The US media outlets who<br \/>\n\u2018called\u2019 the election in favor of Joe Biden focused solely on whether he was definitely<br \/>\nwinning 270 electoral college seats, and did not focus on whether he had won a<br \/>\nsimple majority of the total number of votes cast. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">So, what exactly is this electoral<br \/>\ncollege system, and why is the election not decided simply by determining which<br \/>\ncandidate receives more national votes in total? In this post, we shall discuss<br \/>\ncertain features of the electoral college system, which shall help us understand<br \/>\nthe election result better. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><i><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">Let us begin by discussing certain<br \/>\nessential features of the electoral college system, along with some relevant<br \/>\nstats: <\/span><\/i><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The total number of seats in the<br \/>\nelectoral college is 538. These 538 seats are divided and allocated amongst<br \/>\nevery State in the US. The allocation of seats is done on the basis of the<br \/>\npopulation of each State. For instance, as California is the State with the<br \/>\nlargest population, it has 55 seats in the electoral college \u2013 which is more<br \/>\nthan any other State. On the other hand, Delaware and Hawaii have only 3 seats<br \/>\neach in the electoral college, as their population is significantly less when<br \/>\ncompared to a large State like California. The number of seats in the electoral<br \/>\ncollege also equals the number of representatives a State sends to the US<br \/>\nCongress (i.e. the House of Representatives and the Senate).<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The presidential candidate who wins<br \/>\nmore votes in a particular State wins all the seats of that State\u2019s electoral<br \/>\ncollege. For instance, as Joe Biden received more votes than Donald Trump in<br \/>\nCalifornia, he won all the 55 electoral college seats. This system of granting<br \/>\nall electoral college seats to the winning candidate is known as the \u2018winner-takes-all\u2019<br \/>\nsystem.\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">As there are a total of 538 electoral<br \/>\ncollege seats, a candidate has to win at least 270 seats to be elected as the<br \/>\nPresident. Now, a candidate can win 270 seats based on the number of States<br \/>\nwhere he receives a majority of the vote. Hence, the outcome is decided based<br \/>\non the number of seats won, and not by whether the candidate receives more of<br \/>\nthe total national vote.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">This implies that a candidate can win<br \/>\nthe presidential election even if he does not win the total national vote, but<br \/>\nwins at least 270 electoral college seats. This happened in the 2016 presidential<br \/>\nelection, where Donald Trump lost the total national vote, but still won 306<br \/>\nseats of the electoral college. Hillary Clinton received a total of 2.9 million<br \/>\nmore votes than Donald Trump. But, she lost the election as she could only win 232<br \/>\nelectoral college seats. This is one of the main reasons why the electoral<br \/>\ncollege system has been criticized \u2013 as a candidate can win the election even<br \/>\nif he loses the total national popular vote.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">Apart from 2016, there have been 4<br \/>\nother instances where a candidate won the election even after losing the total<br \/>\nnational vote. In 2000, George Bush Jr. won the election even though Al Gore,<br \/>\nthe Democratic presidential nominee, won the popular vote. In fact, George Bush<br \/>\nJr won the State of Florida by a small margin of 537 votes, and became<br \/>\nPresident only after the United States Supreme Court barred the State of<br \/>\nFlorida from recounting the votes! For instance, as<br \/>\nCalifornia has consistently voted for the Democratic Party, it is categorized<br \/>\nas a \u2018Blue State\u2019. On the other hand, as Texas is a stronghold of the Republican<br \/>\nparty, it is categorized as a \u2018Red State\u2019. There are only a handful of \u2018Swing<br \/>\nStates\u2019, where there is a greater possibility of the vote swinging between the<br \/>\nDemocratic and Republican candidates. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">In this election, Pennsylvania,<br \/>\nMichigan, Wisconsin, Florida, Arizona, and Georgia were considered as the major<br \/>\nswing States, where the vote could swing between either of the parties. Arizona<br \/>\nand Georgia were late entrants to this list, as both of these States have also<br \/>\ntraditionally voted for the Republican Party in the past. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The presence of these swing States also<br \/>\nthrows light on the campaigning patterns of the presidential candidates, and<br \/>\nwhy they spent a disproportionate amount of time campaigning in the Swing<br \/>\nStates. While Biden and Trump barely visited California or Texas (where the<br \/>\noutcome was certain), they spent considerable amount of time in Michigan,<br \/>\nWisconsin, Pennsylvania and Florida \u2013 where the vote could shift in small, but decisive<br \/>\nmargins. