{"id":7039020,"date":"2026-08-16T08:10:37","date_gmt":"2026-08-16T08:10:37","guid":{"rendered":"https:\/\/peraltafinancing.com\/business\/legal\/rights-group-warns-russia-strike-on-ukraine-may-constitute-war-crime-jurist\/"},"modified":"2026-08-16T08:10:37","modified_gmt":"2026-08-16T08:10:37","slug":"rights-group-warns-russia-strike-on-ukraine-may-constitute-war-crime-jurist","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=7039020","title":{"rendered":"Rights group warns Russia strike on Ukraine may constitute war crime &#8211; JURIST"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>Human Rights Watch (HRW) on Thursday <a href=\"https:\/\/www.hrw.org\/news\/2026\/08\/13\/russia-cluster-munition-attack-on-kyiv-a-potential-war-crime\">warned<\/a> that Russia\u2019s attack on Kyiv, which utilized cluster munitions in a crowded residential area, may constitute a war crime under international law, citing the weapon\u2019s indiscriminate nature and the high toll of civilian deaths it caused in violation of international humanitarian law.<\/p>\n<p>In commenting on the <a href=\"https:\/\/www.jurist.org\/commentary\/2025\/11\/dismantling-the-chaos-exception-ukraine-v-russia-and-human-rights-accountability\/\">latest attack<\/a>, HRW assistant Ukraine researcher Kseniya Kvitka stated:<\/p>\n<blockquote>\n<p>\u201cRussia has once again fired an inherently indiscriminate weapon into a densely populated civilian area. There can be no justification for using cluster munitions near homes, schools, and hospitals, and it shows Russia\u2019s utter disregard for civilians and the international law designed to protect them.\u201d<\/p>\n<\/blockquote>\n<p>HRW reported that Russia may have used cluster munitions in its August 5th attack on Kyiv which killed three civilians, and formed part of a wider strike on Kyiv which totaled 17 civilian causalities, and dozens injured.<\/p>\n<p><a href=\"https:\/\/www.armscontrol.org\/factsheets\/cluster-munitions-glance\">Cluster munitions<\/a> are \u201cgravity bombs, artillery shells, and rockets that fragment into small bomblets or grenades.\u201d The majority of reported cluster munitions casualties are civilians, and were used by at least 42 states throughout World War II.<\/p>\n<p>In 2008, the <a href=\"https:\/\/www.clusterconvention.org\/\">Convention on Cluster Munitions<\/a> was adopted and became binding international law. Under the<a href=\"https:\/\/www.clusterconvention.org\/treaty-obligations\/\"> treaty<\/a>, \u201cStates Parties commit to never use, product, stockpile or transfer cluster munitions.\u201d <a href=\"https:\/\/www.clusterconvention.org\/wp-content\/uploads\/2026\/03\/CCM-Universalization-Status-by-Region-updated-10-March-2026.pdf\">112 States are party to the treaty<\/a>, however,\u00a0 Russia and Ukraine are among the 73 States that have not ratified the treaty.<\/p>\n<p><a href=\"https:\/\/t.me\/oko_ua\/100758\">Footage<\/a> of the attack, posted on Telegram, shows fire in a residential area and simultaneous flashes of light and explosions. HRW stated that it analyzed the footage and determined that the attack was \u201cless than a kilometer\u201d from a hospital, and less than 500 meters east from \u201cmultiple high-rise residential buildings.\u201d<\/p>\n<p>HRW urged both countries to join the Convention on Cluster Munitions, and \u201ccommit to clearing unexploded cluster munitions in all areas under their effective control\u201d. Attacks on civilians are prohibited under international law, namely the <a href=\"https:\/\/ihl-databases.icrc.org\/en\/ihl-treaties\/gciv-1949\">Fourth Geneva Convention 1949<\/a>, and constitute war crimes.<\/p>\n<p>Russia and Ukraine have had a long history of tension stemming from centuries of shared history, imperial domination, and Soviet rule, with the modern conflict erupting in 2014 when Russia had annexed Crimea and backed separatists in Donbas, before escalating into a <a href=\"https:\/\/commonslibrary.parliament.uk\/the-conflict-in-ukraine\/\">full-scale invasion<\/a> on the 24th of February 2022 when Russia invaded Ukraine to <a href=\"https:\/\/www.jurist.org\/features\/2022\/04\/05\/russias-invasion-of-ukraine-is-the-result-of-its-own-failure-to-denazify\/\">\u2018de-militarize and de-nazify\u2019<\/a> the country. In July 2026, the UN Human Rights Monitoring Mission in Ukraine highlighted that at least <a href=\"https:\/\/ukraine.ohchr.org\/en\/reports\">437 civilians<\/a> were killed in July 2026 alone, the highest number since May 2022.<\/p>\n<p>A month after Russia\u2019s invasion of Ukraine, the UN had <a href=\"https:\/\/news.un.org\/en\/story\/2022\/03\/1115092\">reported<\/a> that cluster munitions were used at least two dozen times in densely populated Ukrainian neighborhoods, drawing condemnation from the international community.<\/p>\n<\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>Human Rights Watch (HRW) on Thursday warned that Russia\u2019s attack on Kyiv, which utilized cluster munitions in a crowded residential area, may constitute a war crime under international law, citing the weapon\u2019s indiscriminate nature and the high toll of civilian deaths it caused in violation of international humanitarian law.
