroom-ceiling-collapse-asbestos\">asbestos,<\/a> or <a href=\"https:\/\/www.brickunderground.com\/improve\/keep-smoke-pot-incense-cooking-smells-odors-out-of-apartment-nyc\">secondhand smoke.<\/a><\/p>\n<p dir=\"ltr\"><span style=\"font-size: 1.15rem;\">Finally, you can call 311 or\u00a0<\/span><a href=\"https:\/\/portal.311.nyc.gov\/article\/?kanumber=KA-01074\" style=\"font-size: 1.15rem;\" target=\"_blank\">file a complaint online.<\/a>\u00a0If the city issues violations, that is objective proof of the condition.
