Bandcamp has built a reputation as one of the more artist-friendly platforms in the digital music economy. And compared with many streaming platforms, that reputation isn\u2019t without reason.<\/strong><\/p>\n
Bandcamp says artists retain ownership of their music. It also says artists generally receive 80% to 85% of every dollar a fan spends. But \u201cartist-friendly\u201d doesn\u2019t mean \u201cread the fine print later.\u201d<\/p>\n
Bandcamp\u2019s current Terms of Use, effective May 7, 2026<\/strong>, contain several provisions that independent artists, producers, labels and songwriters should understand before uploading music or merchandise.<\/p>\n
Here are five that deserve considerably more attention.<\/p>\n
\n
1. Bandcamp Doesn\u2019t Own Your Music, But You Give It a Broad License<\/h2>\n
Let\u2019s start with the important distinction.<\/p>\n
Bandcamp does not take ownership of your music.<\/strong><\/p>\n
The company\u2019s own introduction to its Terms explicitly says artists aren\u2019t signing over their rights and that Bandcamp takes the rights necessary to operate its service.<\/p>\n
But that doesn\u2019t mean Bandcamp receives a tiny, narrowly defined permission slip.<\/p>\n
The Terms grant Bandcamp a broad license to use uploaded material in connection with its site and service. That includes rights to reproduce, distribute, publicly perform, display, synchronize and otherwise exploit User Submissions, with the license described as worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, sublicensable and transferable.<\/p>\n
For artists, the distinction is crucial:<\/p>\n
You retain ownership. Bandcamp receives licensed rights.<\/strong><\/p>\n
Those are two very different things.<\/p>\n
The license allows Bandcamp to do things necessary to operate, promote and redistribute the service. The Terms also make clear that the license does not<\/strong> eliminate the artist\u2019s ability to grant additional licenses to the material.<\/p>\n
So the headline shouldn\u2019t be:<\/p>\n
\n
\u201cBandcamp owns your music.\u201d<\/p>\n<\/blockquote>\n
It doesn\u2019t.<\/p>\n
The more accurate question is:<\/p>\n
\n
\u201cWhat rights am I giving Bandcamp to use my music and other content without separately negotiating with me every time?\u201d<\/strong><\/p>\n<\/blockquote>\n
That\u2019s the question artists should actually be asking.<\/p>\n
\n
Here\u2019s one that could easily get buried inside the Terms.<\/p>\n
Bandcamp can allow customers to redownload music they\u2019ve already purchased<\/strong>.<\/p>\n
The Terms specifically cover situations where a customer received a corrupted or incorrect file, received an incomplete product, or lost previously purchased content because of things such as hard-drive failure, damage, theft or destruction.<\/p>\n
Bandcamp can also permit a user with a Bandcamp account to redownload previously purchased content.<\/p>\n
And the Terms explicitly state that no additional payment is made to the artist for those redistributions.<\/strong><\/p>\n
That doesn\u2019t mean Bandcamp can randomly hand your album to strangers for free.<\/p>\n
The provision concerns customers who already purchased the content or situations where Bandcamp determines a replacement is appropriate.<\/p>\n
Still, from an artist-business perspective, it\u2019s an important distinction:<\/p>\n
A new sale generates revenue.<\/strong><\/p>\n
A replacement\/redownload does not necessarily generate a new transaction or second artist payment.<\/strong><\/p>\n
That\u2019s not necessarily unfair. A customer shouldn\u2019t have to buy the same album twice because their hard drive died.<\/p>\n
But artists should understand that the platform\u2019s definition of a \u201cpurchase\u201d and its handling of subsequent access aren\u2019t necessarily the same thing.<\/p>\n
\n\n
This one gets repeated incorrectly all over the music business.<\/p>\n
