They have a general grievance procedure, written before AI played any role in workplace decisions or complaints, and an assumption that it will stretch to cover whatever comes next.<\/p>\n<p class=\"wp-block-paragraph\">That gap is more urgent than it might look. <a href=\"https:\/\/www.acas.org.uk\/about-us\/acas-consultations\/code-of-practice-disciplinary-grievance-2026\">Acas opened a consultation on 30 July 2026<\/a> to update its statutory Code of Practice, and it explicitly asks the public <strong>whether AI-related issues in disciplinary and grievance processes need addressing at all<\/strong>. The body that sets the national standard for handling grievances hasn\u2019t decided yet. Waiting for that answer before building a policy of your own means waiting on a timeline nobody controls.<\/p>\n<p class=\"wp-block-paragraph\">This piece covers what an actual AI grievance policy needs to contain, covering both the decision-origin and AI-assisted grievances already established in this series, how to build human review into the process rather than reconstructing it afterward, and how to roll a policy out so it actually changes what happens on the ground.<\/p>\n<p class=\"wp-block-paragraph\"><strong><em>Explore: <\/em><\/strong><a href=\"https:\/\/www.avadolearning.com\/blog\/ai-grievances-employment-tribunals-guide\/\" data-type=\"link\" data-id=\"https:\/\/www.avadolearning.com\/blog\/ai-grievances-employment-tribunals-guide\/\">AI Grievances and Employment Tribunals: A Guide for HR Teams<\/a><\/p>\n<p><h2 class=\"uagb-heading-text\"><strong>Why a General Grievance Policy Isn\u2019t Enough<\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">A general grievance procedure is built around a single assumption: a human made the decision being complained about, and a human can be asked to explain it. That assumption breaks down twice over with AI:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Decision-origin grievances <\/strong>(where an algorithm helped produce the outcome): the gap is <strong>ownership and documentation<\/strong>. There\u2019s often no one assigned to explain what a system actually did, and no record of the human review that happened at the time, if it happened at all. <a href=\"https:\/\/ico.org.uk\/about-the-ico\/what-we-do\/recruitment-rewired\/\">ICO\u2019s Recruitment Rewired findings<\/a> confirm this isn\u2019t rare: many employers believe a human is meaningfully involved when, in practice, the system made the decision alone.<\/li>\n<li><strong>AI-assisted grievances <\/strong>(where the complaint itself was drafted or built with AI): the gap is <strong>readiness<\/strong>. Most HR teams have had no training on how these differ from an ordinary complaint, even though <a href=\"https:\/\/www.recruiter.co.uk\/news\/2025\/11\/how-respond-rise-ai-generated-workplace-grievances\">Irwin Mitchell\u2019s survey found<\/a> over half report they\u2019re harder to resolve.<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">Neither gap gets closed by a policy that doesn\u2019t name either problem.<\/p>\n<p class=\"wp-block-paragraph\"><strong><em>Explore: <\/em><\/strong>Anatomy of an AI-Related Grievance<\/p>\n<p class=\"wp-block-paragraph\"><strong><em>Explore: <\/em><\/strong>Tribunal Rulings, Regulatory Action and Claim Trends on AI in the Workplace<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong><strong><strong>What a Real AI Grievance Policy Actually Needs to Cover<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">A policy that just says \u201cAI-related grievances will be handled fairly\u201d doesn\u2019t actually change anything. Four specific elements do:<\/p>\n<ul class=\"wp-block-list\">\n<li><strong>Assigned ownership. <\/strong>A named role or function responsible for explaining any AI-influenced decision, not whoever happens to be free when a grievance lands.<\/li>\n<li><strong>A documented human review point. <\/strong>Captured at the time the original decision is made, not written up afterward to justify it. <a href=\"https:\/\/ico.org.uk\/about-the-ico\/what-we-do\/recruitment-rewired\/\">ICO\u2019s own standard<\/a> requires this to be genuinely meaningful, not a rubber stamp, more on exactly what that means below.<\/li>\n<li><strong>Transparency requirements. <\/strong>Employees should be told when and how AI played a role in a decision affecting them, before they have to ask.<\/li>\n<li><strong>A dedicated escalation path. <\/strong>AI-influenced disputes shouldn\u2019t get stuck in a generic process that was never built to handle them.<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">None of this needs to be complicated. It needs to be specific enough that someone can actually follow it when a grievance arrives, rather than improvising.