Successful
\nCEOs, entrepreneurs and surgeons (among others) can be difficult clients. Their
\nvery success too often leads them to believe they know everything about succeeding
\nin their legal matter. Which usually involves their wanting you to do something
\nentirely different from what you know is the best approach to handling their
\ncase or themselves as witnesses.<\/span><\/p>\n

The
\ntemptation is to say, “Look, I don’t tell you what to do in your field,
\ndon’t tell me what to do in mine.” That may work with some clients, but it’s
\nworth remembering that many powerful individuals harbor an underlying fear of
\nbeing exposed as powerless. It does not advance your work with the client to
\naggravate that fear.<\/span><\/p>\n

Instead,
\nuse the “Yes, and” approach, which basically consists of the
\nfollowing:<\/span><\/p>\n

1.
\n<\/span>Don’t
\nwave aside the client’s arguments. Treat <\/span>your<\/span> client’s
\nanalyses and sugge<\/span>stions
\nwith respect.<\/span>
\n<\/span><\/p>\n

2.
\nT<\/span>hen<\/span>,<\/span> go on to <\/span>recommending\/doing<\/span> whatever
\nyou think is best.\u00a0<\/span><\/p>\n

For
\nexample, “I appreciate that you want me to call Ms. Jones as a live witness,
\nand I think our most successful strategy is to use her declaration.”<\/span><\/p>\n

Notice, it’s
\nnot “I appreciate that you want me to call Ms. Jones as a live witness, but<\/i> I think our most successful strategy
\nis to use her declaration,” nor is it “I think our most successful
\nstrategy is to use her declaration instead.<\/i>”
\nYou make no attempt to defend, rebut or otherwise resist your client’s
\nperspective. You acknowledge it respectfully, and then go ahead with what you
\nbelieve is the best course of action.<\/span><\/p>\n

Such is
\nthe power of “Yes, and.”<\/span><\/p>\n<\/div>\n\n","protected":false},"excerpt":{"rendered":"
