{"id":7026680,"date":"2026-08-04T10:59:29","date_gmt":"2026-08-04T10:59:29","guid":{"rendered":"https:\/\/peraltafinancing.com\/uncategorized\/why-lenders-are-pushing-heirs-out-of-3-mortgage-rates\/"},"modified":"2026-08-04T10:59:29","modified_gmt":"2026-08-04T10:59:29","slug":"why-lenders-are-pushing-heirs-out-of-3-mortgage-rates","status":"publish","type":"post","link":"https:\/\/fivemor.com\/?p=7026680","title":{"rendered":"Why Lenders Are Pushing Heirs Out of 3% Mortgage Rates"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\"><a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/real-estate-summary\/aging-homeowners-poised-to-reshape-housing-market-in-key-cities\/\">As more older Americans age<\/a> with <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/trends\/mortgage-interest-rates-now-july-30-2026\/\">low-rate mortgages <\/a>still attached to their homes, <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/real-estate-news\/heir-wills-estates-new-housing-laws-great-wealth-transfer\/\">some heirs report servicing delays and refinance pressure<\/a> are putting their inheritance at risk.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">After their mother died, one heir said the 2.7% mortgage attached to the house was what made it worth fighting to keep.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cThis is the reason I keep fighting for the house is to keep the payments where they are,\u201d the heir wrote in an anonymized complaint to the <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.consumerfinance.gov\/\">Consumer Financial Protection Bureau<\/a>.<\/p>\n<p><iframe height=\"230px\" style=\"width:100%;border:0\" src=\"https:\/\/www.realtor.com\/creative\/rdc-ads\/local-listings-widget\/\" loading=\"lazy\" title=\"Embedded widget\"><\/iframe><\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">But the mortgage company offered a new loan instead.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cThe only option they offered me was a refinance offer,\u201d the complaint continued, adding that it \u201cwould have doubled the monthly payment and interest.\u201d<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">It\u2019s just one account in more than 200 such complaints involving obstacles to inherited-mortgage assumption or successor recognition, identified by <a target=\"_blank\" href=\"http:\/\/realtor.com\">Realtor.com\u00ae<\/a> in a review of the <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.consumerfinance.gov\/data-research\/consumer-complaints\/\">CFPB complaint database<\/a>. The complaints described denied account access, blocked payments, and repeated documentation demands as balances and foreclosure deadlines inched closer.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The findings <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.consumerfinance.gov\/data-research\/research-reports\/homeowners-face-problems-with-mortgage-companies-after-divorce-or-death-of-a-loved-one\/\">echo a 2024 CFPB review<\/a>, which found a similar pattern of lengthy delays, repeated paperwork, and alleged pressure toward higher-rate refinancing. Together, they capture a growing vulnerability of the Great Wealth Transfer: A family can inherit the house yet lose the financing that made it affordable.<\/p>\n<h2 class=\"base__StyledType-rui__sc-18muj27-0 eAPYSB\">More inheritances will come with low-rate mortgages attached<\/h2>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">An estimated $124 trillion will transfer intergenerationally through 2048, mainly from the Silent Generation and baby boomers, according to a report by <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.cerulli.com\/\">Cerulli Associates<\/a>. Much of that wealth is tied up in housing\u2014<a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/real-estate-summary\/5-key-takeaways-baby-boomers-home-equity\/\">boomers alone hold as much as $19 trillion<\/a> in real estate wealth today. But more than ever, debt is attached to that equity.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The share of homeowners aged 65 to 79 carrying mortgage debt rose from 24% in 1989 to 41% in 2022, according to <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.jchs.harvard.edu\/housing-americas-older-adults-2023\">Harvard University\u2019s Joint Center for Housing Studies<\/a>. Nearly one-third of homeowners 80 and older also had a mortgage.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">And while it may seem like a liability, in today\u2019s interest-rate environment, a low-interest loan is its own asset. Among active borrowers, 61% of baby boomers and 55% of the Silent Generation had rates of 4% or less in January 2024, according to <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.freddiemac.com\/research\/insight\/interest-rate-dispersion-by-generation\">Freddie Mac<\/a>.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Consider a home carrying a $250,000 mortgage at 3%, with 20 years remaining. The existing principal-and-interest payment would be about $1,386 a month. Replacing that mortgage with a 6.66% loan\u2014while holding the balance and remaining repayment period constant\u2014would raise the payment to about $1,888.