<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong>Building the Human Review Point Into the Process, Not After It<\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">This is the single most repeated failure across everything we\u2019ve covered in this series: <strong>human review reconstructed after a complaint, rather than documented at the time the decision was made.<\/strong><\/p>\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/ico.org.uk\/about-the-ico\/what-we-do\/recruitment-rewired\/\">ICO\u2019s own standard<\/a> is specific about what \u201cmeaningful\u201d review actually requires. It has to involve someone with <strong>genuine authority, discretion, and competence to change the outcome<\/strong>, not a person glancing at an AI-generated recommendation and approving it by default. A human who technically looked at the decision but couldn\u2019t realistically have overturned it doesn\u2019t meet that bar, even if a box was ticked somewhere.<\/p>\n<p class=\"wp-block-paragraph\">The practical fix is to build the record into the decision workflow itself, not to reconstruct it later. Whoever makes or approves an AI-influenced decision should note, at that moment, what they reviewed and why they agreed with it. That single habit is what turns \u201cwe\u2019re confident a human was involved\u201d into something an employer can actually demonstrate if a grievance or a tribunal claim asks the question.<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong><strong><strong><strong><strong>Handling AI-Assisted Grievances Within the Same Policy<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">An AI-assisted grievance doesn\u2019t need its own separate track. It needs the same investigation standard applied with a bit more discipline in how it\u2019s read.<\/p>\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.kingsleynapley.co.uk\/our-insights\/articles\/grievances-written-by-a-bot-navigating-ai-drafted-complaints-in-the-workplace\/\">Kingsley Napley\u2019s guidance<\/a> is useful here: <strong>start with an initial meeting to scope out what\u2019s actually being raised<\/strong> before launching a full investigation. Where a grievance bundles multiple allegations together, as AI-drafted ones often do, categorise them separately rather than treating the document as one undifferentiated complaint. Neither step requires new policy language, just a consistent first move.<\/p>\n<p class=\"wp-block-paragraph\">What the policy shouldn\u2019t do is let length or formality change the standard. The <a href=\"https:\/\/www.acas.org.uk\/acas-code-of-practice-on-disciplinary-and-grievance-procedures\">Acas Code<\/a> <strong>does not permit dismissing or truncating a grievance because it\u2019s poorly evidenced or unusually broad<\/strong>. Every allegation that\u2019s reasonably capable of investigation still has to be investigated, whether it arrived in three sentences or three pages.<\/p>\n<p class=\"wp-block-paragraph\"><strong><em>Explore: <\/em><\/strong>Anatomy of an AI-Related Grievance<\/p>\n<p><h2 class=\"uagb-heading-text\"><strong><strong><strong><strong><strong>Rolling the Policy Out: Training and Communication<\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n<\/p>\n<p class=\"wp-block-paragraph\">A policy that exists only in a document nobody\u2019s read doesn\u2019t change what happens when a grievance actually lands.<\/p>\n<p class=\"wp-block-paragraph\">The cost case for getting this right is stark. <a href=\"https:\/\/www.acas.org.uk\/about-us\/acas-consultations\/code-of-practice-disciplinary-grievance-2026\">Acas\u2019s own research<\/a> found:<\/p>\n<ul class=\"wp-block-list\">\n<li>Formal disciplinary and grievance procedures cost UK employers an estimated <strong>\u00a32.36 billion a year<\/strong><\/li>\n<li>Informal resolution costs roughly <strong>\u00a3250 million<\/strong>, about a tenth as much<\/li>\n<li><strong>44% of working-age adults<\/strong> in Great Britain reported experiencing conflict at work in the past year<\/li>\n<\/ul>\n<p class=\"wp-block-paragraph\">Training that helps a grievance get resolved earlier, or handled correctly the first time, isn\u2019t a soft investment, it\u2019s the cheaper path by a wide margin.<\/p>\n<p class=\"wp-block-paragraph\">Acas\u2019s own draft update to the Code reflects this, encouraging employers to provide training as good practice specifically to build the skills and confidence needed for early, effective resolution. For AI-related grievances specifically, that training needs to cover two distinct things: <strong>how to explain an AI-influenced decision when asked<\/strong>, and <strong>how to read past an AI-assisted grievance\u2019s formatting<\/strong> to find the actual complaint underneath.<\/p>\n<p class=\"wp-block-paragraph\">None of this needs to be elaborate.