Bandcamp currently charges a 10% revenue share on physical goods<\/strong>. Digital items are generally subject to a 15% revenue share<\/strong>, which drops to 10% once an artist reaches $5,000 in sales and maintains the applicable sales threshold over the preceding 12 months.<\/p>\n
So if you sell a $30 shirt:<\/p>\n
$30 sale<\/strong><\/p>\n
\u2212 $3 Bandcamp revenue share<\/strong><\/p>\n
= $27<\/strong><\/p>\n
But you\u2019re not necessarily finished.<\/p>\n
Payment-processing fees are separate. Bandcamp says those vary by transaction, with typical processing costs around 4% to 6% overall, depending on the transaction.<\/p>\n
The Terms also specify that merchandise payouts can be reduced by applicable:<\/p>\n
\n
Revenue Share<\/li>\n
Publishing Share<\/li>\n
sales tax remitted by Bandcamp<\/li>\n
payment-processing fees<\/li>\n<\/ul>\n
So:<\/p>\n
\n
\u201cBandcamp takes 10% of merch.\u201d<\/strong><\/p>\n<\/blockquote>\n
is technically true as far as its revenue share goes.<\/p>\n
But:<\/p>\n
\n
\u201cBandcamp takes only 10% of your merch sale.\u201d<\/strong><\/p>\n<\/blockquote>\n
is a different statement.<\/p>\n
The actual payout calculation can involve several moving pieces.<\/p>\n
\n
Here\u2019s where things get especially interesting for producers and songwriters.<\/p>\n
Bandcamp\u2019s Terms allow it to deduct and accrue a Publishing Share<\/strong> from digital transactions when the music involves songwriters affiliated with organizations such as PROs, MROs or CMOs.<\/p>\n
And \u201cdigital transaction\u201d isn\u2019t necessarily limited to somebody buying an MP3.<\/p>\n
Bandcamp\u2019s current help documentation says that merchandise containing a digital download can also be subject to collection-society accruals.<\/strong><\/p>\n
For example:<\/p>\n
$20 T-shirt + digital album<\/strong><\/p>\n
The publishing-related calculation isn\u2019t necessarily applied to the entire $20 merchandise price. Bandcamp says it calculates the applicable share based on the digital component.<\/p>\n
That distinction matters.<\/p>\n
If you\u2019re a producer selling:<\/p>\n
\n
beat tapes<\/li>\n
albums<\/li>\n
vinyl<\/li>\n
shirts bundled with downloads<\/li>\n
digital beat licenses<\/li>\n
producer packs<\/li>\n<\/ul>\n
you shouldn\u2019t assume that \u201cphysical merchandise\u201d automatically means zero music-rights deductions<\/strong>.<\/p>\n
Bandcamp specifically distinguishes between physical products containing no digital music and merchandise that includes digital content.<\/p>\n
\n
This may be the most important provision here for producers.<\/p>\n
When you upload music, you\u2019re making representations about your rights.<\/p>\n
Bandcamp\u2019s Terms require artists to represent that they have the necessary rights and authorization to upload and exploit the music and artwork through the service.<\/p>\n
That becomes particularly important when a recording involves:<\/p>\n
\n
multiple producers<\/li>\n
songwriters<\/li>\n
publishers<\/li>\n
samples<\/li>\n
interpolations<\/li>\n
featured artists<\/li>\n
labels<\/li>\n
PROs<\/li>\n
MROs<\/li>\n
CMOs<\/li>\n<\/ul>\n
The Terms require artists to accurately identify songwriter affiliations where applicable.<\/p>\n
And here\u2019s where things get serious.<\/p>\n
If Bandcamp determines that a songwriter was incorrectly identified as not being affiliated with a relevant collecting society or publishing organization, Bandcamp can, among other remedies:<\/p>\n
\n
deduct and accrue the Publishing Share,<\/li>\n
remove the music, or<\/li>\n
terminate access to the service.<\/li>\n<\/ol>\n
The Terms also say Bandcamp can recover Publishing Share amounts that weren\u2019t retained because the artist supplied incorrect writer or publisher information. The company can debit the artist\u2019s account, and if there aren\u2019t sufficient funds, the artist agrees to reimburse Bandcamp through other means.<\/p>\n
