Capital assets most commonly include things like your home or vehicle, but they can also include stocks, bonds, or art.<\/p>\n<p><span style=\"font-weight: 400;\">A capital gains tax is a tax levied on any capital gains earned during a tax year. For example, if you purchased your Utah home for<\/span><span style=\"font-weight: 400;\"> $535,000 and sold it a few years later for $635,000<\/span><span style=\"font-weight: 400;\">, you have earned a capital gain of $100,000, which would be taxed.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Capital gains tax rates differ by state. Some states, like Florida, don\u2019t even have a capital gains tax. Utah charges a flat rate for its capital gain tax of<\/span> <a href=\"https:\/\/incometax.utah.gov\/credits\/capital-gains\"><span style=\"font-weight: 400;\">4.5%<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>Capital gains are also classified as \u201cshort-term\u201d or \u201clong-term\u201d at the Federal level.<\/p>\n<ul>\n<li aria-level=\"1\">Capital gains are considered <strong>short-term<\/strong> when an asset is sold within a year of its purchase. Those gains are lumped into your regular income and taxed according to your tax bracket.<\/li>\n<li aria-level=\"1\">Capital gains are considered <strong>long-term <\/strong>when earned from the sale of an asset after at least a full year of ownership. Those gains are taxed at a variable rate for a home sale, depending on your income. The table below will illustrate:<\/li>\n<\/ul>\n<h3>Federal 2026 capital gains tax brackets<\/h3>\n<p>The table below shows the <a href=\"https:\/\/www.irs.gov\/newsroom\/irs-releases-tax-inflation-adjustments-for-tax-year-2026-including-amendments-from-the-one-big-beautiful-bill\">long-term capital gains rates<\/a> for tax year 2026. The years you\u2019ve lived in it don\u2019t need to be consecutive. Certain exceptions to this rule are made for those who are disabled or those in the <\/span><a href=\"https:\/\/www.homelight.com\/blog\/military-selling-house\/\"><span style=\"font-weight: 400;\">military<\/span><\/a><span style=\"font-weight: 400;\">, Foreign Service, intelligence community, or Peace Corps.<\/span><\/li>\n<li aria-level=\"1\">You didn\u2019t acquire the home through a like-kind exchange (also known as a <a href=\"https:\/\/www.irs.gov\/pub\/irs-news\/fs-08-18.pdf\">section 1031 exchange<\/a>) within the past five years. This is basically when you swap one investment property for another.<\/li>\n<li aria-level=\"1\">You haven\u2019t claimed the exclusion on another home in the past two years.<\/li>\n<li aria-level=\"1\">You aren\u2019t subject to expatriate tax (a government fee paid by those who renounce their citizenship or take up residency in another country).<\/li>\n<\/ul>\n<p>You may still qualify for a partial exclusion even if you don\u2019t fit any of the above criteria.<\/p>\n<p>Circumstances such as a <a href=\"https:\/\/www.homelight.com\/blog\/sell-house-for-job-relocation\/\">change in workplace location<\/a>, a problem with your health, or having to sell the property of a <a href=\"https:\/\/www.homelight.com\/blog\/selling-parents-home-after-death\/\">parent who passed away<\/a>, among others, can qualify you. For more, please refer to <a href=\"https:\/\/www.irs.gov\/publications\/p523\">IRS Publication 523<\/a>.<\/p>\n<h3>How to report your Utah capital gains taxes<\/h3>\n<h2>Utah transfer taxes<\/h2>\n<p>The government charges a tax on this transaction whenever you sell your home and transfer the legal ownership to the buyer. This is known as a <a href=\"https:\/\/www.homelight.com\/blog\/real-estate-transfer-tax\/\">transfer tax<\/a>, also sometimes called a Documentary Stamp Tax or recordation tax, depending on the state.<\/p>\n<p>The <a href=\"https:\/\/www.ftc.gov\/sites\/default\/files\/documents\/one-stops\/real-estate-competition\/realestateglossary.pdf\">Federal Trade Commission<\/a> describes transfer taxes as fees that state or local governments impose when the title to a property transfers from one owner to another.<\/p>\n<p>The amount owed in transfer taxes when selling your home will vary, as different states, counties, and cities have their own guidelines. Similar to other forms of taxation, these taxes are a way for the government to <a href=\"https:\/\/www.homelight.com\/blog\/real-estate-transfer-tax\/\">generate revenue<\/a> and are an important part of determining your overall profit when selling your home.<\/p>\n<p><span style=\"font-weight: 400;\">Who pays the transfer tax will also depend on the state. Sometimes it\u2019s the buyer, sometimes it\u2019s the seller. Utah, unlike most states, <\/span><a href=\"https:\/\/www.homelight.com\/blog\/utah-real-estate-transfer-tax\/\"><span style=\"font-weight: 400;\">does not charge a transfer tax<\/span><\/a><span style=\"font-weight: 400;\">.
