\nKailasam, who served on the Supreme Court in the 1970s, once observed that on
\nMondays and Fridays the Court heard roughly 280 Special Leave Petitions (SLPs),
\nand nearly half of them were admitted. Today, the picture is dramatically
\ndifferent. More than 96,000 cases are pending before the Supreme Court of
\nIndia, with some litigants waiting for justice for over three decades.<\/span><\/p>\nIncidentally, Justice
\nKailasam was the father-in-law of senior Congress leader P. Chidambaram and the
\nfather of designated senior advocate Nalini Chidambaram. P Chidambaram also
\nfinds mention in K. K. Venugopal’s recent memoir, An Accidental Lawyer: My
\nAdventures in Law and Life<\/i>. Nonagenarian KK Venugopal is himself a
\nlegendary lawyer. <\/span><\/p>\nIn a written reply to
\nthe Rajya Sabha, Union Law Minister Arjun Ram Meghwal stated the other day that
\nthe Supreme Court has 96,024 pending cases, including 10,094 pending for more
\nthan ten years, 558 pending for over twenty years, and 26 cases that have
\nremained unresolved for more than thirty years. Across the country, the total
\npendency has crossed 5.64 crore cases, highlighting the staggering burden on
\nIndia’s judicial system.<\/span><\/p>\nThe Minister pointed
\nout that case disposal falls within the judiciary’s domain and that delays
\narise from several factors, including the complexity of cases, the availability
\nof evidence, and the cooperation of investigating agencies, witnesses, and litigants.
\nHe also referred to measures such as the \u20b97,210 crore e-Courts Phase III
\nproject and the establishment of Fast Track Special Courts to improve access to
\njustice and reduce pendency.<\/span><\/p>\nWhile these
\ninitiatives deserve appreciation, they do not address the fundamental problem.
\nUnless Artificial Intelligence is integrated extensively into the justice
\ndelivery system, the backlog will continue to grow. Merely increasing the
\nsanctioned strength of judges\u2014from the Supreme Court to the district
\njudiciary\u2014will not produce the transformative results that the country urgently
\nneeds.<\/span><\/p>\nConsider the thousands
\nof cheque dishonour cases under Section 138 of the Negotiable Instruments Act
\nthat continue to clog district courts. Many of these cases involve repetitive
\nfactual issues and standard legal questions, making them ideal candidates for
\nAI-assisted case management. Likewise, the cross-examination of multiple
\nwitnesses, which can often be completed within a day through proper scheduling
\nand technological assistance, routinely stretches over several years because of
\nprocedural delays and inefficient case management.<\/span><\/p>\nIt is perplexing that
\nthe Indian judiciary, from the Supreme Court to the district courts, remains
\nhesitant to embrace Artificial Intelligence on a meaningful scale. AI is not a
\nsubstitute for judges; it is a tool that can significantly enhance judicial efficiency
\nby assisting in research, document analysis, scheduling, transcription,
\ntranslation, precedent identification, drafting, and case management, thereby
\nallowing judges to devote more time to adjudication.<\/span><\/p>\nIndia is home to one
\nof the world’s largest pools of scientific and technological talent. Yet even
\ncomparatively modest reforms, such as the widespread live streaming of court
\nproceedings, have taken years to implement and are still absent in hundreds of
\ncourts. This slow pace of technological adoption reflects an institutional
\nreluctance to embrace innovation.<\/span><\/p>\nResistance to AI often
\nstems from concerns about reliability, accountability, judicial independence,
\nand the possibility of technological errors. While such concerns deserve
\ncareful consideration, they cannot become an excuse for maintaining an outdated
\nsystem that is already overwhelmed by mounting arrears. Proper safeguards,
\nhuman oversight, and phased implementation can address these legitimate
\napprehensions.<\/span><\/p>\nThe judiciary exists
\nto deliver timely justice. When millions of citizens spend years\u2014sometimes
\ndecades\u2014awaiting decisions, incremental reforms are no longer enough.
\nTechnology, particularly Artificial Intelligence, is not a luxury but a
\nnecessity. Nations that embrace technological innovation will strengthen their
\njustice systems; those that resist it risk falling further behind. If India is
\nserious about judicial reform, the large-scale adoption of Artificial
\nIntelligence is no longer a matter of choice\u2014it is an imperative.<\/span><\/p>\n<\/p>\n\u00a0<\/p>\n
