{"id":7053049,"date":"2026-08-31T20:46:20","date_gmt":"2026-08-31T20:46:20","guid":{"rendered":"https:\/\/peraltafinancing.com\/uncategorized\/data-center-cites-kentucky-law-meant-to-promote-housing-development\/"},"modified":"2026-08-31T20:46:20","modified_gmt":"2026-08-31T20:46:20","slug":"data-center-cites-kentucky-law-meant-to-promote-housing-development","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=7053049","title":{"rendered":"Data Center Cites Kentucky Law Meant To Promote Housing Development"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">A <a target=\"_blank\" id=\"https:\/\/www.realtor.com\/news\/trends\/data-center-home-prices-housing-report-2026\/\" type=\"link\" href=\"https:\/\/www.realtor.com\/news\/trends\/data-center-home-prices-housing-report-2026\/\">data center<\/a> operator in <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/realestateandhomes-search\/Kentucky\">Kentucky<\/a> hopes to block a legal challenge from area homeowners using a new law designed to fast-track housing developments, highlighting the unintended consequences of housing policy shifts.\u00a0<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The conflict stems from a 200-acre data center campus that developer TenKey LandCo is planning to build in <a target=\"_blank\" id=\"https:\/\/www.realtor.com\/realestateandhomes-search\/Simpson-County_KY\" type=\"link\" href=\"https:\/\/www.realtor.com\/realestateandhomes-search\/Simpson-County_KY\">Simpson County, KY<\/a>, which is in the southwestern part of the state on the <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/realestateandhomes-search\/Tennessee\">Tennessee<\/a> border.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">In March, the city of <a target=\"_blank\" id=\"https:\/\/www.realtor.com\/realestateandhomes-search\/Franklin_KY\" type=\"link\" href=\"https:\/\/www.realtor.com\/realestateandhomes-search\/Franklin_KY\">Franklin<\/a> Planning and Zoning Commission approved a preliminary development plan for TenKey&#8217;s planned large-scale data storage and service facility.<\/p>\n<p><iframe height=\"230px\" style=\"width:100%;border:0\" src=\"https:\/\/www.realtor.com\/creative\/rdc-ads\/local-listings-widget\/\" loading=\"lazy\" title=\"Embedded widget\"><\/iframe><\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The Franklin Citizens for Responsible Development then filed a <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.scribd.com\/document\/1026416043\/Data-Center-Complaint\">complaint<\/a> in the Simpson Circuit Court, arguing that the Planning and Zoning Commission \u201cacted arbitrarily, capriciously, and without substantial evidence\u201d when it approved TenKey\u2019s plan, despite the \u201cthreats to the health, safety, and welfare of nearby residents and businesses.\u201d<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">In response, TenKey argued that the group that filed the lawsuit \u201cdoes not comply with the strict requirements\u201d that Kentucky&#8217;s HB 321 now requires and should therefore be dismissed.\u00a0<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\"><a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/apps.legislature.ky.gov\/record\/25rs\/hb321.html\">House Bill 321<\/a> was introduced in the state Legislature by state Rep. <strong>DJ Johnson<\/strong>, a Republican, in early 2025. It requires mandatory training for local planning and zoning officials. The bill passed easily with support from the Republican-controlled state Legislature and was signed into law by Democratic Gov. <strong>Andy Beshear<\/strong> last year.\u00a0<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">But the House bill also included a last-minute amendment to <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/apps.legislature.ky.gov\/law\/statutes\/statute.aspx?id=56263\">Kentucky Revised Statute 100.347<\/a>, a local law that outlines the rules around citizens appealing planning and zoning decisions.\u00a0<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The new language limits appeals to people with properties that are similarly zoned, stating that \u201cAny person or entity claiming to be injured or aggrieved by any final action of the board of adjustment and that owns real property within the same zone where the property that is the subject of the final action is located shall appeal from the action to the Circuit Court of the county in which the property that is the subject of the action of the board of adjustment lies.\u201d <\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Because the data center is zoned as I-2, heavy industrial, TenKey argues in its rebuttal, only similarly zoned businesses should be able to weigh in. The property of the group challenging the data center is zoned as B-1, neighborhood business.