He stated in open court that he had been approached by both parties to<br \/>\nshow them some favour. In my humble opinion, the matter concerns the grant of<br \/>\nbail to a large number of persons lodged in jail.<\/span><\/p>\n<p class=\"isselectedend\"><span style=\"font-size: 20.0pt;\">There was a time when<br \/>\neven the faintest whisper casting doubt on a judge&#8217;s impartiality was enough<br \/>\nfor the judge to recuse himself or herself, without the slightest hesitation. I<br \/>\nvividly remember an incident involving the Presiding Officer of the Industrial<br \/>\nTribunal at Tis Hazari Courts, Delhi. He recused himself from hearing a case on<br \/>\nthe ground that the counsel appearing for the management was a distant relative<br \/>\nof his. I personally told him that I had no objection to his deciding the<br \/>\nmatter, but he politely declined and recused himself, nonetheless.<\/span><\/p>\n<p class=\"isselectedend\"><span style=\"font-size: 20.0pt;\">The Presiding Officer was<br \/>\na retired District Judge from Uttar Pradesh who had been appointed by the Delhi<br \/>\ngovernment to head the Industrial Tribunal. Such conduct by judges inspires<br \/>\nconfidence not only among litigants but also in the minds of the general<br \/>\npublic. It reinforces the fundamental principle that justice must not only be<br \/>\ndone but must also be seen to be done.<\/span><\/p>\n<p class=\"isselectedend\"><span style=\"font-size: 20.0pt;\">The contrast with the<br \/>\npresent day is striking. Increasingly, parties are compelled to seek the<br \/>\nrecusal of judges, often leading to public controversy and allegations against<br \/>\nthe judiciary. The proceedings in certain high-profile cases, including those<br \/>\ninvolving Mr Arvind Kejriwal, illustrate how contentious such issues have<br \/>\nbecome.<\/span><\/p>\n<p class=\"isselectedend\"><span style=\"font-size: 20.0pt;\">There is, of course, a<br \/>\nlegitimate concern that unscrupulous litigants may make baseless allegations<br \/>\nagainst judges who are otherwise fair, honest, and upright, merely to secure a<br \/>\ndifferent Bench. However, where circumstances create a reasonable apprehension<br \/>\nthat a judge&#8217;s impartiality may be questioned\u2014or where the judge himself<br \/>\ndiscloses that attempts have been made by litigants to improperly influence the<br \/>\nproceedings\u2014it is both prudent and appropriate for the judge to step aside.<br \/>\nSuch tactics may succeed only once or twice, but they cannot become a<br \/>\nsubstitute for the judicial process.<\/span><\/p>\n<p><span style=\"font-size: 20.0pt;\">In the present case, the Allahabad High Court<br \/>\njudge has adopted the most appreciable course. Had he proceeded to hear the<br \/>\nmatter, whichever side lost would almost certainly have questioned the fairness<br \/>\nof the outcome.
