In a <a href=\"https:\/\/www.warren.senate.gov\/wp-content\/uploads\/2026\/08\/Letter-to-MOHELA-re-False-Delinquency-Notices-Final.pdf\" target=\"_blank\" rel=\"noopener\">letter sent August 27<\/a> (PDF File) to MOHELA CEO Scott Giles, Senators demand the servicer explain the <a href=\"https:\/\/thecollegeinvestor.com\/85563\/mohela-glitch-hits-student-loan-borrowers-with-false-past-due-notices\/\">false past-due notices that hit borrowers<\/a> earlier this month. They set a September 10, 2026 deadline for answers.<\/p>\n<p class=\"wp-block-paragraph\">The letter follows <a href=\"https:\/\/www.forbes.com\/sites\/adamminsky\/2026\/08\/04\/borrowers-get-false-notices-that-their-student-loans-are-delinquent\/\" target=\"_blank\" rel=\"noopener\">Forbes reporting on August 4<\/a> that MOHELA sent delinquency warnings to borrowers who were current on their loans. The emails claimed loans were \u201cseverely past due,\u201d that \u201cPayment in Full is Required,\u201d and that borrowers faced <a href=\"https:\/\/thecollegeinvestor.com\/80311\/wage-garnishment-on-defaulted-student-loans-restarts-this-fall\/\">wage garnishment and other consequences of default<\/a>. One version told borrowers they had missed nine due dates and were more than 240 days past due.<\/p>\n<p class=\"wp-block-paragraph\">In updated reporting from <a href=\"https:\/\/news.bgov.com\/bloomberg-government-news\/student-loan-servicer-probed-over-misleading-past-due-notices\" target=\"_blank\" rel=\"noopener\">Bloomberg<\/a> this week, the Department of Education said the incorrect notifications impacted less than 6,000 borrowers.<\/p>\n<h2 class=\"wp-block-heading\">Why It Matters<\/h2>\n<p class=\"wp-block-paragraph\">The big concern: a borrower who believes the notice is correct might pay money they don\u2019t owe \u2014 or worse, liquidate retirement accounts to head off a default that was never coming. The senators\u2019 letter posted screenshots showing a \u201ctotal amount due\u201d over $10,000 in one case.<\/p>\n<p>\u201c<em>This error is a failure that has not only been highly distressing for borrowers but could have led to direct financial harm<\/em>,\u201d the senators wrote. If the false delinquencies reached credit bureaus, credit scores could drop, a familiar problem for borrowers after <a href=\"https:\/\/thecollegeinvestor.com\/80507\/ny-fed-3-6-million-federal-student-loan-borrowers-have-defaulted-since-october\/\">defaults surged and credit scores fell 91 points<\/a> when reporting resumed.<\/p>\n<p class=\"wp-block-paragraph\">MOHELA\u2019s response allegedly made things worse. Borrowers who called were promised a supervisor, then routed to an automated line promising a callback within two business days. And while MOHELA said impacted borrowers would be notified of the error by email, <a href=\"https:\/\/www.businessinsider.com\/student-loan-borrowers-mistakenly-received-delinquency-emails-mohela-debt-2026-8\" target=\"_blank\" rel=\"noopener\">Business Insider reported<\/a> those correction emails still hadn\u2019t gone out days after the error became public. <\/p>\n<p class=\"wp-block-paragraph\">Borrowers trying to figure out whether a notice is real can check their status directly at StudentAid.gov, something we recommend in our <a href=\"https:\/\/thecollegeinvestor.com\/20506\/problems-mohela-loan-servicing\/\">MOHELA servicing review<\/a>.<\/p>\n<h2 class=\"wp-block-heading\">The Nine Questions Senators Want Answers To<\/h2>\n<p class=\"wp-block-paragraph\">The senators want MOHELA to answer the following questions:<\/p>\n<ol class=\"wp-block-list\">\n<li>How many borrowers received false notices in each month since January 2026<\/li>\n<li>The average false \u201ctotal amount due\u201d stated on the notices<\/li>\n<li>Why the notices went out in the first place<\/li>\n<li>When affected borrowers will be told they aren\u2019t delinquent, and how many have been notified so far<\/li>\n<li>The median time it took to remove false delinquencies from accounts<\/li>\n<li>How many borrowers actually paid the amounts demanded, and the total sum<\/li>\n<li>Whether MOHELA will proactively refund payoff payments and overpayments<\/li>\n<li>Whether MOHELA will make borrowers whole for other damage, including tax penalties from retirement account withdrawals<\/li>\n<li>What steps will prevent false notices going forward<\/li>\n<\/ol>\n<h2 class=\"wp-block-heading\">The Growing Pattern Of Errors<\/h2>\n<p class=\"wp-block-paragraph\">The letter and accompanying press release catalogs MOHELA\u2019s track record: nearly two million credit reporting errors tied to loan transfers in 2023, inaccurate billing statements during the return to repayment that <a href=\"https:\/\/www.cnbc.com\/2023\/10\/30\/education-dept-penalizes-student-loan-servicer-mohela-for-errors.html\" target=\"_blank\" rel=\"noopener\">directly caused 800,000 delinquencies<\/a>, and repayment plan application backlogs so severe the Biden administration temporarily stopped assigning the servicer new accounts. MOHELA has also faced <a href=\"https:\/\/thecollegeinvestor.com\/57194\/mohela-faces-multi-state-loan-servicing-probes\/\">multi-state servicing probes<\/a> over similar breakdowns.<\/p>\n<p class=\"wp-block-paragraph\">The senators are also concerned that these patterns and errors aren\u2019t being fulling investigated and loan servicers are not being held to account. The Department of Education eliminated its entire servicer oversight team as part of staffing cuts that an <a href=\"https:\/\/thecollegeinvestor.com\/85243\/oig-report-education-department-cut-40-of-staff-gutting-student-loan-oversight\/\">inspector general report found gutted student loan oversight<\/a>. <\/p>\n<p class=\"wp-block-paragraph\">A <a href=\"https:\/\/www.gao.gov\/products\/gao-26-108534\" target=\"_blank\" rel=\"noopener\">March 2026 GAO report<\/a> warned that halting servicer accuracy assessments could leave borrowers overbilled or placed in the wrong repayment status, and noted the administration told servicers it \u201chas waived financial penalties\u201d for poor performance.
