This latest ruling was <a href=\"https:\/\/www.aclutx.org\/press-releases\/federal-court-rules-again-that-texas-drag-ban-is-unconstitutional\/?ref=texassignal.com\">celebrated<\/a> by groups like the American Civil Liberties Union, which co-filed the original lawsuit against the law.<\/p>\n<p>This is the second time that Judge David Hittner ruled SB 12 was too broad for enforcement. Earlier this year, the Fifth Circuit Court of Appeals ruled the law could take effect but sent it back to the district court for further deliberation.<\/p>\n<p>SB 12 <a href=\"https:\/\/legiscan.com\/TX\/bill\/SB12\/2023?ref=texassignal.com\">passed<\/a> in the Texas legislature in 2023. Businesses that were found to be in violation of the law could face $10,000 in fines and performers were potentially looking at up to a year in jail.<\/p>\n<p>In his ruling this week, Judge Hittner reiterated that those in Texas who object to performances, like drag shows, have an easy resolution. \u201cFor those who find such activities as described in this case offensive, the solution is relatively simple\u2026 just don\u2019t go,\u201d wrote Hittner.<\/p>\n<p>The drag performer Brigitte Bandit, an original plaintiff in the case, <a href=\"https:\/\/www.aclutx.org\/press-releases\/federal-court-rules-again-that-texas-drag-ban-is-unconstitutional\/?ref=texassignal.com\">praised<\/a> the ruling. \u201cNo one should be punished for performing drag, and I wish lawmakers would take steps to protect kids from real dangers in our state instead of trying to divide and marginalize us,\u201d they said in a statement.<\/p>\n<p>Attorney General Ken Paxton <a href=\"https:\/\/x.com\/KenPaxtonTX\/status\/2092373539491881415?ref=texassignal.com\">called<\/a> the ruling a \u201cprofoundly flawed decision that endangers our children and is an affront to Texas values.\u201d He also said he would be appealing.<\/p>\n<\/p><\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>Culture This is the second time that Judge David Hittner ruled Senate Bill 12, which passed in 2023 in the Texas legislature, was too broad for enforcement Photo by No Revisions \/ Unsplash This week, a federal judge in Texas struck down Senate Bill 12, a bill that restricted what could be performed in front [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":7052957,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[12136],"tags":[13261,7540,12685,5033,84541],"dealstore":[],"offerexpiration":[],"class_list":["post-7052956","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-culture","tag-banning","tag-drag","tag-law","tag-shows","tag-unconstitutional"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.4 -
