The door clicks shut. Outside, it\u2019s the same rush-hour story across cities, with vehicles inching forward on Bengaluru\u2019s Outer Ring Road at rush hour, or Mumbai\u2019s Western Express Highway- take your pick. You\u2019re checking the route on your phone when a small banner slides across the driver\u2019s screen and yours: this trip is being recorded. There\u2019s no pop-up asking you to agree. No slider to switch it off. Just a notice, and then the ride begins. That\u2019s Uber\u2019s new <\/span>Record My Ride<\/span><\/i> feature in India. And the real story here isn\u2019t the camera. It\u2019s what \u201c<\/span>consent<\/b>\u201d is supposed to mean when you\u2019re already sitting in the backseat.<\/span><\/p>\n

Why Uber Built a Camera Into the Dashboard<\/h5>\n

Uber officially rolled out Record My Ride at its Uber Surakshit Conference in New Delhi on <\/span>June 30, 2026<\/span><\/a>, packaging it alongside ambulance assistance and rider-set trip PINs. It wasn\u2019t new, exactly. The feature had been <\/span>running quietly since May 2025<\/span><\/a>, and by the time it went public, it was already live in ten cities: Delhi, Mumbai, Bengaluru, Chennai, Hyderabad, Kolkata, and more.<\/span><\/p>\n

The trigger wasn\u2019t a passenger-safety campaign. It was the drivers. Drivers in Delhi-NCR have been telling reporters for months that they face a specific, gnawing risk: a passenger threatens to file a false complaint, and the driver absorbs the consequences. A penalty or a suspended account can follow, with nothing to push back with except the driver\u2019s own word. Record My Ride hands drivers something to point to. The driver controls it. The driver\u2019s phone shoots the footage. And whoever\u2019s in the back seat gets captured along with it, whether they meant to be part of the record or not.<\/span><\/p>\n

A Notice Isn\u2019t the Same as a \u201cYes\u201d<\/h5>\n

Here\u2019s where it gets messy. Since the pilot phase, the driver has had to manually switch on the recording, and the rider is informed that the trip is being recorded. But now, as of June 2026, the feature activates <\/span>automatically<\/span><\/a> on every trip, and the rider is simply notified when it starts. That\u2019s it. No consent screen, no checkbox, no way to say \u201cactually, no.\u201d If you\u2019re not comfortable with it, your only real option is to cancel a ride you already booked, waited for, and perhaps need. For a lot of riders, walking away isn\u2019t much of a choice at all.<\/span><\/p>\n

Even Uber knows this is shaky ground. Its own <\/span>help documentation<\/span><\/a> concedes that certain regions may legally require rider consent. This is an odd thing to include in your FAQ if a notification alone would have covered you.<\/span><\/p>\n

What the Law Actually Says<\/h5>\n

India\u2019s <\/span>Digital Personal Data Protection Act, 2023<\/span><\/a> (DPDP) is built on three principles: notice, a clearly defined purpose, and consent. Video of a recognisable person counts as personal data under that law, full stop. So the live question beneath all of this is simple to state but hard to answer: Does telling a passenger they\u2019re being filmed satisfy the DPDP Act, or does actually recording them require consent first?<\/span><\/p>\n

There\u2019s an older precedent hanging over this too. The Supreme Court\u2019s <\/span>Puttaswamy judgment<\/span><\/a>, which established privacy as a fundamental right, set a necessity and proportionality test for anything that intrudes on it. A driver-controlled camera filming every passenger who gets in the car, regardless of whether that specific ride ever involves a dispute, will eventually have to answer why that\u2019s proportionate to the problem it\u2019s solving.<\/span><\/p>\n

The catch is that the DPDP Act\u2019s notice-and-consent machinery is still being switched on in phases, and full compliance is not required until May 2027. Thus, there is no fully operational enforcement mechanism against which to test Uber\u2019s approach. That doesn\u2019t mean the underlying obligations don\u2019t apply; it means nobody has had to answer for them yet.\u00a0<\/span><\/p>\n

Where the Footage Actually Goes<\/h5>\n

To be fair to Uber, the technical design isn\u2019t reckless. Recordings are encrypted on the driver\u2019s own phone and locked away from everyone, including Uber, unless the driver files a safety report. Left untouched, Uber says the footage disappears after 14 days.<\/span><\/p>\n

Except that number doesn\u2019t quite hold up. Uber\u2019s help page says 14 days. An <\/span>earlier report on the same pilot<\/span><\/a> put the retention window at a week. Two different numbers for the same feature are the kind of detail that makes you wonder how tightly anyone\u2019s actually tracking this.<\/span><\/p>\n

Retention isn\u2019t the only exit door, either. Uber has said it can hand recordings to police \u201cwith appropriate legal process or in emergencies,\u201d broad enough to cover a lot of ground, and vague enough that nobody outside Uber knows exactly where that line sits.<\/span><\/p>\n

The Questions Still Sitting There<\/h5>\n

This is the kind of gap that shows up when a safety feature gets built driver-first and rider-second. Multiple questions need to be answered<\/span>: what legal ground actually justifies filming a passenger who was told about the camera but never given a real say in it, whether turning it down still gets you in the car or cancelling the ride is the only door left open, which of the several retention periods floating around is the one that\u2019s actually true, what has to happen before that footage lands in a police file, and whether anyone bothered to run a proper data protection impact assessment before flipping this feature on across ten cities.\u00a0<\/span><\/p>\n

None of those has public answers yet. As India\u2019s data protection rules move from paper to enforcement, Record My Ride is shaping up to be a genuine test case not of whether Uber can build a camera into its app, but of whether \u201cwe told you\u201d will ever count as \u201cyou agreed.\u201d Next time that banner slides across your screen mid-ride, it\u2019s worth asking: if you\u2019d said no, would it have made any difference at all?<\/span><\/p>\n\n