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">In 2016, Donald Trump managed to cross<br \/>\nthe 270-barrier only after he won Pennsylvania, Michigan and Wisconsin by very<br \/>\nsmall margins. Donald Trump won Pennsylvania by only 44,292 votes, and won<br \/>\nWisconsin by an even smaller margin of 22,748 votes. Even in the current election,<br \/>\nJoe Biden is likely to win Pennsylvania and Wisconsin by a small margin of<br \/>\napproximately 40,000 votes each. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The presence of such swing States with<br \/>\nsmall victory margins leads to a situation where certain States get a greater<br \/>\nweightage in determining the outcome of the Presidential election. If the<br \/>\nelectoral college is abolished, the candidate who wins a simple majority of the<br \/>\ntotal national votes can be directly adjudged as the winner. This would<br \/>\ndirectly reduce the disproportionate significance that a handful of Swing<br \/>\nStates have, in determining the outcome of the election. For this reason, there<br \/>\nhave been multiple demands for a constitutional amendment to abolish the<br \/>\nelectoral college system. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">But how did such a system originate in<br \/>\nthe first place? <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><b><i><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The historical origins of the electoral<br \/>\ncollege system <\/span><\/i><\/b><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">The United States Constitution was<br \/>\ndrafted at the Constitutional Convention in Philadelphia, which took place<br \/>\nbetween May 25 and September 17, 1787. The framers of the Constitution decided to<br \/>\nallocate a specific number of electoral college seats to each State \u2013 based on<br \/>\nits population. The number of electoral college seats allocated would also be equal<br \/>\nto the number of representatives that the State would send to the US Congress.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">While the Constitution was being<br \/>\ndrafted and debated, a majority of America\u2019s white citizens lived in cities<br \/>\nsuch as Boston and Philadelphia \u2013 which are in the North. As the Northern<br \/>\nStates had a higher population of Whites \u2013 they would be allotted a higher number<br \/>\nof seats in the electoral college. The Southern States (such as Alabama and<br \/>\nTexas) had less Whites when compared to the North. But, a majority of African-Americans,<br \/>\nwho were slaves and were treated as the \u2018property\u2019 of their \u2018owners\u2019 \u2013 stayed<br \/>\nin these Southern States. The Northern States had a very small proportion of<br \/>\nAfrican Americans. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">As African-Americans were considered to<br \/>\nbe the \u2018property\u2019 of their \u2018owners\u2019 \u2013 they did not have voting rights, and were<br \/>\nnot treated as equal citizens. But, the Southern States wanted them to be included<br \/>\nwhile calculating the total population of a State, as an increase in that<br \/>\nnumber would grant them more seats in the electoral college. The Northern<br \/>\nStates rejected this demand. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">This stalemate led to the \u2018three-fifths<br \/>\ncompromise\u2019 \u2013 which was codified in <a href=\"https:\/\/www.law.cornell.edu\/constitution\/articlei\">Article 1, Section 2<\/a><br \/>\nof the US Constitution. As per the \u2018three-fifths compromise\u2019 \u2013 every African-American<br \/>\nwould be considered as \u2018three-fifths\u2019 (60%) of a White person. Hence, as an<br \/>\nexample, for every 100 African-Americans, the State\u2019s population would be<br \/>\ndeemed to increase by 60. This significantly increased the number of seats Southern<br \/>\nStates received in the electoral college. The practice of slavery, where Blacks<br \/>\nwere treated as property and not as human beings \u2013 is one of the founding<br \/>\npillars of this electoral college system. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">In 1816, a formal proposal was moved<br \/>\nbefore the US Congress for the first time \u2013 to elect the President by determining<br \/>\nthe winner of the national popular vote, and abolish the electoral college<br \/>\nsystem. This proposal was shot down by Senators from the Southern States &#8211; who<br \/>\nfelt that this would reduce the influence that Southern States had in the<br \/>\nelectoral process. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">In 1969, the House of Representatives<br \/>\nvoted in favor of a constitutional amendment to dismantle the electoral college<br \/>\nsystem. But, this amendment could not pass the Senate as a bipartisan consensus<br \/>\ncould not be achieved. The electoral college system, conceptualized in the dark<br \/>\nera of slavery, has hence survived the test of two centuries, while 270<br \/>\ncontinues to be the magic number. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 150%; text-align: justify;\"><b><i><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\">Postscript:<\/span><\/i><\/b><i><span style=\"font-family: &quot;Georgia&quot;,serif; font-size: 12pt; line-height: 150%; mso-bidi-font-family: &quot;Times New Roman&quot;;\"> While we discuss the US elections, it<br \/>\nis significant to note that African-American men were conferred the right to<br \/>\nvote only in 1870, 5 years after the practice of slavery was abolished. Also,<br \/>\nall adult women got the right to vote only in 1920, after the 19<sup>th<\/sup><br \/>\nAmendment to the US Constitution was ratified.