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">That&#8217;s an additional $502 a month, or more than $6,000 a year.<\/p>\n<h2 class=\"base__StyledType-rui__sc-18muj27-0 eAPYSB\">Inheriting the house does not mean inheriting the loan<\/h2>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Those savings make a low-rate mortgage part of the inheritance, and federal law is meant to prevent the borrower\u2019s death from automatically wiping out that advantage.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.federalreservehistory.org\/essays\/garn-st-germain-act\">Garn-St Germain Act<\/a> generally prevents lenders from invoking a <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/advice\/finance\/due-on-sale-clause-mortgage-contract\/\">due-on-sale clause<\/a> solely because of certain protected transfers, including a transfer to a relative resulting from a borrower\u2019s death. In those cases, the lender cannot demand immediate repayment of the entire balance simply because the property changed hands.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">But protecting the mortgage from immediate repayment is hardly the same as automatically making the heir the borrower on the loan.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cWhen someone inherits a mortgaged home, they generally inherit ownership of the property itself, subject to the existing mortgage,\u201d <strong>Denise D. Nordheimer<\/strong>, an <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.foxrothschild.com\/denise-d-nordheimer\">estate planning and elder-law attorney<\/a> and partner at Fox Rothschild, tells Realtor.com.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cThe heir is not personally liable for the mortgage debt unless they formally assume the loan, but the lender can foreclose if payments are not made,\u201d she adds.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">But that also creates the central vulnerability. The family may need to keep the mortgage current before it has been fully recognized as the party entitled to manage the account.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">The CFPB has said confirmed successors can continue making payments, obtain information about the mortgage, and be evaluated for foreclosure-prevention assistance without first assuming the debt or refinancing. Yet its 2024 review found complaints from successors who said they were unnecessarily pushed toward new loans. <\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">And before an heir can even exercise those federal servicing protections, the family may first have to establish who legally owns the property.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cIn many cases, these heirs do not acquire the property outright at the time of the relative\u2019s death (they require a probate or other process to become the legal heirs and gain the right to the property) and therefore often find themselves falling behind on the financial obligations associated with the asset,\u201d says <strong>Claudia Cobreiro<\/strong>, a Miami-based <a rel=\"noopener noreferrer\" target=\"_blank\" href=\"https:\/\/cobreirolaw.com\/\">attorney and founder of Cobreiro Law<\/a>.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">That may be the biggest risk of all.<\/p>\n<h2 class=\"base__StyledType-rui__sc-18muj27-0 eAPYSB\">Paperwork delays can turn affordable payments into five-figure demands<\/h2>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">As heirs work to establish their right to <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/news\/trends\/inherited-home-worth-total-costs\/\">manage an inherited home<\/a>, mortgage bills keep coming, and each missed payment can push the account further behind.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">One surviving spouse told the CFPB that she worked two jobs and wanted to remain in the home where she had cared for her husband through hospice.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">After his death, though, she said the loan servicer repeatedly asked her to resend a power of attorney, marriage certificate, and death certificate. At the same time, representatives told her that they could not discuss the account with her.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">She wrote that the servicer \u201ckept giving me the runaround,\u201d repeatedly telling her that it could not speak with her because she was not on the mortgage agreement.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">That delay turned the monthly payment she hoped to continue into months of missed payments, added costs, and a much larger sum required to bring the loan current. The widow alleged she was denied mortgage assistance and eventually told that her available option was a one-time payment of approximately $34,000. <\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">She wrote that she was \u201cafraid that by the time my probate hearing comes, [the loan servicer] will already be trying to sell the home.