According to experts from The University of North Carolina at Chapel Hill, \u201c[p]eople are drawn to these sensational stories by curiosity about the motivations of the criminals, concerns about justice and the legal system[,] and the thrill of solving a real-life whodunnit.\u201d<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> Fiction: True crime is always accurate in its portrayal of events and\/or people.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/p>\n<p>As the public continues to indulge in true crime and more real-life crimes make it to the screen, ethical questions arise about the impact these shows have on real victims, their families, and others portrayed within them. Additionally, there may be legal concerns with these \u201cfictionalized\u201d and \u201cdramatized\u201d portrayals. Consequently, while true crime may serve as entertainment for some, it can be retraumatizing, harmful, and even defamatory for others.<\/p>\n<p>\u00a0<\/p>\n<p>Netflix is no stranger to the true crime community. Most recently, the streaming giant released the second installment of its <em>Monster<\/em> anthology series, <em>Monsters: The Lyle and Erik Menendez Story<\/em>.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> In 1989, Lyle and Erik Menendez, who were twenty-one and eighteen years old at the time, respectively, fatally shot their parents several times with 12-guage shotguns in their home.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> Initially it was speculated that the murders were a mob hit and that the killers \u201cintended to send a message.\u201d<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> Nonetheless, law enforcement remained suspicious of the brothers, particularly given their nearly $700,000 spending spree following the murders.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> However, it was not until Erik confessed to his therapist, and the events that followed, that the brothers were eventually arrested.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> Thus, at trial, the issue was not whether the brothers did, in fact, kill their parents.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> The issue was <em>why<\/em> they did it.<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a><\/p>\n<p>\u00a0<\/p>\n<p>In essence, the prosecution argued that the murders were premeditated because Lyle and Erik wanted to ensure access to their considerable inheritance.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a> Conversely, the defense contended that the brothers acted in self-defense.<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a> Lyle and Erik both took the stand and detailed the years of sexual, emotional, and physical abuse they endured at the hands of their parents throughout their lives.<a href=\"#_ftn16\" name=\"_ftnref16\">[16]<\/a> They testified that, in the days leading up to the murders, they confronted their parents about the abuse, and tensions escalated to a breaking point.<a href=\"#_ftn17\" name=\"_ftnref17\">[17]<\/a> The brothers believed that their parents intended to kill them on the night of the murders, prompting them to take fatal action first.<a href=\"#_ftn18\" name=\"_ftnref18\">[18]<\/a> Ultimately, after years of litigation, Lyle and Erik Menendez were each convicted on two counts of first-degree murder and were sentenced to life in prison, without parole.<a href=\"#_ftn19\" name=\"_ftnref19\">[19]<\/a><\/p>\n<p>\u00a0<\/p>\n<p>The <em>Monsters<\/em> series is a fictionalized and scripted recount of this case, including the events leading up to the murders, the murder themselves, as well as the subsequent trials.<a href=\"#_ftn20\" name=\"_ftnref20\">[20]<\/a> The story was intentionally told from multiple perspectives to show \u201call points of view\u201d that existed when the real events unfolded.