These amendments are applicable only in the Union<br \/>\nTerritory of Jammu &amp; Kashmir, and are not applicable in the Union Territory<br \/>\nof Ladakh. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">After explaining the procedure adopted<br \/>\nfor amending these land laws, we shall discuss the constitutional validity of<br \/>\nthe Adaptation Order notified by the Home Ministry. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">We shall conclude our discussion by<br \/>\nexamining how the conversion of the State of Jammu &amp; Kashmir into 2 Union<br \/>\nTerritories, along with the continued imposition of President\u2019s Rule, has given<br \/>\nthe Central Government a justification for making legislative policy changes<br \/>\nwithout any prior consultation. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><b><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The procedure adopted for notifying the<br \/>\nAdaptation Order <\/span><\/b><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">Through the Adaptation Order <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"http:\/\/164.100.117.97\/WriteReadData\/userfiles\/218978.pdf\"><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">notified<\/span><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"> by the Union Home Ministry, multiple<br \/>\nland laws that were applicable in the erstwhile State of Jammu &amp; Kashmir<br \/>\nhave either been repealed or amended. 12 land laws have been repealed, while 26<br \/>\nhave been amended. After these amendments, outsiders (i.e. those who are not<br \/>\ndomicile residents of Jammu &amp; Kashmir) can acquire both agricultural as<br \/>\nwell as non-agricultural land in the Union Territory. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">This has led to an uproar, and politicians<br \/>\nsuch as Omar Abdullah have contended that allowing outsiders to purchase land<br \/>\nwill further disempower the local population, and may alter the demography of<br \/>\nKashmir in the long run. It was also argued that such far-reaching changes to<br \/>\nland laws were made without any prior stakeholder consultation. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">It is pertinent to note here that in<br \/>\nApril, a similar \u2018Adaptation Order\u2019 was notified, to enact a new domicile<br \/>\npolicy for Jammu &amp; Kashmir. This was done by amending the <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"http:\/\/jakfinance.nic.in\/IMP_REFERENCE\/Decentralization%20Act\/JK-Civil-Services-Decentralization%20&amp;%20Recruitment-ACT,2010.pdf\"><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">Jammu &amp; Kashmir Civil<br \/>\nServices (Decentralization and Recruitment) Act, 2010<\/span><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"> \u2013 which prescribed the conditions that<br \/>\nmust be satisfied for claiming the status of a \u2018domicile resident\u2019 of Jammu<br \/>\n&amp; Kashmir. Just like the land law amendments, even the domicile policy was<br \/>\ncriticized on the ground that it was notified without any prior consultation or<br \/>\ndiscussion. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">In both of these Adaptation Orders, it has<br \/>\nbeen stated that the Order derives legal force by virtue of <u>Section 96<\/u><br \/>\nof the <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"http:\/\/egazette.nic.in\/WriteReadData\/2019\/210407.pdf\"><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">Jammu and Kashmir Reorganization<br \/>\nAct, 2019<\/span><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"> (\u2018<b>the<br \/>\nReorganization Act<\/b>\u2019). <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">To recall, the Reorganization Act has<br \/>\nbifurcated the erstwhile State of Jammu and Kashmir into two separate Union<br \/>\nTerritories of Jammu &amp; Kashmir and Ladakh. This statute was introduced simultaneously<br \/>\nwith the <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"https:\/\/abcaus.in\/wp-content\/uploads\/2019\/08\/article-370-scrapped.pdf\"><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">Presidential Order<\/span><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"> and the <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"http:\/\/164.100.47.5\/newlobsessions\/sessionno\/249\/S050819.pdf\"><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">Statutory Resolution<\/span><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"> which amended Article 370 of the<br \/>\nIndian Constitution, on 5<sup>th<\/sup> August 2019. To understand the nature<br \/>\nand purpose of the Adaptation Order, it is instructive to refer to Section 96<br \/>\nof the Reorganization Act. Section 96 falls under Part XIV of the<br \/>\nReorganization Act, which consists of \u201cLegal and miscellaneous provisions\u201d. It<br \/>\nstates as follows: <\/span><\/p>\n<blockquote style=\"text-align: justify;\"><p><b><i>&#8220;For the purpose of facilitating<br \/>\nthe application in relation to the successor Union Territories<\/i><\/b><i>, of<br \/>\nany law made before the appointed day, as detailed in Fifth Schedule, the<br \/>\nCentral Government may, before the expiration of one year from that day, by<br \/>\norder, make such <b>adaptations and modifications<\/b> of the law, whether by<br \/>\nway of repeal or amendment, as may be <b>necessary or expedient<\/b>, and<br \/>\nthereupon every such law shall have effect subject to the adaptations and<br \/>\nmodifications so made until altered, repealed or amended by a competent<br \/>\nLegislature or other competent authority&#8221;<\/i>(emphasis supplied). <\/p><\/blockquote>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The Fifth Schedule referred to above<br \/>\nconsists of the Central and State Laws that are applicable in the newly formed<br \/>\nUnion Territories of Jammu &amp; Kashmir and Ladakh. Section 96 confers the<br \/>\nCentral Government with the power to amend or repeal any Central or State law<br \/>\napplicable in the Union Territories, if it considers it to be \u2018necessary and<br \/>\nexpedient\u2019. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">This power is available for a period of<br \/>\none year from the appointed date i.e. the date on which the Reorganization Act<br \/>\ncame into force &#8211; which was 31<sup>st<\/sup> October 2019. Hence, the Government<br \/>\ncan resort to Section 96 only upto 31<sup>st<\/sup> October 2020. Now, such a<br \/>\nprovision enabling the adaptation and modification of existing laws by the<br \/>\nExecutive is not unique to this Reorganization Act. A similar provision is also<br \/>\npresent in Section 101 of the <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"https:\/\/www.aplegislature.org\/documents\/12524\/17895\/APRegACT2014.pdf\/8505fe86-f67b-41a7-ac8f-571f58090586\"><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">Andhra Pradesh Reorganization<br \/>\nAct, 2014<\/span><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">, which<br \/>\nconferred the government with powers of adaptation and modification \u2013 for a<br \/>\nperiod of 2 years. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">An important question arises here with<br \/>\nrespect to the scope and ambit of the power of \u2018adaptation and modification\u2019<br \/>\nconferred by Section 96. The question that arises here is whether the power<br \/>\nconferred by Section 96 is limited to making \u2018adaptations and modifications\u2019 solely<br \/>\nfor purposes of procedural and administrative efficiency, or whether it also extends<br \/>\nto making policy alterations \u2013 such as allowing outsiders to purchase land, or enacting<br \/>\na new domicile policy. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><b><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The scope and ambit of the power of \u2018<i>adaptation<br \/>\nand modification<\/i>\u2019<\/span><\/b><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">From a plain reading of Section 96, it<br \/>\nis evident that the purpose of this provision is to adapt or modify any law for<br \/>\nthe purpose of facilitating its application to the successor Union Territories,<br \/>\nif the Central Government feels that it is necessary and expedient to do so. This<br \/>\nis further qualified by a one-year time limit, which means that adaptations and<br \/>\nmodifications can be made for a temporary period of one year &#8211; from the date on<br \/>\nwhich the Reorganization Act has come into force. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The presence of a one-year time limit<br \/>\nand the words \u201c<i>for the purpose of facilitating the application in relation<br \/>\nto the successor Union Territories, of any law<\/i>\u201d indicates that such<br \/>\nadaptations and modifications made through executive orders can be undertaken only<br \/>\nfor procedural and administrative matters connected with the bifurcation and<br \/>\nthe conversion of the erstwhile State into 2 Union Territories. <span style=\"mso-spacerun: yes;\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">This also implies that policy changes<br \/>\nmade through executive orders which are unconnected to this process of<br \/>\nfacilitating the application of existing laws shall be beyond the ambit of<br \/>\nSection 96. This interpretation is also in line with the Supreme Court\u2019s<br \/>\ndecision in the landmark <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"https:\/\/indiankanoon.org\/doc\/1814791\/\"><i><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">In Re: The Delhi Laws Act<\/span><\/i><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"> (1951) case, where it was held that<br \/>\nthe Legislature cannot delegate matters of essential legislative policy to the<br \/>\nExecutive. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">Keeping in mind the wording of Section<br \/>\n96 and the <i>In Re: Delhi Laws Act<\/i> decision, it can be argued that Section<br \/>\n96 cannot be used to make any substantive policy changes by amending existing<br \/>\nlaws; and it is restricted to matters of procedure and administration that are necessary<br \/>\nfor facilitating the smooth application of existing laws to the newly<br \/>\nconstituted Union Territories. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The Adaptation Orders referred to above<br \/>\nhave amended existing laws to permit outsiders to purchase land, and has also framed<br \/>\na new domicile policy for Jammu &amp; Kashmir. These are clearly changes that<br \/>\nfall within the realm of legislative policy, and are not simple modifications that<br \/>\nhave been made for procedural and administrative convenience. As they are substantive<br \/>\npolicy changes, it can be argued that they do not fall within the ambit of the<br \/>\npower conferred by Section 96 \u2013 and should hence be struck down for going beyond<br \/>\nwhat is permitted by the Reorganization Act. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">There are hence strong grounds to<br \/>\nchallenge the Adaptation Orders in the Jammu &amp; Kashmir High Court or the<br \/>\nSupreme Court. Let us now examine certain constitutional provisions that the<br \/>\nCentral Government may invoke, in response to a possible legal challenge. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%;\"><b><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The<br \/>\nCentral Government\u2019s possible line of defence <\/span><\/b><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">As per the Reorganization Act, the<br \/>\nUnion Territory of Ladakh does not have a Legislature, and is to be administered<br \/>\nby a Lieutenant Governor, acting on behalf of the President. On the other hand,<br \/>\nthe Union Territory of Jammu &amp; Kashmir follows a model similar to Pondicherry<br \/>\nand Delhi. Along with a Lieutenant Governor, Jammu &amp; Kashmir is envisaged<br \/>\nto have a Legislature and a Council of Ministers headed by the Chief Minister. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">Section 58 makes <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"https:\/\/indiankanoon.org\/doc\/297117\/\"><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">Article 239<\/span><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"><br \/>\nand <a href=\"https:\/\/indiankanoon.org\/doc\/1823046\/\">Article 240<\/a> of the<br \/>\nConstitution applicable to the Union Territory of Ladakh. Article 240 states<br \/>\nthat for specified Union Territories (such as Pondicherry and now Ladakh), any<br \/>\nRegulation made by the President which amends or repeals any applicable law<br \/>\nshall have the same force as an Act of Parliament. Hence, with respect to the<br \/>\nUnion Territory of Ladakh, all executive orders issued by the Central Government<br \/>\nshall be equivalent to a parliamentary law. However, the position is<br \/>\nsignificantly different for the Union Territory of Jammu &amp; Kashmir. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">Unlike Ladakh, Article 240 has not been<br \/>\nmade directly applicable to the Union Territory of Jammu &amp; Kashmir. This is<br \/>\nby virtue of Section 13 of the Reorganization Act. Section 13 only states that the<br \/>\nprovisions contained in <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"https:\/\/www.constitution.org\/cons\/india\/p08239a.html\"><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">Article 239A<\/span><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"> of the Constitution as applicable to<br \/>\nPondicherry shall also be applicable to the Union Territory of J&amp; K. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">However, the Government may<br \/>\nnevertheless invoke the proviso to Article 240(1) as a defence. The proviso to<br \/>\nArticle 240(1) states that if a body is created to function as the Legislature<br \/>\nfor the Union Territories enlisted under Article 239A (which now includes<br \/>\nPondicherry and Jammu &amp; Kashmir), then until the first meeting of the Legislature,<br \/>\nthe Central Government may make Regulations that amend or repeal the existing<br \/>\nlaws that are applicable in the Union Territory. Also, as per Article 240(2), all<br \/>\nsuch regulations made before the first meeting of the Legislature shall have<br \/>\nthe same force as a statute passed by Parliament. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">This may be used as a justification by<br \/>\nthe Central Government in a possible constitutional challenge, as the Union<br \/>\nTerritory of Jammu and Kashmir is currently under President\u2019s rule, and no<br \/>\nLegislative Assembly has been created after the passage of the Reorganization<br \/>\nAct. It may contend that even if the Adaptation Order is beyond the ambit of<br \/>\nSection 96 of the Reorganization Act, it is saved by Article 239A and Article<br \/>\n240 \u2013 as Jammu &amp; Kashmir does not have a Legislature as of now. <span style=\"mso-spacerun: yes;\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><b><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">Continued Imposition of President\u2019s<br \/>\nrule &#8211; A larger