Slaughter<\/em><\/a>, 609 U.S. ___ (2026), the U.S. Supreme Court held that the Federal Trade Commission\u2019s (FCC) for-cause removal provision violates the separation of powers enshrined in the Constitution. In so ruling, the majority expressly overruled its 1935 decision in\u00a0<em>Humphrey\u2019s Executor v. United States<\/em>,\u00a0which had served as a restraint on presidential power.<\/p>\n<h2 class=\"wp-block-heading\">Facts of the Case<\/h2>\n<p class=\"wp-block-paragraph\">The FTC consists of five Commissioners, no more than three of whom may come from any one political party. Each commissioner is appointed by the president and confirmed by the Senate. Commissioners serve for seven years and may be removed by the President only \u201cfor inefficiency, neglect of duty, or malfeasance in office.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Soon after President Trump began his second term in January 2025, he fired the FTC\u2019s two Democratic appointees, Rebecca Slaughter and Alvaro Bedoya. He did not identify a cause under the statute. He instead told them their \u201ccontinued service on the FTC [was] inconsistent with [his] Administration\u2019s priorities\u201d and that they were removed \u201cpursuant to [his] authority under Article II of the Constitution.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Slaughter subsequently filed suit against the President and other executive officials, seeking relief to restore her to office. She argued that her removal was ultra vires, violated the Administrative Procedure Act, and violated the Constitution. The District Court granted Slaughter\u2019s motion for summary judgment. It acknowledged that <em>Myers <\/em>v. <em>United States<\/em>, 272 U.S. 52, generally permits the President to remove executive officers at will, but explained that <em>Humphrey\u2019s Executor <\/em>carved out an exception for the FTC. The court declared the President\u2019s \u201cpurported removal\u201d ultra vires and issued a permanent injunction barring interference \u201cwith Ms. Slaughter\u2019s right to perform her lawful duties.\u201d<\/p>\n<p class=\"wp-block-paragraph\">A divided Court of Appeals denied the Government\u2019s motion for a stay pending appeal. Thereafter, the Supreme Court stayed the District Court\u2019s order and granted certiorari before judgment.<\/p>\n<h2 class=\"wp-block-heading\">Majority Decision<\/h2>\n<p class=\"wp-block-paragraph\">The Supreme Court reversed by a vote of 6-3, holding that FTC\u2019s for-cause removal provision violates the separation of powers.\u00a0Chief Justice <a href=\"https:\/\/constitutionallawreporter.com\/chief-supreme-court-justices\/john-roberts\/\" target=\"_blank\" rel=\"noreferrer noopener\">John Roberts<\/a> wrote on behalf of the majority, which included Justices <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/clarence-thomas\/\" target=\"_blank\" rel=\"noreferrer noopener\">Thomas<\/a>, <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/samuel-alito\/\" target=\"_blank\" rel=\"noreferrer noopener\">Alito<\/a>, <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/neil-gorsuch\/\" target=\"_blank\" rel=\"noreferrer noopener\">Gorsuch<\/a>, <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/brett-m-kavanaugh\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kavanaugh<\/a>, and <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/amy-coney-barrett\/\" target=\"_blank\" rel=\"noreferrer noopener\">Barrett<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">In reaching its decision, the majority relied heavily on the text, structure, and history of Article II. Chief Justice Roberts emphasized that Article II intentionally established a \u201cunity\u201d of executive power in a single person\u2014the President. He went on to explain that the power to remove at will was a necessary corollary of the Constitution\u2019s design.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe President must have the assistance of officers he can trust. Although it is up to the Senate to decide whether to confirm those with whom the President would<em>prefer<\/em>to work, neither Congress nor the courts may saddle him with those with whom he<em>cannot<\/em>work,\u201d Roberts wrote. \u201cSubordinates who exercise the President\u2019s power are subject to removal by him. Then, and only then, can they remain accountable to the President, and the President to the people.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court also addressed <em>Humphrey\u2019s Executor, <\/em>which had previously upheld the statute. \u201cIf anything more<em>is <\/em>left of<em>Humphrey<\/em>\u2018s,\u201d it is overruled, Chief Justice Roberts declared. According to the majority, <em>Humphrey\u2019s<\/em>\u201cconclusion that the FTC did not exercise executive power has not withstood the test of time.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The Court went on to find that because the FTC exercises significant executive authority, the FTC\u2019s for-cause removal provision violates the separation of powers. In support, it cited that the FTC enforces and administers some 80 statutes covering \u201calmost every facet of the Nation\u2019s economy,\u201d has the power to promulgate substantive rules carrying the force of law, investigates businesses and enforce statutes through in-house adjudications, and files civil suits on behalf of the United States in federal court. \u201cThe FTC unquestionably exercises executive power and must therefore be controlled by the Chief Executive,\u201d Chief Justice Roberts wrote.<\/p>\n<p class=\"wp-block-paragraph\">Finally, the Court emphasized what it was <em>not<\/em> deciding. Notably, Chief Justice Roberts stated that it was not deciding thepermissibility ofstatutory removal protectionfor other officials, including members of the Federal Reserve. <\/p>\n<h2 class=\"wp-block-heading\">Dissent<\/h2>\n<p class=\"wp-block-paragraph\">Justice <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/sonia-sotomayor\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sonia Sotomayor<\/a> authored a lengthy dissent, which was joined by Justices <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/elena-kagan\/\" target=\"_blank\" rel=\"noreferrer noopener\">Elena Kagan<\/a> and <a href=\"https:\/\/constitutionallawreporter.com\/current-supreme-court-justices\/ketanji-brown-jackson\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ketanji Brown Jackson<\/a>.\u00a0\u201cToday, the Court discards that democratic regime in favor of one that distorts the structure of Government to fit the majority\u2019s theory of unitary, total executive control. The result is a President who emerges with far greater power than ever before,\u201d she wrote. \u201cIt is a power, however, that neither the People, nor Congress, nor the Constitution bestowed upon him. In granting the President this unbridled authority, the Court upends its precedent, misconstrues our history, and sheds any pretense of judicial modesty.