<a href=\"#_ftn21\" name=\"_ftnref21\">[21]<\/a> In the few weeks the show has been out, its reception has been rather controversial.<a href=\"#_ftn22\" name=\"_ftnref22\">[22]<\/a> Erik Menendez has even criticized the show as being a \u201cdishonest portrayal\u201d filled with \u201chorrible and blatant lies.\u201d<a href=\"#_ftn23\" name=\"_ftnref23\">[23]<\/a> Particularly controversial is the show\u2019s suggestion that the brothers may have engaged in an incestuous, sexual relationship.<a href=\"#_ftn24\" name=\"_ftnref24\">[24]<\/a> Ryan Murphy, the co-creator and writer of the show, has defended the series. Murphy said that \u201che did not make a documentary of the brothers\u201d and that he \u201cwas interested in doing something about everybody involved in this case, including the parents and their perspectives.\u201d<a href=\"#_ftn25\" name=\"_ftnref25\">[25]<\/a> Moreover, Murphy said that the show was not \u201cpresenting any of it as truth\u201d but rather \u201cpresenting it as someone\u2019s opinion.\u201d<a href=\"#_ftn26\" name=\"_ftnref26\">[26]<\/a><\/p>\n<p>\u00a0<\/p>\n<p>Notably, on October 24, 2024, the Los Angeles County District Attorney George Gasc\u00f3n announced that he would recommend the resentencing of Lyle and Erik Menendez.<a href=\"#_ftn27\" name=\"_ftnref27\">[27]<\/a> Four days later, the brothers\u2019 defense team submitted their request for clemency to California Governor Gavin Newsom.<a href=\"#_ftn28\" name=\"_ftnref28\">[28]<\/a> District Attorney Gasc\u00f3n has since announced his support for the brothers\u2019 clemency request.<a href=\"#_ftn29\" name=\"_ftnref29\">[29]<\/a> A decision has not yet been rendered.<\/p>\n<p>\u00a0<\/p>\n<p>Although no legal action has been taken against Netflix for its <em>Monsters<\/em> series at this time, claims of falsehoods by individuals depicted in its true crime series are not a new legal issue for the streaming service. In 2015, Netflix released its first true crime docuseries called <em>Making a Murderer<\/em>.<a href=\"#_ftn30\" name=\"_ftnref30\">[30]<\/a> Over the course of two seasons, the series follows the case of Steven Avery, who, in 1985, was wrongfully convicted in Wisconsin of the sexual assault and attempted murder of Penny Beernsten.<a href=\"#_ftn31\" name=\"_ftnref31\">[31]<\/a> After serving eighteen years in prison, Avery, with the aid of the Wisconsin Innocence Project, was exonerated by DNA evidence.<a href=\"#_ftn32\" name=\"_ftnref32\">[32]<\/a> In 2005, just over two years after his release, Avery was arrested for the murder of Teresa Halbach.<a href=\"#_ftn33\" name=\"_ftnref33\">[33]<\/a> A few months later, Avery\u2019s nephew, Brendan Dassey, confessed to participating in the crime, though Dassey later recanted his statement.<a href=\"#_ftn34\" name=\"_ftnref34\">[34]<\/a> Avery was convicted of first-degree intentional homicide, and Dassey was convicted of being party to first-degree intentional homicide, mutilation of a corpse, and second-degree sexual assault.<a href=\"#_ftn35\" name=\"_ftnref35\">[35]<\/a> Both were sentenced to life in prison.<a href=\"#_ftn36\" name=\"_ftnref36\">[36]<\/a><\/p>\n<p>\u00a0<\/p>\n<p>Within thirty-five days of <em>Making a Murderer<\/em>\u2019s release on Netflix, it garnered over nineteen million views<a href=\"#_ftn37\" name=\"_ftnref37\">[37]<\/a> and received considerable media coverage. The show sparked conversations over flaws in the criminal justice system, such as police misconduct<a href=\"#_ftn38\" name=\"_ftnref38\">[38]<\/a> and custodial interrogations,<a href=\"#_ftn39\" name=\"_ftnref39\">[39]<\/a> and intense, online debate over the guilt\u2014or innocence\u2014of Avery and Dassey.