Is there a specific provision<br \/>\nwhich applies to such a circumstance? In what context does the exercise<br \/>\nbecome relevant? To address these and such questions, one must look to Section<br \/>\n13 of the Evidence Act, 1872, which is reproduced below:<\/span><\/p>\n<p>\n<span style=\"font-family: inherit;\"><i style=\"text-indent: 0.25in;\"><br \/><\/i><br \/>\n<i style=\"text-indent: 0.25in;\"><span style=\"color: #323232;\">13. Facts relevant when right or custom is in<br \/>\nquestion<\/span><\/i><\/span><\/p>\n<div class=\"MsoNormal\" style=\"line-height: normal; margin-bottom: .0001pt; margin-bottom: 0in; margin-left: .25in; margin-right: 0in; margin-top: 0in; text-align: justify;\">\n<span style=\"font-family: inherit;\"><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: #323232;\">Where the question is as to the<br \/>\nexistence of any right or custom, the following facts are relevant.<\/span><\/i><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: black;\"\/><\/i><\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal; margin-bottom: .0001pt; margin-bottom: 0in; margin-left: .25in; margin-right: 0in; margin-top: 0in; text-align: justify;\">\n<span style=\"font-family: inherit;\"><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: #323232;\">(a) Any transaction by which the right<br \/>\nor custom in question was created, claimed, modified, recognized, asserted, or<br \/>\ndenied, or which was inconsistent with its existence;<\/span><\/i><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: black;\"\/><\/i><\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal; margin-bottom: .0001pt; margin-bottom: 0in; margin-left: .25in; margin-right: 0in; margin-top: 0in; text-align: justify;\">\n<span style=\"font-family: inherit;\"><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: #323232;\">(b) Particular instances in which the<br \/>\nright or custom was claimed, recognized, or exercised, or in which its exercise<br \/>\nwas disputed, asserted or departed from.<\/span><\/i><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: black;\"\/><\/i><\/span><\/div>\n<div class=\"MsoNormal\" style=\"line-height: normal; margin-bottom: .0001pt; margin-bottom: 0in; margin-left: .25in; margin-right: 0in; margin-top: 0in; text-align: justify;\">\n<span style=\"font-family: inherit;\"><span style=\"font-family: &quot;times&quot; , &quot;times new roman&quot; , serif;\"><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: #323232;\"><br \/><\/span><\/i><\/span><br \/>\n<span style=\"font-family: &quot;times&quot; , &quot;times new roman&quot; , serif;\"><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: #323232;\">The question is, whether A has a right<br \/>\nto a fishery. A deed conferring the fishery on A\u2019s ancestors, a mortgage of the<br \/>\nfishery by A\u2019s father, a subsequent grant of the fishery by A\u2019s father,<br \/>\nirreconcilable with the mortgage, instances in which A\u2019s father exercised the<br \/>\nright, or in which the exercise of the right was stopped by A\u2019s neighbors, are<br \/>\nrelevant facts.<\/span><\/i><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: black;\"\/><\/i><\/span><\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: .25in; text-align: justify;\">\n<span lang=\"EN-IN\" style=\"line-height: 107%;\"><span style=\"font-family: inherit;\">Does the provision apply to <i style=\"mso-bidi-font-style: normal;\">inter partes <\/i><span style=\"mso-bidi-font-style: normal;\">proceedings\/<\/span><i style=\"mso-bidi-font-style: normal;\">in<\/i> <i style=\"mso-bidi-font-style: normal;\">personam <\/i>rights, or<br \/>\ndoes it apply only to rights which have a public or a <i style=\"mso-bidi-font-style: normal;\">quasi<\/i>-public character? What would qualify as a \u201ctransaction\u201d<br \/>\nwithin the meaning of Clause (a)? Would a judgement, wherein the right or custom<br \/>\nwas discussed, qualify as a transaction? Or would <span style=\"mso-spacerun: yes;\">\u00a0<\/span><span style=\"mso-spacerun: yes;\">\u00a0<\/span>the<br \/>\njudgement, or the legal proceeding where the judgement was delivered, qualify<br \/>\nas an \u201cinstance\u201d within the meaning of Clause (b)? <\/span><\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: .25in; text-align: justify;\">\n<span lang=\"EN-IN\" style=\"line-height: 107%;\"><span style=\"font-family: inherit;\">One of the earliest judgements on the provision<br \/>\nwas delivered by a Full Bench of the Calcutta High Court in 1880 in <i style=\"mso-bidi-font-style: normal;\"><span style=\"background: white; color: black;\"><a href=\"https:\/\/indiankanoon.org\/doc\/1743815\/\">Fatten<br \/>\nLall vs Gujju Lall<\/a><\/span><\/i><span