But can an SHRC actually take on a private employer? Telangana State Human Rights Commission [<\/span><\/span><\/em><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>Writ Petition Nos. <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>36488 and 36486 of 2025<\/span><\/span><\/strong><em style=\"font-style:italic\"><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>]<\/span><\/span><\/em><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>, a Division Bench of Chief Justice Aparesh Kumar Singh and Justice Ghouse Meera Mohiuddin quashed proceedings pending before the Commission, holding that an SHRC has <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>no jurisdiction over a purely private employer<\/span><\/span><\/strong><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span> \u2014 unless a public servant is implicated. This piece breaks down the ruling, the statutory reasoning behind it, and what it means in practice.<\/span><\/span><\/span><\/p>\n<\/div>\n<p><h3 class=\"NHUsU nj4cA JP8V2 QncKy\" dir=\"auto\" id=\"viewer-ci9uq13\" tabindex=\"-1\"><span aria-hidden=\"true\" id=\"the-case-background-ci9uq13\"\/><span class=\"GIaiz\"><span>The Case Background<\/span><\/span><\/h3>\n<\/p>\n<div data-breakout=\"normal\">\n<p class=\"_8C1-J ZH-gN JP8V2 QncKy\" dir=\"auto\" id=\"viewer-osn6a15\" tabindex=\"-1\"><span class=\"fujJq\"><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>An employee approached the Telangana SHRC with complaints against her employer, alleging, among other grievances, that she had suffered a <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>miscarriage due to workplace stress<\/span><\/span><\/strong><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>. The Commission took up the matter. Wells Fargo challenged its authority to do so through two writ petitions before the High Court.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"_8C1-J ZH-gN JP8V2 QncKy\" dir=\"auto\" id=\"viewer-th4kg38859\" tabindex=\"-1\"><span class=\"fujJq\"><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>The single question the Court had to answer: <\/span><\/span><strong style=\"font-weight:700\"><em style=\"font-style:italic\"><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>Does an SHRC have the power to inquire into alleged human rights violations by a private company and its managers?<\/span><\/span><\/em><\/strong><\/span><\/p>\n<\/div>\n<p><h3 class=\"NHUsU nj4cA JP8V2 QncKy\" dir=\"auto\" id=\"viewer-n0gvw27\" tabindex=\"-1\"><span aria-hidden=\"true\" id=\"the-legal-clarification-n0gvw27\"\/><span class=\"GIaiz\"><span>The Legal Clarification<\/span><\/span><\/h3>\n<\/p>\n<div data-breakout=\"normal\">\n<p class=\"_8C1-J ZH-gN JP8V2 QncKy\" dir=\"auto\" id=\"viewer-8gkwo29\" tabindex=\"-1\"><span class=\"fujJq\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>The High Court quashed the TSHRC&#8217;s order, emphasising that the Commission is a <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>&#8220;creature of statute&#8221;<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0and must operate strictly within the powers granted by the Protection of Human Rights Act, 1993.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"_8C1-J ZH-gN JP8V2 QncKy\" dir=\"auto\" id=\"viewer-ntsnu33\" tabindex=\"-1\"><span class=\"fujJq\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>The court\u2019s analysis centred on <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>Section 12(a) of the Protection of Human Rights Act, 1993 (PHRA), <\/span><\/span><\/strong><span style=\"color:rgb(10, 10, 10);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>which empowers a Commission to inquire into:<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<div class=\"wjXFB\" dir=\"ltr\" id=\"viewer-ujwtj40356\" tabindex=\"-1\">\n<blockquote class=\"pUKwP\"><p><span><\/p>\n<p><span class=\"fujJq\"><em style=\"font-style:italic\"><span style=\"color:rgb(110, 108, 104);background-color:rgb(253, 253, 252);text-decoration:inherit\"><span>&#8220;(i) violation of human rights or abetment thereof; or (ii) negligence in the prevention of such violation, by a public servant \u2026&#8221;<\/span><\/span><\/em><\/span><\/p>\n<p><\/span><\/p><\/blockquote>\n<\/div>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"_8C1-J ZH-gN JP8V2 QncKy\" dir=\"auto\" id=\"viewer-imorr1862\" tabindex=\"-1\"><span class=\"fujJq\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>The crux of the dispute was whether the phrase <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>&#8220;by a public servant&#8221;<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0at the end of sub-clause (ii) also qualifies the &#8220;violation or abetment&#8221; mentioned in sub-clause (i).<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"_8C1-J ZH-gN JP8V2 QncKy\" dir=\"auto\" id=\"viewer-5ex2r44759\" tabindex=\"-1\"><span class=\"fujJq\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>The Human Rights Commission and the respondent (the employee) argued for a <\/span><\/span><strong style=\"font-weight:700\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>&#8220;broad and purposive construction&#8221;<\/span><\/span><\/strong><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>\u00a0or a &#8220;liberal interpretation&#8221; of the Act.\u00a0They contended that (1)  where allegations disclose an infringement of fundamental rights like dignity and equality (especially concerning women), the Commission should have jurisdiction regardless of the private nature of the employer; and (ii) the Act should not be read in an &#8220;unduly technical or restrictive manner&#8221; as its a piece of beneficial legislation.<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p class=\"_8C1-J ZH-gN JP8V2 QncKy\" dir=\"auto\" id=\"viewer-9iujo55805\" tabindex=\"-1\"><span class=\"fujJq\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>However, the Court ruled that:<\/span><\/span><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<ul class=\"_1dfgM JP8V2\">\n<li dir=\"auto\" aria-level=\"1\" class=\"s7izI\" style=\"margin-inline-start:1.5em;list-style-type:disc\">\n<p class=\"_8C1-J ZH-gN JP8V2 QncKy\" dir=\"\" id=\"viewer-yd7zv55809\" tabindex=\"-1\"><span class=\"fujJq\"><span style=\"color:rgb(48, 48, 48);background-color:rgb(255, 255, 255);text-decoration:inherit\"><span>The expression &#8220;by a public servant&#8221;
