Warren Slams Compass Private Listings Network in Letter to CEO"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">A top Senate Democrat has expressed concerns that brokerage giant Compass Inc.\u2019s <a target=\"_blank\" id=\"https:\/\/www.realtor.com\/news\/real-estate-news\/new-york-private-listings-restrict-s10274-hochul\/\" type=\"link\" href=\"https:\/\/www.realtor.com\/news\/real-estate-news\/new-york-private-listings-restrict-s10274-hochul\/\">private listings network<\/a> could create a &#8220;two-tiered housing market&#8221; that &#8220;increases risks of civil rights violations&#8221; in a letter to the company\u2019s CEO, <a target=\"_blank\" href=\"http:\/\/realtor.com\">Realtor.com\u00ae<\/a> can exclusively reveal.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Sen. <strong>Elizabeth Warren<\/strong> (D-MA), ranking member of the Senate Committee on Banking, Housing and Urban Affairs, on Thursday sent a letter to Compass CEO <strong>Robert Reffkin <\/strong>and <strong>Rebecca Jensen<\/strong>, CEO of Midwest Real Estate Data, requesting information about their recent partnership to create a <a target=\"_blank\" id=\"https:\/\/www.realtor.com\/news\/real-estate-news\/compass-reffkin-private-listings-congressional-probe-earnings-call\/\" type=\"link\" href=\"https:\/\/www.realtor.com\/news\/real-estate-news\/compass-reffkin-private-listings-congressional-probe-earnings-call\/\">national database of private listings<\/a>.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">&#8220;Your partnership threatens to create a two-tiered housing market where insiders pay for exclusive access to housing inventory and market data, while everyone else is shut out,&#8221; Warren wrote in the letter, which was obtained by Realtor.com. &#8220;I am concerned that this move will increase industry consolidation and harm consumers by driving up housing costs and worsening inequalities in the housing market.&#8221;<\/p>\n<p><iframe height=\"230px\" style=\"width:100%;border:0\" src=\"https:\/\/www.realtor.com\/creative\/rdc-ads\/local-listings-widget\/\" loading=\"lazy\" title=\"Embedded widget\"><\/iframe><\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">In April, Compass and MRED, the multiple listing service for the Chicago area, announced a deal to distribute Compass Private Exclusives listings nationwide through the MRED database, which has historically operated only as a regional service. Such private listings are not easily visible to the public online, and are instead primarily marketed to clients within the network.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Warren in her letter raised concerns that the Compass deal with MRED \u201cincreases risks of civil rights violations,\u201d including violations of the Fair Housing Act, which prohibits <a target=\"_blank\" id=\"https:\/\/www.realtor.com\/news\/trends\/pocket-listings-discrimination-fair-housing\/\" type=\"link\" href=\"https:\/\/www.realtor.com\/news\/trends\/pocket-listings-discrimination-fair-housing\/\">discrimination in housing transactions<\/a>.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cI am particularly concerned that the non-public, exclusive nature of private listings may perpetuate housing discrimination through residential steering that is prohibited under the FHAct and other civil rights laws, also making potential discrimination harder to detect,\u201d she wrote, referring to the illegal practice of \u201csteering\u201d homebuyers toward certain neighborhood based on their race or other protected characteristics.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">In the nine-page letter, Warren requested details on how the companies would &#8220;mitigate the potential harms&#8221; of their partnership. The letter asks the CEOs to explain details of the partnership and how the companies analyzed any fair housing or antitrust concerns.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Warren\u2019s request comes just weeks after the top Republican on the House&#8217;s antitrust subcommittee <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/real-estate-news\/congress-judiciary-subcommittee-investigation-compass-mred-antitrust\/\">made a similar request<\/a> and sought a hearing with the companies, making concern over private listings now a rare bipartisan issue in Congress.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">In a statement to Realtor.com, MRED said that it looked forward to dialogue with Warren about the issues raised in her letter.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cIt would be an honor to speak with Senator Warren and explain the important role of the MLS in the Real Estate marketplace,\u201d the statement said. \u201cIssues such as fair housing, data quality, and rules are critical to any MLS. We look forward to discussing MRED&#8217;s value with her.\u201d<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">A Compass spokesperson declined to comment when reached by Realtor.com.\u00a0<\/p>\n<h2 class=\"base__StyledType-rui__sc-18muj27-0 eAPYSB\">Private listings under scrutiny<\/h2>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Compass, the world&#8217;s largest residential real estate broker, has focused its business strategy heavily on private listings, which it calls Private Exclusives. These are homes for sale that are primarily marketed to the company&#8217;s own network of agents and clients, before they are easily visible to the wider public online.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Compass says its Private Exclusives offer sellers more privacy and control over their listings than traditional marketing through multiple listing services, which make listings available to any real estate agent or broker who subscribes. But critics of the practice argue that private listings offer few benefits to sellers, and may hide valuable market information from homebuyers who are not privy to the network.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">In her letter, Warren also argued that private listings \u201chave the potential to obscure key data typically used to negotiate home prices, like the number of days on the market or price change history\u201d\u2014information that is typically required by an MLS, but often absent from a private listing.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cHiding this data could destabilize the broader housing market,\u201d the senator wrote, noting that the mortgage market relies on complete and accurate listing history information to inform appraisals and other aspects of the home purchase process.