{"id":7053661,"date":"2026-09-01T09:19:48","date_gmt":"2026-09-01T09:19:48","guid":{"rendered":"https:\/\/peraltafinancing.com\/uncategorized\/what-is-the-correct-legal-position\/"},"modified":"2026-09-01T09:19:48","modified_gmt":"2026-09-01T09:19:48","slug":"what-is-the-correct-legal-position","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=7053661","title":{"rendered":"What is the Correct Legal Position?"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div style=\"text-align: justify;\">\n<div class=\"MsoNormal\">\n<span lang=\"EN-IN\">About a week ago, on March 24, 2017, I was part<br \/>\nof a panel discussion organised in New Delhi by the Centre for Communication<br \/>\nGovernance of NLU Delhi to commemorate the <a href=\"http:\/\/supremecourtofindia.nic.in\/FileServer\/2015-03-24_1427183283.pdf\">Shreya Singhal judgement<\/a>. Since I led the team which challenged the intermediary<br \/>\nliability regime on behalf of the Internet and Mobile<br \/>\nAssociation of India as part of the batch of Shreya Singhal petitions, my views<br \/>\nwere sought on the actual impact of the judgement on intermediary liability<br \/>\nregime in the two years that have passed since the verdict. <\/span><span lang=\"EN-IN\">In this post, I will expand on the views I expressed in<br \/>\nthe panel discussion on the legacy of <i>Shreya<br \/>\nSinghal<\/i>.\u00a0<\/span><span lang=\"EN-IN\">On a different note, those interested may read\u00a0<\/span><a href=\"https:\/\/storify.com\/jsaideepak\/shreya-singhal-v-union-of-india-as-it-happened\"><span lang=\"EN-IN\">here<\/span><\/a><span lang=\"EN-IN\">\u00a0the storified version of my live updates on Twitter on the arguments in\u00a0<i>Shreya Singhal<\/i>.<\/span><\/div>\n<div class=\"MsoNormal\">\n<span lang=\"EN-IN\">In April 2015, I had <\/span><a href=\"http:\/\/thedemandingmistress.blogspot.in\/2015\/04\/intermediary-liability-regime-historic.html\"><span lang=\"EN-IN\">written<\/span><\/a><span lang=\"EN-IN\"> that while the judgement was certainly a<br \/>\nwelcome and necessary step forward in preserving the democratic nature of the<br \/>\ninternet and to ensure that unconstitutional limitations were not imposed on<br \/>\nexercise of free speech and expression citing the nature of the medium, the<br \/>\nSupreme Court did miss a historic\u00a0<br \/>\nopportunity to strike a more comprehensive and nuanced position in so<br \/>\nfar as intermediary liability was concerned. This is evident from the cursory<br \/>\nmanner in which the Supreme Court dealt with the challenge to Section 79(3)(b)<br \/>\nof the Information Technology Act, 2000 and Rule 3 of the Intermediary<br \/>\nGuidelines, 2011. The entire discussion relating to these provisions is<br \/>\nlimited to the last six paragraphs of the decision i.e. Paras 112-118, apart<br \/>\nfrom the holding in Para 119(c). The analysis of the parent provision i.e.<br \/>\nSection 79(3)(b) itself is to be found only in Paras 116 and 117.<\/span><\/div>\n<div class=\"MsoNormal\">\n<span lang=\"EN-IN\">In Para 116, the Court observed that in<br \/>\ncontrast to the take-down mechanism under Section 79(3)(b), blocking of content<br \/>\non websites under Section 69A of the Act was possible (a) through issuance of a<br \/>\nreasoned order by a Designated Officer applying the procedural safeguards provided<br \/>\nunder the Act and the 2009 Rules or (b) under the order of a competent court directing<br \/>\nthe Designated Officer to block a website or content on a website. Importantly,<br \/>\nthe Court noted that under Section 69A, unlike under Section 79(3)(b), an<br \/>\nintermediary was not expected to adjudicate on blocking of content under the<br \/>\nprovision. This led the Court, in Para 117, to read down \u201cactual knowledge\u201d<br \/>\nunder Section 79(3)(b) to mean receipt of a Court order directing the<br \/>\nintermediary to expeditiously remove or disable access to content. To this<br \/>\nextent, the judgement provided some much-needed respite to intermediaries who were<br \/>\ncaught in the crossfire between the issuer of the notice and their users to<br \/>\nwhom they were bound by the terms of use of their portals. <\/span><\/div>\n<div class=\"MsoNormal\">\n<span lang=\"EN-IN\">However, what is pertinent is that in reading<br \/>\ndown what constitutes \u2018actual knowledge\u2019, the Court did not expressly state in its analysis that receipt of or constructive notice of a notification of an appropriate<br \/>\ngovernment or its agency too would amount to actual knowledge. The reference to<br \/>\ngovernment notification is to be found at the end of Para 117 and that too in<br \/>\nthe context of Article 19(2). Extracted below is the relevant excerpt:<\/span><\/div>\n<div class=\"MsoNormal\">\n<i><span lang=\"EN-IN\">\u201c<\/span>Also, the<br \/>\nCourt order and\/or the notification by the appropriate Government or its agency<br \/>\nmust strictly conform to the subject matters laid down in Article 19(2).