style=\"background: white; color: black;\">. Compared to other statutes, given that the analysis<br \/>\nof judgements relating to the Evidence Act is even more guided by the facts of<br \/>\nthe cases they were delivered in, it becomes important to understand the backdrop<br \/>\nin which the judgement was delivered. <\/span><\/span><\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: .25in; text-align: justify;\">\n<span lang=\"EN-IN\" style=\"background: white; color: black; line-height: 107%;\"><span style=\"font-family: inherit;\">In the judgement under discussion, a person X sued Y with respect to title over an immoveable property P and<br \/>\nthe issue of X\u2019s succession from another person Z had a bearing on X\u2019s right<br \/>\nwith respect to the property. In a previous proceeding initiated by Y against<br \/>\nQ, it was established that X was indeed a successor of Z. Consequently, X<br \/>\nwanted to place reliance on the judgement delivered in the previous proceeding<br \/>\n(\u201cearlier judgement\u201d) in his current suit against Y on the ground that the said<br \/>\njudgement was a \u201ctransaction\u201d within the meaning of Section 13, and was<br \/>\ntherefore admissible. Y objected to the reliance on the judgement on the ground<br \/>\nthat it was inadmissible in evidence in X\u2019s suit against Y since X was not<br \/>\nparty to the previous proceeding.<\/span><\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: .25in; text-align: justify;\">\n<span lang=\"EN-IN\" style=\"background: white; color: black; line-height: 107%;\"><span style=\"font-family: inherit;\">By 4-1 majority, the Bench held that the previous judgement was<br \/>\ninadmissible in evidence. While the entire judgement makes for an extremely<br \/>\nenlightening read on Sections 11, 13, 32, 40-43 and 48 of the Evidence Act, the<br \/>\nquality of analysis in the minority and majority opinions is a treat for litigators.<br \/>\n<span style=\"mso-spacerun: yes;\">\u00a0<\/span><\/span><\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: .25in; text-align: justify;\">\n<span style=\"font-family: inherit;\"><span lang=\"EN-IN\" style=\"background: white; color: black; line-height: 107%;\">The minority opinion of Justice Mitter discussed the possibility of pegging<br \/>\nthe earlier judgement under Sections 40-42 of the Evidence Act, which deal with<br \/>\nrelevancy of judgements, orders or decrees of Court, and concluded that the<br \/>\nearlier judgement while not attracting Sections 40-42, would certainly attract<br \/>\nthe window provided under Section 43. Section 43 provides that <\/span><span lang=\"EN-IN\" style=\"background: white; color: black; line-height: 107%;\">&#8220;<i>judgments,<br \/>\norders, or decree, other than those mentioned in\u00a0<\/i><\/span><i><span lang=\"EN-IN\" style=\"background: white; line-height: 107%;\">Sections 40<span style=\"color: black;\">,\u00a0<\/span><\/span>41<span style=\"color: black;\">, and\u00a0<\/span>42<\/i><span style=\"color: black;\"><i>, are irrelevant, unless the fact that such a judgment,<br \/>\norder, or decree existed is relevant<\/i> <b style=\"mso-bidi-font-weight: normal;\"><i style=\"mso-bidi-font-style: normal;\">under some other provision of this Act<\/i><\/b>.<\/span><br \/>\nHe, therefore, concluded that the earlier judgement was relevant under Sections<br \/>\n11 and 13 of the Act. <\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: .25in; text-align: justify;\">\n<span lang=\"EN-IN\" style=\"background: white; color: black; line-height: 107%;\"><span style=\"font-family: inherit;\">According to<br \/>\nJustice Mitter, the word transaction was wide enough to take within its ambit<br \/>\nan earlier judgement and since there was no restriction on the nature of right<br \/>\nor custom referred to in Section 13, it included even <i style=\"mso-bidi-font-style: normal;\">in personam <\/i>rights. He further added that the existence of the<br \/>\nearlier judgement was itself a relevant fact within the meaning of Section 11<br \/>\nsince its existence would affect the fact in issue in the current suit. The<br \/>\nfact that X was not a party to the earlier judgement did not affect its admissibility<br \/>\nunder Section 13, according to Justice Mitter. Also, he was of the<br \/>\nview that the Indian Evidence Act did not necessarily mirror the English law of evidence in<br \/>\nevery way.