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Warren also raised concerns about Compass&#8217; acquisition of major rival Anywhere Real Estate last year.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Although the merger sailed through federal antitrust review under the Trump administration, it is currently under investigation for potential violations of antitrust law by the <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/real-estate-news\/compass-merger-antitrust-investigation-new-york\/\">New York State Attorney General\u2019s Office<\/a>, Realtor.com confirmed in June.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Warren in her letter alleged that \u201cthe Trump administration rubber stamped the merger, increasing the ongoing antitrust concerns with Compass\u2019 behavior.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">&#8220;The Compass-MRED partnership threatens to intensify Compass\u2019s market control and reduce<br \/>market transparency, leading to potential violations of antitrust laws and increased housing costs,&#8221; Warren wrote.<\/p>\n<div class=\"Boxstyles__StyledBox-rui__sc-1p1qqov-0 cGIhfE sc-1d9c28t-0 dVWipe\">\n<figure><figcaption class=\"sc-1d9c28t-3 kUNXdc\"><span class=\"image-caption\">Robert Reffkin, chairman and chief executive officer of Compass Inc., center, on the floor the New York Stock Exchange on Feb. 2, 2026<\/span><span class=\"sc-1d9c28t-2 nMMWW image-credit\">Michael Nagle\/Bloomberg via Getty Images<\/span><\/figcaption><\/figure>\n<\/div>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Compass&#8217; <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/trends\/pocket-listings-discrimination-fair-housing\/\">private listings<\/a> partnership with MRED has now drawn bipartisan scrutiny. In a similar letter to the two companies in July, Rep. <strong>Scott Fitzgerald<\/strong> (R-WI), chair of the House Judiciary Subcommittee on the Administrative State, Regulatory Reform, and Antitrust, wrote the partnership may \u201cincentivize brokers to push sellers into private listings.\u201d<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Several states have moved to limit or restrict private listings. <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/realestateandhomes-search\/Washington\">Washington state<\/a> and<a target=\"_blank\" href=\"https:\/\/www.realtor.com\/realestateandhomes-search\/Connecticut\"> Connecticut<\/a> both <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/real-estate-news\/connecticut-private-listings-ban-ned-lamont\/\">signed restrictions<\/a> this year. The <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/realestateandhomes-search\/New-York\">New York<\/a> General Assembly has <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/real-estate-news\/new-york-private-listings-restrict-s10274-hochul\/\">passed a bill<\/a> with similar restrictions, but it has not yet been sent to the governor for her signature.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">In an earnings call on Tuesday night, Reffkin defended the MRED partnership. He called the current system a &#8220;monopoly&#8221; because typically there is only one MLS serving a specific area.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">&#8220;Multiple listing services should have to compete for our business, just as brokerages have to compete for agents and agents have to compete for their clients,&#8221; he said.<\/p>\n<p><iframe height=\"230px\" style=\"width:100%;border:0\" src=\"https:\/\/www.realtor.com\/creative\/rdc-ads\/search-listings-widget\/\" loading=\"lazy\" title=\"Embedded widget\"><\/iframe><\/p>\n<h2 class=\"base__StyledType-rui__sc-18muj27-0 eAPYSB\">Ongoing legal dispute<\/h2>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Shortly after Compass and MRED launched their private listings network, real estate portal Zillow Inc. informed MRED it would not display some of those listings if they were later added to the MLS. In response, MRED <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.globenewswire.com\/news-release\/2026\/05\/20\/3298655\/0\/en\/mred-suspends-listing-data-feeds-to-zillow-group.html\">cut Zillow off<\/a>, saying the company&#8217;s actions violated its license agreements.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">This temporarily took a large number of Chicago-area listings off the Zillow website. Zillow then <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.zillow.com\/news\/zillow-sues-mred-compass\/\">sued<\/a> the two companies alleging antitrust violations, a suit which is still ongoing.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Zillow\u2019s complaint alleges Compass and MRED &#8220;are colluding to hide home listings from buyers\u2014and conspired to punish Zillow for not going along with it.&#8221;<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Compass and MRED deny those claims and are fighting the lawsuit in court.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The Consumer Federation of America and the Urban League in April published <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/consumerfed.org\/news\/reports\/escalating-housing-costs-hidden-listings\/\">a report critical<\/a> of pocket listings. Then, CFA requested the Department of Justice <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/consumerfed.org\/media\/wuvdqjyi\/compass-pocket-listing-fairness.pdf\">investigate the deal<\/a>.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">&#8220;It&#8217;s not good for sellers and it&#8217;s not good for buyers either, because as a seller I want my house seen by as many potential buyers as possible so I get the best possible deal,&#8221; <strong>Sharon Cornelissen<\/strong>, director of housing for CFA, told Realtor.com. &#8220;As a buyer, I might not even find out about houses for sale and that affects my opportunities.&#8221;<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">In 2025, <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.brightmls.com\/about-us\">Bright MLS<\/a>, a multiple listing service covering the mid-Atlantic region, found that <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/trends\/private-exclusive-listings-homes-property-mls\/\">private listings take longer to sell<\/a> and offer no price benefits to the seller.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Zillow <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.zillow.com\/news\/a-review-of-compass-latest-private-listing-claims\/\">found something similar<\/a> in its own research.
