They have strict income caps for buyers, are priced below market rate, and are an appealing option for low- and middle-income New Yorkers.\u00a0<\/p>\n<p data-uw-rm-sr=\"\" dir=\"ltr\"><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\"><span data-uw-rm-sr=\"\">HDFC buildings were created several decades ago when the city allowed tenants in buildings with neglectful landlords to form co-ops and take over their buildings. Some residents bought their apartments for $250 apiece, according to a 2014 article in\u00a0<\/span><a href=\"https:\/\/www.nytimes.com\/2014\/06\/29\/realestate\/affordable-new-york-apartments-with-a-catch.html\">The New York Times<\/a><\/span>\u2014and yes, that&#8217;s the correct number of zeroes.<\/p>\n<hr\/>\n<p dir=\"ltr\"><em><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\">[Editor&#8217;s note: <\/span><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\">A previous version of this article ran in August 2025. It has been updated with new information for August 2026.<\/span><span>]<\/span><\/em><\/p>\n<hr\/>\n<p data-uw-rm-sr=\"\" dir=\"ltr\"><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\"><span data-uw-rm-sr=\"\">Naturally, prices have risen since the HDFC program was launched\u2014now the cost of an HDFC generally ranges from $350,000 to $500,000. StreetEasy currently has 230 HDFC listings in NYC (see below for how to filter your search), ranging in price from $95,000 for a one bedroom in the Bronx to $1.895 million for a four bedroom on Riverside Drive in Washington Heights.\u00a0<\/span><\/span><\/p>\n<p data-uw-rm-sr=\"\" dir=\"ltr\"><span><span data-uw-rm-sr=\"\">Listings typically provide the specific income limits that the HDFC building has agreed to impose per government agencies (some require you to inquire about the restrictions); for example, a Hamilton Heights one bedroom (see below) on the market for $200,000 dictates that the buyer\u2019s annual income cannot exceed $100,890 in the two most recent years. Plus, no financing is allowed\u2014cash buyers only.\u00a0<\/span><\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\">Another bonus is that HDFCs often have more affordable <\/span>monthly maintenance fees, which especially matters when inflation is high. Case in point: The Hamilton Heights one-bedroom unit has a monthly fee of $750.\u00a0<\/p>\n<div class=\"align-center\">\n<fieldset class=\"media-default--caption ff-europa fw-700 js-form-item form-item js-form-wrapper form-wrapper mb-3\">\n<legend> <span class=\"fieldset-legend\"\/><\/legend>\n<div class=\"fieldset-wrapper\">\n<div class=\"clearfix text-formatted field field--name-field-image-caption field--type-text-long field--label-visually_hidden field__items\">\n<p>Caption<\/p>\n<div class=\"field__item\">\n<p>Located in a six-story Hamilton Heights walk-up,\u00a0#3-1 557 150th St. is a one-bedroom, one-bath co-op asking $200,000 cash.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/fieldset>\n<\/div>\n<h2 dir=\"ltr\"><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\">How HDFCs work<\/span><\/h2>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\">HDFCs were formed under various state regulations, including private housing finance laws, and their regulatory agreements vary by building. Dean Roberts, an attorney at\u00a0<\/span><a href=\"https:\/\/norrismclaughlin.com\/\">Norris McLaughlin,<\/a> noted that HDFCs often function similarly to typical co-ops: Rules vary from building to building,\u00a0depending on the bylaws and the board. In this way, HDFCs differ from <a href=\"https:\/\/www.nyc.gov\/site\/hpd\/services-and-information\/mitchell-lama-program.page\">Mitchell Lama buildings,<\/a> which operate under more uniform regulations. (Another difference is that you apply to Mitchell Lama buildings as you would for <a href=\"https:\/\/www.brickunderground.com\/blog\/2014\/08\/8020_affordable_housing_guide\">NYC\u2019s affordable rental lottery.)<\/a><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\">Beyond variations in how HDFCs operate, each building&#8217;s condition can vary significantly.\u00a0\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span>\u201cOn the one hand, it was a good program to preserve and rehabilitate these buildings, but once ownership was transferred to tenants, the city pretty much left them alone,\u201d said attorney Serge Joseph, a partner at <\/span><a href=\"https:\/\/hmgdjlaw.com\/attorney\/serge-joseph\/\">Himmelstein, Gribben, &amp; Joseph.