\u201d<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">It&#8217;s a telling illustration of compounding risk. The longer recognition and probate take, the more payments can accumulate. And by the time an heir gains the authority needed to resolve the account, resuming the old monthly payment may no longer be a realistic option.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cFor that reason, it becomes difficult for many of them to reinstate the existing mortgages against the property, and they find themselves needing to refinance or sell to satisfy the outstanding economic obligations,\u201d Cobreiro says.<\/p>\n<h2 class=\"base__StyledType-rui__sc-18muj27-0 eAPYSB\">Estate planning must account for the mortgage<\/h2>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">But families are hardly powerless in this process, and the safest time to protect an inherited mortgage is before the borrower dies.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">To start, families should reconsider what belongs in a <a target=\"_blank\" href=\"https:\/\/www.realtor.com\/advice\/finance\/real-estate-and-your-estate-plan\/\">conventional estate plan<\/a>. While these plans typically determine who should receive the property, they may not address the mortgage attached to it. A plan for a mortgaged home must also establish who intends to keep the property, who will make the payments, and where that person can find the documents needed to prove their authority.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cIf the property is held in a trust, the successor trustee must follow the trust\u2019s terms, and some lenders may require additional documentation or may not recognize the trust as an eligible successor,\u201d she explains.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">An LLC can present a different problem.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cProperties held in LLCs can trigger due-on-sale clauses, as most federal protections for heirs do not apply to entities,\u201d she says.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Even when a home passes directly to individual heirs, authority may be divided.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cWhen multiple heirs inherit a property, disagreements can arise over who will live in the home, who will make payments, or whether to sell,\u201d Nordheimer says.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Those questions become more consequential when a mortgage payment is due before the heirs have reached an agreement.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Before a death, families should also identify the mortgage servicer, outstanding balance, interest rate, monthly payment, and loan number. The person expected to handle the estate should be able to locate the deed, loan statements, will, trust, and other records establishing how the property is owned.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Additionally, the family should also decide who intends to keep the home and who will cover the mortgage, taxes, and insurance while probate or successor recognition is underway.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">After a death, the potential successor should notify the servicer in writing, request the list of documents required for recognition, and retain proof of each submission. That record can become important if documents are lost, requests are repeated, or foreclosure begins before recognition is complete.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">Keeping the loan current is not always sufficient to resolve every legal or servicing issue, but it can preserve time and prevent a manageable monthly payment from becoming a much larger reinstatement demand.<\/p>\n<p class=\"base__StyledType-rui__sc-18muj27-0 IEPPf sc-7dicpk-0 ccZqsH core-paragraph\">\u201cIn the case where the family can keep up with the financial obligations associated with these properties promptly, they are often able to keep the existing mortgages with little to no effort,&#8221; Cobreiro says, and even without formally assuming the existing loans in their own names.<\/p>\n<p><a target=\"_blank\" data-testid=\"text-widget\" class=\"sc-s4khec-0 jknOCu\" href=\"https:\/\/www.realtor.com\/myaccount\/signin?config=NEWS_AND_INSIGHTS_SIGNUP&amp;redirect_url_override=\/myaccount\/profile\/settings\/\"><\/p>\n<div class=\"Herostyles__StyledHero-rui__sc-oinnz5-0 cfoUCN sc-s4khec-1 dNveAM\">\n<div class=\"hero-content\">\n<p class=\"base__StyledType-rui__sc-18muj27-0 fFVyEr\">Get real estate news in your inbox<\/p>\n<p><button class=\"base__StyledButton-rui__sc-7dk5je-1 fzpFdV\" type=\"button\">Sign up now<\/button><\/div>\n<\/div>\n<p><\/a><\/div>\n\n","protected":false},"excerpt":{"rendered":"<p>As more older Americans age with low-rate mortgages still attached to their homes, some heirs report servicing delays and refinance pressure are putting their inheritance at risk.