<br \/>\nUnlawful acts beyond what is laid down in Article 19(2) obviously cannot form<br \/>\nany part of Section 79. With these two caveats, we refrain from striking down<br \/>\nSection 79(3) (b).\u201d<\/i><\/div>\n<div class=\"MsoNormal\">\nExtracted below is the conclusion<br \/>\nof the Court in Para 119(c):<\/div>\n<div class=\"MsoNormal\">\n<i>\u201c(c) Section 79 is valid subject to Section 79(3)(b) being read down to<br \/>\nmean that an intermediary upon receiving actual knowledge from a court order or<br \/>\non being notified by the appropriate government or its agency that unlawful<br \/>\nacts relatable to Article 19(2) are going to be committed then fails to<br \/>\nexpeditiously remove or disable access to such material. Similarly, the<br \/>\nInformation Technology \u201cIntermediary Guidelines\u201d Rules, 2011 are valid subject<br \/>\nto Rule 3 sub-rule (4) being read down in the same manner as indicated in the<br \/>\njudgment.\u201d<\/i><\/div>\n<p>\nIt could be inferred, based on the language of<br \/>\nboth excerpts, that <span lang=\"EN-IN\">receipt of or constructive notice of a<br \/>\nnotification of an appropriate government or its agency too would amount to<br \/>\nactual knowledge. That being said, the further observation that Orders of the<br \/>\nCourt and Government Notifications <i>must<br \/>\nstrictly conform to subject-matters laid down in Article 19(2) and that<br \/>\nunlawful acts beyond what is laid down in Article 19(2) obviously cannot form<br \/>\nany part of Section 79,<\/i> has given rise to three different interpretations:<\/span><br \/><span lang=\"EN-IN\" style=\"text-indent: -0.25in;\"><br \/><\/span><br \/>\n<span lang=\"EN-IN\" style=\"text-indent: -0.25in;\">1.<span style=\"font-size: 7pt; font-stretch: normal; font-variant-numeric: normal; line-height: normal;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\n<\/span><\/span><b style=\"text-indent: -0.25in;\"><span lang=\"EN-IN\">Interpretation 1<\/span><\/b><span lang=\"EN-IN\" style=\"text-indent: -0.25in;\">: Since Court Orders and government<br \/>\nnotifications must conform to Article 19(2), it must obviously only relate to<br \/>\ncontent that attracts Article 19(1)(a). Therefore, receipt of court order or government<br \/>\nnotification as actual knowledge is a safeguard that applies <i>only<\/i> to content which falls under<br \/>\nArticle 19(1)(a). The consequence of this is that mere cease and desist notices<br \/>\nwould continue to constitute actual knowledge in relation to content which<br \/>\nfalls outside the ambit of Article 19(1)(a). This defeats the very <i>ratio <\/i>of the Supreme Court which was to<br \/>\nnot put the intermediary in the position of an adjudicator of the lawfulness of<br \/>\nany content.<\/span><br \/><span lang=\"EN-IN\" style=\"text-indent: -0.25in;\"><br \/><\/span><br \/>\n<span lang=\"EN-IN\" style=\"text-indent: -0.25in;\">2.<span style=\"font-size: 7pt; font-stretch: normal; font-variant-numeric: normal; line-height: normal;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\n<\/span><\/span><b style=\"text-indent: -0.25in;\"><span lang=\"EN-IN\">Interpretation 2<\/span><\/b><span lang=\"EN-IN\" style=\"text-indent: -0.25in;\">: Since, according to the Supreme<br \/>\nCourt, unlawful acts beyond what is laid down in Article 19(2) obviously cannot<br \/>\nform any part of Section 79, the very applicability of Section 79 and the<br \/>\nimmunity granted thereunder to intermediaries does not extend to any unlawful act which falls<br \/>\noutside Article 19(2). This obviously exposes intermediaries to legal action to<br \/>\nunlawful acts which fall outside the ambit of Article 19(2) despite them<br \/>\nplaying the limited role of intermediaries.<\/span><br \/><span lang=\"EN-IN\" style=\"text-indent: -0.25in;\"><br \/><\/span><br \/>\n<span lang=\"EN-IN\" style=\"text-indent: -0.25in;\">3.<span style=\"font-size: 7pt; font-stretch: normal; font-variant-numeric: normal; line-height: normal;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\n<\/span><\/span><b style=\"text-indent: -0.25in;\"><span lang=\"EN-IN\">Interpretation 3<\/span><\/b><span lang=\"EN-IN\" style=\"text-indent: -0.25in;\">: Court orders or government<br \/>\nnotifications constitute actual knowledge in all cases and in relation to all<br \/>\nkinds of content. Where the content is relatable to Article 19(1)(a), the<br \/>\nlimitations and safeguards of Article 19(2) kick in and apply to Court orders<br \/>\nas well as Government notifications.<\/span><\/p>\n<p>\n<span lang=\"EN-IN\">In my view, the third interpretation is\u00a0<\/span>perhaps the most faithful to the language and intent of Section 79, as well as<br \/>\nto the Supreme Court\u2019s <i>ratio<\/i> behind<br \/>\nreading down the meaning of actual knowledge and introducing Article 19(2) in<br \/>\nthe context of free speech.\u00a0<\/p>\n<\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>About a week ago, on March 24, 2017, I was part of a panel discussion organised in New Delhi by the Centre for Communication Governance of NLU Delhi to commemorate the Shreya Singhal judgement.