<\/span><\/span><\/div>\n<div class=\"MsoNormal\" style=\"margin-left: .25in; text-align: justify;\">\n<span lang=\"EN-IN\" style=\"line-height: 107%;\"><span style=\"font-family: inherit;\">On these, the majority opinions disagreed with Justice<br \/>\nMitter. One of the majority opinions observed that Section 13 did not relate to<br \/>\nthe issue of ownership of property, but was limited in its application to<br \/>\nincorporeal rights, and that a judgement was not a transaction in any sense of<br \/>\nthe word. As regards the applicability of Section 11, it was held that while the<br \/>\nexistence of the earlier judgement could be treated as a fact, the judgement in itself was not a fact but an opinion and therefore did not attract Section 11. The<br \/>\nsubstance of the majority opinion is, perhaps, best expressed in the words of the<br \/>\nthen Chief Justice who was part of the Bench:<\/span><\/span><\/div>\n<div style=\"margin-left: .25in; text-align: justify;\">\n<span style=\"color: black;\"><span style=\"font-family: inherit;\">\u201c<i style=\"mso-bidi-font-style: normal;\">73. I suppose<br \/>\nit must be generally acknowledged, that, with some few exceptions, the\u00a0Indian<br \/>\nEvidence Act\u00a0was intended to, and did in fact, consolidate the English law<br \/>\nof evidence.<\/i><\/span><\/span><\/div>\n<div id=\"p_84\" style=\"-webkit-text-stroke-width: 0px; font-variant-caps: normal; font-variant-ligatures: normal; margin-left: .25in; orphans: 2; text-align: justify; text-decoration-color: initial; text-decoration-style: initial; widows: 2; word-spacing: 0px;\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"color: black;\"><span style=\"font-family: inherit;\">74. The different<br \/>\nchapters of the Act deal seriatim with the relevancy and consequent<br \/>\nadmissibility of the different kinds of evidence, and upon this principle,\u00a0Sections<br \/>\n5\u00a0to\u00a016\u00a0deal with the admissibility of facts, whilst\u00a0Sections<br \/>\n40\u00a0to\u00a045\u00a0deal expressly with judgments; and I cannot help<br \/>\nthinking, with all deference to the opinions of those learned Judges who have<br \/>\nexpressed a contrary opinion, that if it had been really the intention of the<br \/>\nLegislature to depart entirely from the English rule, and to make a very large<br \/>\nclass of judgments admissible here, which had never been admissible before the<br \/>\nAct, either in England or in this country, they would have expressed their<br \/>\nintention more plainly, by means of suitable provisions introduced into that<br \/>\nportion of the Act which deals exclusively with judgments.<\/span><\/span><\/i><\/div>\n<div id=\"p_85\" style=\"-webkit-text-stroke-width: 0px; font-variant-caps: normal; font-variant-ligatures: normal; margin-left: .25in; orphans: 2; text-align: justify; text-decoration-color: initial; text-decoration-style: initial; widows: 2; word-spacing: 0px;\">\n<span style=\"font-family: inherit;\"><b style=\"mso-bidi-font-weight: normal;\"><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: black;\">75. If there is one rule of law which is better known and approved<br \/>\nthan another, as being founded upon the most manifest justice and good sense,<br \/>\nit is this; that (except in the case of judgments in rem and judgments relating<br \/>\nto matters of a public nature, which are governed by a different principle) no<br \/>\nman ought to be bound by the decision of a Court of Justice, unless he or those<br \/>\nunder whom he claims were parties to the proceedings in which it was given<\/span><\/i><\/b><i style=\"mso-bidi-font-style: normal;\"><span style=\"color: black;\">.\u201d<\/span><\/i><\/span><\/div>\n<div style=\"margin-left: .25in; text-align: justify;\">\n<span style=\"color: black;\"><span style=\"font-family: inherit;\">On the intent and purpose of Sections 40-43, following<br \/>\nwere the findings of the Chief Justice:<\/span><\/span><\/div>\n<div style=\"margin-left: .25in; text-align: justify;\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"font-family: inherit;\"><span style=\"color: black;\">\u201c81<b style=\"mso-bidi-font-weight: normal;\">.\u00a0<a href=\"https:\/\/indiankanoon.org\/doc\/103053\/\" id=\"a_128\" style=\"-webkit-text-stroke-width: 0px; font-variant-caps: normal; font-variant-ligatures: normal; orphans: 2; widows: 2; word-spacing: 0px;\"\/><\/b><\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: black;\">Section 40<\/span><span style=\"-webkit-text-stroke-width: 0px; float: none; font-variant-caps: normal; font-variant-ligatures: normal; orphans: 2; text-decoration-color: initial; text-decoration-style: initial; widows: 2; word-spacing: 0px;\">, in my opinion, admits as evidence all judgments inter<br \/>\npartes which would operate as res judicata in a second suit.