<\/a>\u00a0\u201cThe people in charge of managing these buildings often did not have professional managerial expertise or background, so some HDFCs are not as well-managed as other co-ops.\u201d\u00a0<\/p>\n<p data-uw-rm-sr=\"\" dir=\"ltr\"><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\">HDFCs also stand apart for their financial structure. Here&#8217;s how it works: Most HDFC buildings receive partial tax exemptions and subsidies to keep operating costs\u2014and maintenance charges for shareholders\u2014at a minimum. Buyers in HDFCs must meet strict income caps, either tied to the <\/span>area median income (AMI) or a formula based on the apartment&#8217;s utilities and maintenance fees. The <a href=\"https:\/\/www1.nyc.gov\/site\/hpd\/services-and-information\/area-median-income.page\">AMI changes\u00a0<\/a><span data-uw-rm-sr=\"\"><span style=\"margin: 0px; padding: 0px;\"><a href=\"https:\/\/www1.nyc.gov\/site\/hpd\/services-and-information\/area-median-income.page\" target=\"_blank\">annually<\/a>\u00a0and is currently $152,700 for a three-person household<\/span>.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\">Some HDFCs require buyers to earn no more than 165 percent AMI (or $251,955 for a three-person household); others limit buyers to those whose incomes do not exceed 120 AMI (or $1783,240 for three people). Others are open only to buyers who don\u2019t earn more than six or seven times the monthly maintenance, utilities, and original purchase price.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\">Importantly, HDFCs are designed as affordable, long-term housing for families rather than investment properties.<\/span><\/p>\n<p><span id=\"docs-internal-guid-0923d035-7fff-5729-d4bf-57a44d72563e\">To keep would-be speculators at bay, HDFC owners typically face a significant flip tax when it comes time to sell, ranging from 10 to 30 percent in some cases. The <\/span><a href=\"https:\/\/www.brickunderground.com\/sell\/flip-tax-transfer-fee-trends\">flip tax<\/a> can be even higher if you have held the apartment for fewer than five years. And despite the lack of any caps on resale price, income restrictions and flip taxes help keep listing prices relatively low.<\/p>\n<div class=\"align-center\">\n<fieldset class=\"media-default--caption ff-europa fw-700 js-form-item form-item js-form-wrapper form-wrapper mb-3\">\n<legend> <span class=\"fieldset-legend\"\/><\/legend>\n<div class=\"fieldset-wrapper\">\n<div class=\"clearfix text-formatted field field--name-field-image-caption field--type-text-long field--label-visually_hidden field__items\">\n<p>Caption<\/p>\n<div class=\"field__item\">\n<p>This oversized two-bedroom, one-bath HDFC co-op, 1040 Carroll St., #4J in Crown Heights is asking $600,000, with a monthly maintenance fee of $890.\u00a0<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/fieldset>\n<\/div>\n<h2 dir=\"ltr\"><span id=\"docs-internal-guid-3c783306-7fff-1fce-0f78-a9b78972da42\">What type of buyer qualifies for an HDFC co-op?<\/span><\/h2>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-3c783306-7fff-1fce-0f78-a9b78972da42\">Prices for HDFC co-ops have been creeping up (especially in neighborhoods like South and Central Harlem, the Lower East Side, and Hamilton Heights), presenting prospective buyers with a frustrating conundrum: How to come up with a down payment that\u2019s tens of thousands of dollars while still earning less than a building&#8217;s income cap.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-3c783306-7fff-1fce-0f78-a9b78972da42\">These conditions ultimately favor buyers with low (ish) incomes but significant assets, such as retirees, young buyers whose parents are helping them out, or those with trust funds or an inheritance to lean on\u2014not exactly the demographic you think of when discussing affordable housing.<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-3c783306-7fff-1fce-0f78-a9b78972da42\">Some HDFCs prefer all-cash buyers because the building requires immediate cash to cover repairs or outstanding debts. Even if the building accepts a buyer with financing, locking down mortgage approval for an HDFC building can be difficult, as banks are wary of financing limited-equity co-ops. In the event of foreclosure, the bank would be bound to the same resale and income restrictions as the shareholder, making it a less appealing financial prospect.