According to <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Section 5(5)<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0of the Act, an employer may allow a woman to work from home, but this is explicitly applicable <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>&#8220;after availing of the maternity benefit&#8221;<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0(i.e., after her maternity leave concludes), provided (i) the nature of the work allows for it; and (ii) it is based on terms mutually agreed upon by the employer and the employee.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-ykyd3592\" tabindex=\"-1\"><span class=\"jpwv0\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Because the statute stipulates the WFH privilege <\/span><\/span><strong style=\"font-weight:700\"><em style=\"font-style:italic\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>after<\/span><\/span><\/em><\/strong><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>the maternity leave period and relies on mutual agreement, a doctor&#8217;s prescription during the prenatal stage does not legally compel the employer to provide a WFH arrangement.<\/span><\/span><\/span><\/p>\n<\/div>\n<p><h2 class=\"k8F11 u-NEn _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-jok2c596\" tabindex=\"-1\"><span aria-hidden=\"true\" id=\"does-that-mean-the-employee-has-no-protection-jok2c596\"\/><span class=\"DPXo6\"><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Does That Mean the Employee Has No Protection?<\/span><\/span><\/strong><\/span><\/h2>\n<\/p>\n<div data-breakout=\"normal\">\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-ugofi598\" tabindex=\"-1\"><span class=\"jpwv0\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Absolutely not. While the law does not grant a right to WFH <\/span><\/span><em style=\"font-style:italic\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>during<\/span><\/span><\/em><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0pregnancy, it provides a robust, highly nuanced safety net for women facing medical difficulties. If the employer refuses WFH, she can invoke the following statutory rights:<\/span><\/span><\/span><\/p>\n<\/div>\n<p><h2 class=\"k8F11 u-NEn _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-5kcs6605\" tabindex=\"-1\"><span aria-hidden=\"true\" id=\"1-protection-from-arduous-work-section-43-44-5kcs6605\"\/><span class=\"DPXo6\"><span>1. Protection from Arduous Work (Section 4(3) &amp; 4(4))\u00a0<\/span><\/span><\/h2>\n<\/p>\n<div data-breakout=\"normal\">\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-asi3c11897\" tabindex=\"-1\"><span class=\"jpwv0\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>If commuting or her current office duties pose a risk to her or her fetus, the pregnent employee is legally protected from hazardous working conditions. Under <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Section 4(3)<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0of the Act, a pregnant woman can make a formal request to her employer, and the employer is legally prohibited from requiring her to do any work that is of an <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>arduous nature, involves long hours of standing, is likely to interfere with her pregnancy, or could adversely affect her health<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<ul class=\"aBukw _8Fwvf\">\n<li dir=\"auto\" aria-level=\"1\" class=\"DOWpl\" style=\"margin-inline-start:1.5em;list-style-type:disc\">\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"\" id=\"viewer-pjbks615\" tabindex=\"-1\"><span class=\"jpwv0\"><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>The Timeline:<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>\u00a0Under <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>Section 4(4)<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>, this right can be invoked during a very specific window: the one (01) month immediately preceding the six (06) weeks (approx 1.5 months) before her expected delivery date, or any time during those six weeks if she has not yet commenced her maternity leave.<\/span><\/span><\/span><\/p>\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"\" id=\"viewer-1rfbb23287\" tabindex=\"-1\"><span class=\"jpwv0\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>For Example:\u00a0If a woman&#8217;s Expected Date of Delivery is <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>October 15<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>:<\/span><\/span><\/span><\/p>\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"\" id=\"viewer-apg6120202\" tabindex=\"-1\"><span class=\"jpwv0\"><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Minus 6 weeks:<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0September 3.<\/span><\/span><\/span><\/p>\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"\" id=\"viewer-cicbl20206\" tabindex=\"-1\"><span class=\"jpwv0\"><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Minus 1 month from that:<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0August 3.<\/span><\/span><\/span><\/p>\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"\" id=\"viewer-i6kp223845\" tabindex=\"-1\"><span class=\"jpwv0\"><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Her protection window:<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0She can formally invoke her right to refuse arduous work starting on <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>August 3<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>. This right remains active through September and October until she officially goes on maternity leave.<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<\/div>\n<p><h2 class=\"k8F11 u-NEn _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-zqjoo628\" tabindex=\"-1\"><span aria-hidden=\"true\" id=\"2-leave-for-pregnancy-related-illness-section-10-zqjoo628\"\/><span class=\"DPXo6\"><span>2. Leave for Pregnancy-Related Illness (Section 10)\u00a0<\/span><\/span><\/h2>\n<\/p>\n<div data-breakout=\"normal\">\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-rys1524798\" tabindex=\"-1\"><span class=\"jpwv0\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Since the Pregnant Employee has a doctor&#8217;s prescription noting complications, she can utilise <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Section 10<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0of the Act. This section states that a woman suffering from an <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>illness arising out of pregnancy<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0is entitled to a maximum of <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>one month of additional paid leave<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0(with wages at the maternity benefit rate).<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<ul class=\"aBukw _8Fwvf\">\n<li dir=\"auto\" aria-level=\"1\" class=\"DOWpl\" style=\"margin-inline-start:1.5em;list-style-type:disc\">\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"\" id=\"viewer-vnz3q640\" tabindex=\"-1\"><span class=\"jpwv0\"><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>Evidentiary Requirements:<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>\u00a0To claim this, <\/span><\/span><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>the Pregnant Employee<\/span><\/span><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span> must produce prescribed proof. For instance, under the <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>Maharashtra Maternity Benefit Rules, 1965, Rule 5(1)<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>, the production of a certificate in <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>Form 2<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>\u00a0from a registered medical practitioner certifying the illness arising out of pregnancy is recognised as legal proof.<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<\/div>\n<p><h2 class=\"k8F11 u-NEn _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-p79ji647\" tabindex=\"-1\"><span aria-hidden=\"true\" id=\"3-early-commencement-of-maternity-leave-section-53-p79ji647\"\/><span class=\"DPXo6\"><span>3. Early Commencement of Maternity Leave (Section 5(3))\u00a0<\/span><\/span><\/h2>\n<\/p>\n<div data-breakout=\"normal\">\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-8r6pu28962\" tabindex=\"-1\"><span class=\"jpwv0\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>If the Pregnant Employee<\/span><\/span><span style=\"color:rgb(48, 48, 48);background-color:transparent;text-decoration:inherit\"><span>\u00a0<\/span><\/span><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>cannot Work From Home and cannot commute, she may choose to initiate her standard maternity leave early. The 2017 Amendment increased maternity leave to <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>26 weeks <\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>(6 months), and under <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Section 5(3)<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>, a pregnant woman can begin taking this leave up to <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>eight weeks <\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>(approx. 2 months) <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>preceding the date of her expected delivery<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>.<\/span><\/span><\/span><\/p>\n<\/div>\n<p><h2 class=\"k8F11 u-NEn _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-lzmjq657\" tabindex=\"-1\"><span aria-hidden=\"true\" id=\"practical-takeaway-for-employers-lzmjq657\"\/><span class=\"DPXo6\"><span>Practical Takeaway for Employers<\/span><\/span><\/h2>\n<\/p>\n<div data-breakout=\"normal\">\n<p class=\"rKr3c LXM-U _8Fwvf GywVr\" dir=\"auto\" id=\"viewer-r871n659\" tabindex=\"-1\"><span class=\"jpwv0\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>In our view, a doctor&#8217;s recommendation for Work From Home should never be dismissed casually.