\u00a0<\/span><span style=\"color: black;\">Section 41<\/span><span style=\"-webkit-text-stroke-width: 0px; float: none; font-variant-caps: normal; font-variant-ligatures: normal; orphans: 2; text-decoration-color: initial; text-decoration-style: initial; widows: 2; word-spacing: 0px;\">\u00a0admits judgments in rem as evidence in all subsequent<br \/>\nsuits where the existence of the right is in issue, whether between the same<br \/>\nparties or not. And\u00a0<\/span><span style=\"color: black;\">Section 42<\/span><span style=\"-webkit-text-stroke-width: 0px; float: none; font-variant-caps: normal; font-variant-ligatures: normal; orphans: 2; text-decoration-color: initial; text-decoration-style: initial; widows: 2; word-spacing: 0px;\">\u00a0admits all<br \/>\njudgments not as res judicata, but as evidence, although they may not be<br \/>\nbetween the same parties, provided they relate to matters of public nature<br \/>\nrelevant to the enquiry.<\/span><\/b><\/span><\/i><\/div>\n<div style=\"margin-left: .25in; text-align: justify;\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"color: black;\"><span style=\"font-family: inherit;\">83. It is obvious that, if the construction which the respondent&#8217;s<br \/>\ncounsel would put upon\u00a0<span style=\"color: black;\">Section<br \/>\n13<\/span>\u00a0is right, there would be no necessity for\u00a0<span style=\"color: black;\">Sections 40<\/span>,\u00a0<span style=\"color: black;\">41<\/span>, and\u00a0<span style=\"color: black;\">42<\/span>\u00a0at all. Those<br \/>\nsections would then only tend to mislead, because the judgments which are made<br \/>\nadmissible under them would all be equally admissible as<br \/>\n&#8220;transactions&#8221; under\u00a0<span style=\"color: black;\">Section 13<\/span>, and not only<br \/>\nthose, but an infinite variety of other judgments which had never before been<br \/>\nadmissible either in this country or in England. And it is difficult to<br \/>\nconceive why, under\u00a0<span style=\"color: black;\">Section<br \/>\n42<\/span>, judgments though not between the same parties should be declared<br \/>\nadmissible so long as they related to matters of a public nature, if those very<br \/>\nsame judgments had already been made admissible under\u00a0<span style=\"color: black;\">Section 13<\/span>, whether they<br \/>\nrelated to matters of a public nature or not.<\/span><\/span><\/i><\/div>\n<div id=\"p_94\" style=\"-webkit-text-stroke-width: 0px; font-variant-caps: normal; font-variant-ligatures: normal; margin-left: .25in; orphans: 2; text-align: justify; text-decoration-color: initial; text-decoration-style: initial; widows: 2; word-spacing: 0px;\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"color: black;\"><span style=\"font-family: inherit;\">84. But then it is<br \/>\nsaid, that\u00a0<span style=\"color: black;\">Section 43<\/span>\u00a0expressly<br \/>\ncontemplates cases in which judgments would be admissible under other sections<br \/>\nof the Act, which are not admissible under\u00a0<span style=\"color: black;\">Sections 40<\/span>,\u00a0<span style=\"color: black;\">41<\/span>\u00a0or 42. This<br \/>\nis quite true. But then I take it, that the cases so contemplated by\u00a0<span style=\"color: black;\">Section 43<\/span>\u00a0are those<br \/>\nwhere a judgment is used not as a res judicata or as evidence more or less<br \/>\nbinding upon an opponent by reason of the adjudication which it contains,<br \/>\n(because judgments of that kind had already been dealt with under one or other<br \/>\nof the immediately preceding sections). <b style=\"mso-bidi-font-weight: normal;\">But<br \/>\nthe cases referred to in\u00a0<span style=\"color: black;\">Section<br \/>\n43<\/span>\u00a0are such, I conceive, as the section itself illustrates,<br \/>\nviz., when the fact of any particular judgment having been given is a matter to<br \/>\nbe proved in the case. As for instance, if A sued B for slander, in saying that<br \/>\nhe had been convicted of forgery, and B justified upon the ground that the<br \/>\nalleged slander was true, the conviction of A for forgery would be a fact to be<br \/>\nproved by B like any other fact in the case, and quite irrespective of whether<br \/>\nA had been actually guilty of the forgery or not. This, I conceive, would be<br \/>\none of the many cases alluded to in\u00a0<span style=\"color: black;\">Section 43<\/span><\/b>.\u201d<\/span><\/span><\/i><\/div>\n<p>\n<span style=\"color: black;\"><span style=\"font-family: inherit;\">In other words, under Section 43, a previous judgement<br \/>\nin an\u00a0<i style=\"mso-bidi-font-style: normal;\">inter<\/i> <i style=\"mso-bidi-font-style: normal;\">partes<\/i> dispute between two or more parties cannot become admissible in<br \/>\nevidence against one of the parties in a subsequent proceeding involving that<br \/>\nparty and a stranger to the earlier proceeding.
