Below is a high\u2011level overview of HB 1207 \/ SB 2, which establishes Paid Family and Medical Leave, and HB 5 \/ SB 199, a pending bill that would expand paid sick leave.<\/span><\/p>\n<h2>HB 1207 \/ SB 2 \u2013 Virginia Paid Family Medical Leave (PFML)<\/h2>\n<p><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">HB 1207 \/ SB 2, which was enacted and signed into law on <\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">April 22, 2026<\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">, establishes Virginia\u2019s first statewide Paid Family and Medical Leave (PFML) insurance program. Once fully implemented, the program will allow eligible individuals to receive partial wage replacement when taking time away from work for certain qualifying reasons. An employee is a covered individual if they meet a minimum monetary eligibility requirement based on wages earned, using the same framework applied for Virginia unemployment insurance. Eligibility is not based on a minimum length of employment or hours worked with a specific employer. Self\u2011employed individuals may also elect coverage if they meet the applicable requirements. The Virginia Employment Commission (VEC) will further define and administer eligibility as it builds the program by January 1, 2028.<\/span><\/p>\n<h5>Covered Reasons for Leave<\/h5>\n<p><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Paid leave may be taken for the following qualifying events:<\/span><\/p>\n<ul>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">The birth, adoption, or foster care placement of a child<\/span><\/li>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Caring for a family member with a serious health condition<\/span><\/li>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">The employee\u2019s own serious health condition<\/span><\/li>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Caring for a covered service member<\/span><\/li>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">A qualifying exigency related to a family member\u2019s military service<\/span><\/li>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Seeking safety services related to domestic violence, harassment, sexual assault, or stalking<\/span><\/li>\n<\/ul>\n<h5>Key Features of the Virginia PFML<\/h5>\n<p><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Benefit Amount: <\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">80% of an individual\u2019s average weekly wages, subject to a maximum tied to the state average weekly wage. The statewide average weekly wage will be updated each year.<\/span><\/p>\n<p><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Duration:<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> Up to 12 weeks of paid leave per year. Limited to 4 weeks for safety services reasons.<\/span><\/p>\n<p><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\" style=\"color: #58595b;\"><strong>Program Funding:<\/strong> <\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">PFML is funded through payroll contributions from employers and employees.<\/span><\/p>\n<ol>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Employers with more than 10 employees remit both the employer and employee portions of the contribution, with up to 50% of the total contribution permitted to be deducted from employee wages.<\/span><\/li>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Employers with 10 or fewer employees are exempt from the employer portion and remit employee\u2011only contributions.<\/span><\/li>\n<\/ol>\n<p><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Leave may be taken on an intermittent basis and will run at the same time as federal FMLA leave when applicable. Employees who have been employed for at least 120 days are entitled to return to the same or an equivalent position following PFML leave. Employers must continue group health coverage during any covered leave, and employees must continue paying their share of the cost.<\/span><\/strong><\/p>\n<h5>Implementation Timeline for PFML<\/h5>\n<ol>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"><strong>January 1, 2028:<\/strong> VEC formally establishes and begins administering the PFML program.<\/span><\/li>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"><strong>April 1, 2028:<\/strong> Payroll contributions begin for covered employers and employees.<\/span><\/li>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"><strong>December 1, 2028:<\/strong> PFML benefits become payable to eligible individuals.<\/span><\/li>\n<\/ol>\n<h5>Private Plan Option for PFML<\/h5>\n<p><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Employers may apply for approval of a private plan exemption if they offer paid leave benefits that are equal to or greater than those provided under the state program. Private plans may be offered on either a fully insured or self\u2011funded basis, subject to approval by the Virginia Employment Commission.<\/span><\/p>\n<h2>HB 5 \/ SB 199 Expanded Paid Sick Leave<\/h2>\n<p><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">HB 5 \/ SB 199, which was enacted and signed into law <\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">May 20, 2026<\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">, expands paid sick leave requirements for private employers across Virginia, with phased implementation based on employer size.<\/span><\/p>\n<h5>Key Features of Expanded Paid Sick Leave<\/h5>\n<p><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Employer Coverage:<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> All private employers, with phased effective dates:<\/span><\/p>\n<ol>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"><strong>July 1, 2027:<\/strong> <\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">50+ employees<\/span><\/li>\n<li><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">January 1, 2028:<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> 25+ employees<\/span><\/li>\n<li><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">January 1, 2029: <\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">1+ employees<\/span><\/li>\n<\/ol>\n<p><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Employee Eligibility: <\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">All Virginia\u2011based employees, including part\u2011time and exempt employees.<\/span><\/p>\n<p><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Accrual &amp; Use: <\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">One hour of paid sick leave for every 30 hours worked, up to 40 hours per year. Employers may frontload 40 hours annually and cap use at 40 hours per year. Unused accrued time must carry over year to year.<\/span><\/p>\n<p><strong>Permitted Uses:<\/strong><\/p>\n<ol>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">The employee\u2019s own medical needs<\/span><\/li>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Care for a family member<\/span><\/li>\n<li><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Leave related to domestic violence, sexual assault, or stalking<\/span><\/li>\n<\/ol>\n<h5>What to Watch<\/h5>\n<p class=\"cvGsUA direction-ltr align-start para-style-body\"><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Many aspects of Virginia\u2019s paid leave laws, particularly the Paid Family and Medical Leave program under HB 1207 \/ SB 2, will continue to be clarified through future regulations and agency guidance prior to implementation.