constitutional question<\/span><\/b><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">Keeping this possible justification<br \/>\naside, there is a larger constitutional question that the Court must address. As<br \/>\nthe Union Territory of Jammu and Kashmir is envisaged to have a Legislative<br \/>\nAssembly, Article 239A read with the proviso to Article 240(1) permits the<br \/>\nissuance of executive orders by the Central Government only until the first<br \/>\nmeeting of the Legislative Assembly, after fresh elections are held. Jammu<br \/>\n&amp; Kashmir was under President\u2019s rule prior to its conversion to a Union<br \/>\nTerritory, and has continued to remain in President\u2019s rule even after 31<sup>st<\/sup><br \/>\nOctober 2019 (when the Reorganization Act came into force). <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"https:\/\/indiankanoon.org\/doc\/8019\/\"><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">Article 356<\/span><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"><br \/>\nof the Indian Constitution has continued to hold fort in Jammu &amp; Kashmir<br \/>\nsince 19<sup>th<\/sup> December 2018, and there is no specific information on<br \/>\nany proposal to have fresh elections in the near future. The continued<br \/>\nimposition of President\u2019s rule and the conversion of the State into 2 Union<br \/>\nTerritories has given the Central Government a <i>carte blanche<\/i> to<br \/>\nindiscriminately take advantage of the statutory and constitutional provisions<br \/>\nreferred to above, and rule by executive decree. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The rationale behind the Central<br \/>\nGovernment wanting this unbridled power can be highlighted by referring to the<br \/>\nSupreme Court\u2019s decision in <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"https:\/\/indiankanoon.org\/doc\/144413017\/\"><i><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">NCT of Delhi v. Union of India<\/span><\/i><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">. In its decision, the Supreme Court held<br \/>\nthat although Delhi is a Union Territory and akin to a quasi-State, the actions<br \/>\nof an elected government and an elected Legislature shall bind the Lieutenant<br \/>\nGovernor &#8211; for all matters that are within its legislative domain. Although<br \/>\nthis decision was based on an interpretation of Article <\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%;\"><a href=\"http:\/\/delhiassembly.nic.in\/constitution.htm\"><span style=\"mso-bidi-font-family: &quot;Times New Roman&quot;;\">239AA<\/span><\/a><\/span><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"><br \/>\nof the Constitution, it applies squarely to Jammu &amp; Kashmir \u2013 as akin to<br \/>\nDelhi, Jammu &amp; Kashmir is envisaged to have a Legislature despite being a<br \/>\nUnion Territory. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">This implies that for all matters<br \/>\nwithin its legislative domain, the Legislature of the Union Territory of Jammu &amp;<br \/>\nKashmir shall stand supreme, and bind the Lieutenant Governor and the Central<br \/>\nGovernment. Hence, if fresh elections had been held and a Legislative Assembly<br \/>\nhad been constituted, the Home Ministry could not have indiscriminately taken<br \/>\nthe benefit of Article 239A, Article 240, and Section 96 of the Reorganization<br \/>\nAct &#8211; to bring about radical policy changes relating to land and domicile. <span style=\"mso-spacerun: yes;\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">As discussed above, the Adaptation Orders<br \/>\nthat made land and domicile-related changes were notified without any prior legislative<br \/>\nconsultation. If there was an elected Legislature in the first place, amendments<br \/>\nto land laws, or a new domicile policy could only have been enacted through<br \/>\nlegislation, after debate and discussions involving members across party lines.<br \/>\nThe conversion to Union Territories coupled with the imposition of President\u2019s<br \/>\nrule has prevented any such discussion from taking place, and has granted the<br \/>\nCentral Government with unbridled power to make policy prescriptions without<br \/>\nany pre-legislative consultation process. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">While the Central Government may<br \/>\ncontend that once there is an elected legislature, the Legislature may further<br \/>\namend or repeal the changes after discussion, this shall only buttress my<br \/>\nprimary point \u2013 that as the presence of a Legislature is envisaged, such<br \/>\nlegislative policy prescriptions should be left solely within its domain. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">This only culminates in one common end<br \/>\n\u2013 which is the need for a greater legal and judicial conversation on whether it<br \/>\nis within the spirit of the constitutional framework to indefinitely impose and<br \/>\nrepeatedly extend President\u2019s rule under Article 356, and rule virtually by<br \/>\nexecutive decree.
