The legal battle over the government\u2019s decision to ban Palestine Action as a\u00a0terrorist organisation looks set to head to the UK<\/span>\u2019s highest court after the Supreme Court\u00a0<\/span>granted the group permission<\/span><\/a> to appeal.<\/span><\/p>\n The direct action group\u2019s co-founder, Huda Ammori, will challenge a\u00a0Court of Appeal ruling that upheld the proscription of Palestine Action, setting up a\u00a0final legal battle with the Home Office later this autumn.<\/span><\/p>\n Palestine Action was banned under terrorism laws in July 2025<\/span> after activists broke into RAF<\/span> Brize Norton and damaged military aircraft in protest against Israel\u2019s war \u2013 which\u00a0<\/span>has been deemed a\u00a0genocide<\/span><\/a> by the United Nations and several leading scholars and human rights groups \u2013 in Gaza. Since the ban came into force, belonging to or expressing support for Palestine Action has become a\u00a0criminal offence carrying a\u00a0maximum prison sentence of 14<\/span>\u00a0years.<\/span><\/p>\n Last month, the Court of Appeal ruled in favour of the government, finding that then home secretary Yvette Cooper had acted lawfully in proscribing the group. Delivering the judgment, Lady Chief Justice Baroness Carr said the decision represented a \u200b\u201c<\/span>justified and proportionate interference with individual rights\u201d.<\/span><\/p>\n The Supreme Court\u2019s decision does not overturn the ban, but means its legality will now be examined by the UK<\/span>\u2019s highest court for the first time. A\u00a0hearing is expected in the final months of this\u00a0year.<\/span><\/p>\n It marks the latest chapter in a\u00a0lengthy legal challenge. Earlier this year, the High Court found that the\u00a0<\/span>proscription was unlawful<\/span><\/a>, concluding that only a\u00a0limited number of Palestine Action\u2019s activities could be characterised as terrorism and questioning whether the threshold for banning the group had been met. That judgement was later reversed by the Court of Appeal.<\/span><\/p>\n The appeal comes as police continue to enforce the ban. On Thursday, the Metropolitan Police\u00a0<\/span>arrested<\/span><\/a> 77<\/span> people at a\u00a0demonstration outside Westminster Magistrates\u2019 Court, where hundreds had gathered in support of Palestine Action.<\/span><\/p>\n Responding to the decision, Ammori said the arrests outside the court highlighted what she describes as a\u00a0widening crackdown on expressions of solidarity with Palestinians.\u00a0<\/span><\/p>\n \u201c<\/span>We will continue to fight this proscription all the way to the Supreme Court and, if necessary, to the European Court of Human Rights,\u201d she says, describing the ban as \u200b\u201c<\/span>one of the most extreme attacks on free speech and the right to protest in modern British history\u201d.<\/span><\/p>\n Ella Glossop is Huck\u2019s social editor.