<\/p>\n<p>Essentially, TenKey says that because the business owners are not zoned in the same category, they have no legal right to appeal the zoning board&#8217;s decision.<\/p>\n<div class=\"Boxstyles__StyledBox-rui__sc-1p1qqov-0 cGIhfE sc-1d9c28t-0 dVWipe\">\n<figure><figcaption class=\"sc-1d9c28t-3 kUNXdc\"><span class=\"image-caption\">Historic commercial buildings line the downtown square in Franklin, KY. In March, the city&#8217;s Planning and Zoning Commission approved a preliminary development plan for TenKey&#8217;s planned data center in the area<\/span><span class=\"sc-1d9c28t-2 nMMWW image-credit\">Getty Images<\/span><\/figcaption><\/figure>\n<\/div>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">But the citizens&#8217; group argues that, even without sharing a zoning designation, a data center in the area will affect their businesses and well-being.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The zoning ruling &#8220;arbitrarily and unreasonably restricts access to judicial review based on zoning classification rather than actual injury, proximity, impact, and therefore creates an irrational classification that permits some similarly situated aggrieved person to seek review while denying it to others,&#8221; the lawsuit says. <\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">If the statute remains in place, it could have far-reaching implications for Kentucky homeowners living near data center zones, preventing them from weighing in on data center decisions. <\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">In an August Facebook post, the citizens&#8217; group <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.facebook.com\/FCRDFranklinKY\/posts\/pfbid0BzdUkoMYdLbx3ak1cV1bbTBineoKebVCHvfuwLWq6fZwxnWkXhRwosk4sp2Tg2xWl\">wrote<\/a>: \u201cA property can be annexed into a city. The city then has zoning authority over that property. A major development can be approved. But if the people directly affected don\u2019t meet the new requirements for standing &#8230; who gets to challenge that decision in court?\u201d<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The group&#8217;s lawsuit asks the court to void the commission&#8217;s approval of the data center and to declare KRS 100.347 unconstitutional.   <\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The case is currently moving through Simpson County Circuit Court, with another hearing expected in October.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The Simpson County lawsuit is part of a fresh wave of lawsuits and actions that local communities are bringing against data centers. <\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Data centers are increasingly becoming a political hot-button issue ahead of the midterms, with both parties grappling with how to balance economic development with the concerns of residents near planned new data centers.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">A recent <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/news.gallup.com\/poll\/709772\/americans-oppose-data-centers-area.aspx\">Gallup poll<\/a> found that 70% of Americans oppose building data centers in their local communities, citing economic, environmental, and resource allocation concerns, and a lack of transparency around their development.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Meanwhile, President <strong>Donald Trump<\/strong> posted to <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/117190477440173795\">Truth Social<\/a> on Monday in support of data center growth. &#8220;The only reason that communities throughout the U.S.A. should not want Data Centers is if they want to end up being backwards and poor,\u201d he wrote.<\/p>\n<\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>A data center operator in Kentucky hopes to block a legal challenge from area homeowners using a new law designed to fast-track housing developments, highlighting the unintended consequences of housing policy shifts.\u00a0 The conflict stems from a 200-acre data center campus that developer TenKey LandCo is planning to build in Simpson County, KY, which is [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":7053050,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[143036,130855,215354,99386,101593],"tags":[14102,18331,11603,72988,2993,13350,29542,12685,215355,7971,17188,1236],"dealstore":[],"offerexpiration":[],"class_list":["post-7053049","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-data-centers","category-kentucky","category-legal-issues-in-real-estate","category-trends","category-video","tag-center","tag-cites","tag-data","tag-data-centers","tag-development","tag-housing","tag-kentucky","tag-law","tag-legal-issues-in-real-estate","tag-meant","tag-promote","tag-video"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.4 -