<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-3c783306-7fff-1fce-0f78-a9b78972da42\">If you need help finding a lender, the listing agent for the apartment should be able to direct you to <\/span>banks that approve financing for HDFCs or offer special programs for first-time buyers. The NYC Department of Housing Preservation and Development, which provides a\u00a0<a href=\"https:\/\/access.nyc.gov\/programs\/homefirst-down-payment-assistance\/\">HomeFirst Downpayment Assistance<\/a> program, is another potential resource.\u00a0<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-3c783306-7fff-1fce-0f78-a9b78972da42\"><span data-uw-rm-sr=\"\">\u201cThe price of an apartment may well be lower than the market price, but because it\u2019s difficult to secure financing, you often have to come up with cash, and most people who would qualify for an HDFC under the income requirements do not have $250,000 (for example) lying around,\u201d Joseph\u00a0said.<\/span><\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-3c783306-7fff-1fce-0f78-a9b78972da42\">Another caveat: Since their inception,\u00a0<\/span>the city has foreclosed on hundreds of HDFC buildings, where taxes, water, or sewage bills are past due, deeming them \u201cdistressed.\u201d When that happens, ownership can transfer to new management, and the building\u2019s shareholders become tenants. Situations like this highlight\u00a0the importance of paying your taxes and utilities on time.<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-3c783306-7fff-1fce-0f78-a9b78972da42\">That said, this seizure of property\u2014amounting to tens of millions of dollars\u2014has been part of a class action legal fight, and HDFC owners won a significant victory in 2021 when the U.S. Court of Appeals for the Second Circuit ruled that <\/span>their lawsuit could proceed<a href=\"https:\/\/www.ropesgray.com\/en\/newsroom\/news\/2021\/June\/Divested-Black-and-LatinX-Homeowners-Win-Appeal-in-Federal-Civil-Rights-Lawsuit\">. <\/a>It\u2019s been argued that the seizure of these buildings targets communities of color, taking away the opportunity to generate intergenerational wealth. The case was eventually <a href=\"https:\/\/www.nyclu.org\/press-release\/new-settlement-enhances-legal-protections-homeowners-facing-foreclosure-across-nys\">settled in March 2024, <\/a>in which the State Office of Court Administration agreed to implement protections for homeowners across the state.\u00a0<\/p>\n<hr\/>\n<p><em>Have you successfully bought a co-op in an HDFC building? If you have first-person advice to share about the process, send\u00a0us\u00a0<a href=\"http:\/\/www.brickunderground.com\/cdn-cgi\/l\/email-protection#cba9b9a2a8a0bfaeaaa68ba9b9a2a8a0bea5afaeb9acb9a4bea5afe5a8a4a6f4b8bea9a1aea8bff699aeeef88aeef9fb838f8d88b8\">an email.<\/a>\u00a0We respect all requests for anonymity.\u00a0<\/em><\/p>\n<hr\/>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-62348d6e-7fff-53aa-99fb-c07f423bf8ef\">Even with higher prices and eager speculators circulating, most HDFC co-ops are still primarily family- and community-oriented with residents in them for the long haul.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-62348d6e-7fff-53aa-99fb-c07f423bf8ef\">This was the experience of Alice (who asked we use a pseudonym), a 20-something florist who, helped by an inheritance, recently bought into a fixer-upper Williamsburg HDFC.<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-62348d6e-7fff-53aa-99fb-c07f423bf8ef\">&#8220;I really like my neighbors,&#8221; she said. &#8220;As a born-and-bred New Yorker, it&#8217;s really refreshing to be in a building where almost everyone is older and has been here for a long time (especially in a neighborhood like Williamsburg). My downstairs neighbor grew up in her apartment, and a woman on the first floor is living in the apartment her mom bought in the \u201980s. There are a lot of interesting characters, and everyone is laid back.&#8221;\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-62348d6e-7fff-53aa-99fb-c07f423bf8ef\">Indeed, many HDFC shareholders can opt to pass down their apartment to relatives, provided they follow<\/span><a href=\"https:\/\/www.brickunderground.com\/live\/how-to-pass-on-hdfc\"> specific succession guidelines<\/a>\u00a0that allow\u00a0generations of a family to live in the same unit successively.