BCLP recommends reviewing probation length now, <strong>shorter periods, three to four months, extendable by no more than a month<\/strong>, tend to work better under the new timeline, alongside clear performance standards set from the outset and regular, documented review points.<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong>Statutory Sick Pay: What Changes From April 2026<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">Two changes to SSP took effect on <strong>6 April 2026<\/strong>, and both shift when a manager\u2019s decisions start carrying payroll consequences:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Waiting period removed. <\/strong><a href=\"https:\/\/www.acas.org.uk\/checking-sick-pay\/statutory-sick-pay-ssp\">ACAS confirms<\/a> SSP is now payable from the first qualifying day of sickness absence, not the fourth.<\/li>\n<li><strong>Lower Earnings Limit removed. <\/strong>Employees no longer need to earn above a minimum threshold to qualify at all.<\/li>\n<li><strong>Rate increased. <\/strong><a href=\"https:\/\/www.gov.uk\/guidance\/rates-and-thresholds-for-employers-2026-to-2027\">GOV.UK\u2019s own rates and thresholds<\/a> confirm the SSP weekly rate for 2026-27 is <strong>\u00a3123.25<\/strong>, or 80% of average weekly earnings, whichever is lower, up from \u00a3118.75 the previous year.<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">For a manager, this means an absence conversation that used to have three days before any pay obligation kicked in now has <strong>none<\/strong>. Every day of sickness absence is now a qualifying day from the outset, which puts more weight on getting the return-to-work conversation and documentation right early, rather than treating the first few days as a grace period.<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong>Family Leave: Paternity, Parental, and Bereavement<\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">From <strong>6 April 2026<\/strong>, the length-of-service requirement for <strong>taking<\/strong> paternity leave and unpaid parental leave was removed. <a href=\"https:\/\/www.womblebonddickinson.com\/uk\/insights\/articles-and-briefings\/employment-law-changes-april-2026-day-one-rights-and-statutory-sick\">Multiple firms confirm<\/a> both are now available from an employee\u2019s first day, including during probation.<\/p>\n<p class=\"wp-block-paragraph\">One distinction matters here, and it\u2019s easy to get wrong: this is a day-one right to <strong>take<\/strong> the leave, not to be <strong>paid<\/strong> for it. Statutory paternity pay still requires 26 weeks\u2019 continuous service, that qualifying condition hasn\u2019t changed. A new starter can request paternity leave in their first week, but whether they\u2019re paid for it during that leave depends on the separate service requirement.<\/p>\n<p class=\"wp-block-paragraph\">A new day-one right to <strong>unpaid bereavement leave<\/strong> was also introduced, covering a wider category of relatives than the previous parental bereavement leave regime it\u2019s modelled on.<\/p>\n<p class=\"wp-block-paragraph\">For managers, the practical shift is straightforward: a request for any of these can now come from someone who started days ago, not months ago. Refusing or delaying on the basis of short service is <strong>no longer an option<\/strong>, workforce planning around parental and bereavement leave needs to account for this from the point of hire.<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong>Flexible Working: What\u2019s Actually Changing (Correcting a Common Misconception)<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">It\u2019s easy to assume flexible working became a day-one right under this Act. <strong>It didn\u2019t<\/strong>, that change happened separately, in 2024. The list of acceptable business grounds hasn\u2019t changed. What\u2019s new is the second test: citing a valid ground is <strong>no longer automatically enough<\/strong> on its own.<\/p>\n<p class=\"wp-block-paragraph\">New regulations will also set out specific steps an employer must take to consult with an employee before rejecting their request, rather than leaving the process to employer discretion.<\/p>\n<p class=\"wp-block-paragraph\">For managers, this means a flexible working refusal now needs to show two things, not one: a genuine business ground, and a documented reason why relying on that ground was reasonable given the specific request. A refusal that would have stood up under the old test may not hold up under this one without that second layer of reasoning.<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong><strong>Dismissal Decisions: Why the Bar Has Moved<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">Everything above changes <strong>when<\/strong> a right applies. This section is about what happens if a dismissal decision goes wrong once it does.<\/p>\n<p class=\"wp-block-paragraph\">From the same date the qualifying period drops, <strong>1 January 2027<\/strong>, the cap on unfair dismissal compensation disappears entirely. For a manager making the actual decision, the practical consequence is more immediate: a dismissal that used to carry bounded, predictable risk now carries <strong>genuinely open-ended risk<\/strong> if the process behind it doesn\u2019t hold up.<\/p>\n<p class=\"wp-block-paragraph\">That raises the bar on what \u201cfair process\u201d needs to look like at the point of decision, not after a claim is lodged:<\/p>\n<ul class=\"wp-block-list\">\n<li>A genuine investigation<\/li>\n<li>Clear and documented reasoning<\/li>\n<li>A real opportunity for the employee to respond<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">All of this needs to happen <strong>before<\/strong> the decision is made, not reconstructed afterward to justify it. That standard hasn\u2019t changed.