That\u2019s a very different proposition from:<\/p>\n
\n
\u201cI uploaded the song, so Bandcamp handles everything.\u201d<\/p>\n<\/blockquote>\n
It doesn\u2019t.<\/strong><\/p>\n
The artist is still responsible for knowing who owns what.<\/p>\n
\n\n
Bandcamp\u2019s Terms go further than simply asking whether you own the master.<\/p>\n
You represent that exploitation of the music through Bandcamp won\u2019t violate third-party rights.<\/p>\n
The Terms specifically discuss possible claims involving third parties such as:<\/p>\n
\n
publishers<\/li>\n
PROs<\/li>\n
MROs<\/li>\n
CMOs<\/li>\n
unions<\/li>\n
guilds<\/li>\n
musicians<\/li>\n
vocalists<\/li>\n
engineers<\/li>\n
producers<\/li>\n<\/ul>\n
If another agreement prevents you from granting Bandcamp the rights you\u2019re granting, the Terms can place responsibility for resulting claims on you, including indemnification for claims and associated legal costs.<\/p>\n
For independent producers, this is where the conversation changes from:<\/p>\n
\u201cHow much does Bandcamp take?\u201d<\/strong><\/p>\n
to:<\/p>\n
\u201cDo I actually have the rights to sell what I\u2019m uploading?\u201d<\/strong><\/p>\n
That\u2019s the question that can save an artist a very expensive headache.<\/p>\n
\n
The fine print isn\u2019t all bad news.<\/p>\n
Bandcamp\u2019s Terms contain a significant provision concerning artificial intelligence.<\/p>\n
The company\u2019s change log says its November 2024 update added language stating that Bandcamp will not use an artist\u2019s music to train models that generate music, nor allow others to do so.<\/strong><\/p>\n
That\u2019s particularly noteworthy in today\u2019s AI-heavy music environment.<\/p>\n
So the picture isn\u2019t simply:<\/p>\n
\u201cBig platform takes artist rights.\u201d<\/strong><\/p>\n
It\u2019s more nuanced.<\/p>\n
Bandcamp says:<\/p>\n
You keep ownership.<\/strong><\/p>\n
We receive licenses necessary to operate the platform.<\/strong><\/p>\n
We take a revenue share.<\/strong><\/p>\n
You remain responsible for having the rights to what you upload.<\/strong><\/p>\n
And we don\u2019t use your music to train generative music models without the required permission.<\/strong><\/p>\n\n
Compared with many mainstream digital platforms, Bandcamp remains unusually transparent about the basic economic relationship with artists.<\/strong><\/p>\n
But artist-friendly doesn\u2019t mean artists should stop reading contracts.<\/p>\n

And that\u2019s ultimately the lesson.<\/p>\n
Don\u2019t just read the percentage. Read the rights language.<\/strong><\/h3>\n
An artist\u2019s relationship with a platform isn\u2019t just about:<\/p>\n
\u201cWhat percentage do they take?\u201d<\/strong><\/p>\n
It\u2019s also about:<\/p>\n
Who owns the music?<\/strong><\/p>\n
What license are you granting?<\/strong><\/p>\n
Can the platform redistribute previously purchased content?<\/strong><\/p>\n
Who pays publishing obligations?<\/strong><\/p>\n
What happens when writer information is wrong?<\/strong><\/p>\n
What third-party rights are you promising you control?<\/strong><\/p>\n
What happens to your money when taxes, processing fees and other deductions enter the equation?<\/strong><\/p>\n
Those questions are buried in the legal machinery.<\/p>\n
And that\u2019s precisely where independent artists need to start paying attention.<\/p>\n
\n
Bottom line<\/h3>\n
Bandcamp does not take ownership of your music.<\/strong> But uploading music means accepting a contractual framework that gives Bandcamp significant rights to operate, distribute and promote the service, while placing substantial responsibility on the artist to ensure that the music and associated rights information are accurate.<\/p>\n
For independent artists, producers and labels, the percentage Bandcamp takes is only half the conversation.<\/strong><\/p>\n
The other half is the fine print.<\/p>\n