\u00a0<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-62348d6e-7fff-53aa-99fb-c07f423bf8ef\">As with many HDFCs, Alice&#8217;s apartment was in less-than-mint condition when she moved in, lacking basics like a stove and kitchen sink. &#8220;Oh God, it was a dump,&#8221; she said. &#8220;It had been vacant for 10 years before I had moved in, so it was completely infested with roaches.&#8221;\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-62348d6e-7fff-53aa-99fb-c07f423bf8ef\">Even more so than in most co-ops, being engaged with how the building is run is often a key part of life in an HDFC. Knowing the program&#8217;s history and being willing to participate in its governance are essential.<\/span><\/p>\n<div class=\"align-center\">\n<fieldset class=\"media-default--caption ff-europa fw-700 js-form-item form-item js-form-wrapper form-wrapper mb-3\">\n<legend> <span class=\"fieldset-legend\"\/><\/legend>\n<div class=\"fieldset-wrapper\">\n<div class=\"clearfix text-formatted field field--name-field-image-caption field--type-text-long field--label-visually_hidden field__items\">\n<p>Caption<\/p>\n<div class=\"field__item\">\n<p>Listed for $1.895 million, 800 Riverside Dr., #4E, is a three-bedroom (convertible to four), two-bath co-op at The Grinnell\u2014a designated landmark in Washington Heights. Income restrictions are available upon inquiry. \u00a0\u00a0<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/fieldset>\n<\/div>\n<h2 dir=\"ltr\"><span id=\"docs-internal-guid-31dc53f9-7fff-52a2-2810-566254710d00\">How do you get an HDFC co-op?<\/span><\/h2>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-f74306e0-7fff-a4f3-0c03-585be79e6ca0\">The <\/span><a href=\"https:\/\/uhab.org\/about-us\/mission\/\">Urban Homesteading Assistance Board<\/a> (UHAB) empowers low- to moderate-income residents to achieve their housing goals. It provides services and training for those who want to buy HDFC apartments, so you can reach out for advice and resources as a first step. (Its\u00a0<a href=\"https:\/\/www.uhab.org\/new-report-breaking-the-cycle-of-distress\/\">Co-operative Improvement Program<\/a> is also helping roughly 20 percent of all HDFCs it found to be classified as distressed\u2014representing 6,209 families in 266 buildings.)\u00a0<\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-f74306e0-7fff-a4f3-0c03-585be79e6ca0\">To find an apartment, you can type &#8220;HDFC&#8221; in a keyword search on listing sites like StreetEasy, which also has an &#8220;income restricted&#8221; filter.\u00a0 (A few &#8220;sponsored&#8221; and &#8220;featured&#8221; listings will pop up, too, so read the fine print.)<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-f74306e0-7fff-a4f3-0c03-585be79e6ca0\">\u201cYou need to do your due diligence,\u201d Joseph said. \u201cFind out whether the building has been approved for financing, and know the maximum income guidelines.\u201d He<\/span><span>\u00a0would also recommend reviewing the building\u2019s financials for the last couple of years, along with the governing documents, such as the proprietary lease, bylaws, and offering plan. <\/span><\/p>\n<p dir=\"ltr\"><span>In reviewing the buildings\u2019 financials, Joseph said to pay particular attention to, among other things, whether the building\u2019s maintenance income is sufficient to cover its operating expenses; whether the building must impose special assessments to meet those expenses; whether it is current on its payment of property taxes, water and sewer charges, and other obligations; and whether any shareholders are in arrears on their maintenance payments and, if so, by how much.<\/span><\/p>\n<p dir=\"ltr\"><span>&#8220;Lastly, I would read the board minutes to see how well-managed the building is, and whether the board intends to undertake capital improvements in the near future, as this may cause an increase in the monthly maintenance,\u201d he said.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-f74306e0-7fff-a4f3-0c03-585be79e6ca0\">The rest of the sale process is like a slowed-down version of what happens when you buy any co-op, since a government agency oversees it. It also involves extra paperwork.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><span id=\"docs-internal-guid-f74306e0-7fff-a4f3-0c03-585be79e6ca0\">Essentially, after the agency approves your package, it forwards it to the board for review and then schedules your interview. Closing could take several more weeks.\u00a0<\/span><\/p>\n<p dir=\"ltr\"><em><span id=\"docs-internal-guid-f74306e0-7fff-a4f3-0c03-585be79e6ca0\">\u2014Earlier versions of this article contained reporting and writing by Virginia K.