<a href=\"#_ftn40\" name=\"_ftnref40\">[40]<\/a> <em>Making a Murderer<\/em> also drew backlash from law enforcement officials portrayed in the show, because the show \u201craised questions about whether [the] Manitowoc County officials framed\u201d Avery and Dassey.<a href=\"#_ftn41\" name=\"_ftnref41\">[41]<\/a> In 2018, the now-former Manitowoc County Sheriff\u2019s Detective Andrew Colborn sued Netflix and the filmmakers for defamation over his portrayal in the series.<a href=\"#_ftn42\" name=\"_ftnref42\">[42]<\/a> Colborn alleged that the docuseries \u201cdistorted the facts, altered testimony[,] and omitted key information to falsely portray [him] as a corrupt officer who planted evidence,\u201d<a href=\"#_ftn43\" name=\"_ftnref43\">[43]<\/a> for example, by \u201cediting snippets of his testimony[] and reactions of others in court to make him appear nervous and uncertain,\u201d among other claims.<a href=\"#_ftn44\" name=\"_ftnref44\">[44]<\/a><\/p>\n<p>\u00a0<\/p>\n<p>Defamation<a href=\"#_ftn45\" name=\"_ftnref45\">[45]<\/a> is a creature of state law, meaning that defamation statutes vary per state.<a href=\"#_ftn46\" name=\"_ftnref46\">[46]<\/a> In Wisconsin, \u201ca defamation plaintiff must show that the defendant (1) published (2) a false, (3) defamatory, and (4) unprivileged statement.\u201d<a href=\"#_ftn47\" name=\"_ftnref47\">[47]<\/a> Additionally, under the First Amendment, public officials are prohibited \u201cfrom recovering damages for a defamatory falsehood relating to [their] official conduct unless [they] prove[] that the statement was made with \u2018actual malice\u2019\u2013that is, with knowledge that it was false or with reckless disregard of whether it was false or not\u201d <a href=\"#_ftn48\" name=\"_ftnref48\">[48]<\/a> and the statement \u201cmust be \u2018of and concerning\u2019 the plaintiff.\u201d<a href=\"#_ftn49\" name=\"_ftnref49\">[49]<\/a> Applying these standards, U.S. District Judge Brett Ludwig granted summary judgment in favor of Netflix and <em>Making a Murderer<\/em>\u2019s filmmakers, concluding that Colborn did not make out a defamation claim and the defendants\u2019 did not act with actual malice.<a href=\"#_ftn50\" name=\"_ftnref50\">[50]<\/a><\/p>\n<p>\u00a0<\/p>\n<p>This year, after five years of litigation, Netflix, Ava DuVernay, and Attica Locke settled a lawsuit with Linda Fairstein over Fairstein\u2019s depiction in the drama miniseries \u201c<em>When They See Us<\/em>.\u201d<a href=\"#_ftn51\" name=\"_ftnref51\">[51]<\/a> This series is based on the events of the 1989 Central Park jogger case that involved the brutal assault of a twenty-eight-year-old white woman, Trisha Meili, in Central Park and the subsequent wrongful convictions of five Black and Latinx boys: Antron McCray, Kevin Richardson, Yusef Salaam, Raymond Santana, and Korey Wise, aged fourteen to sixteen.<a href=\"#_ftn52\" name=\"_ftnref52\">[52]<\/a> The show received critical acclaim,<a href=\"#_ftn53\" name=\"_ftnref53\">[53]<\/a> but Fairstein, the former chief of the Manhattan District Attorney\u2019s Sex Crimes Prosecutions Unit, sued for defamation.<a href=\"#_ftn54\" name=\"_ftnref54\">[54]<\/a> Broadly, Fairstein\u2019s complaint alleged that she was depicted as making \u201cracist and unethical\u201d and \u201cinflammatory\u201d statements that she claimed to have never said, that she was depicted as the \u201csingular mastermind\u201d of the case, that she encouraged the use of \u201cunconstitutional investigative techniques,\u201d and that the show was marketed as a \u201cfact-based version of the events\u201d in \u201csmall font late in the credit rolls.\u201d<a href=\"#_ftn55\" name=\"_ftnref55\">[55]<\/a> Netflix\u2019s motion to dismiss was granted in part and denied in part.<a href=\"#_ftn56\" name=\"_ftnref56\">[56]<\/a> Nonetheless, the suit was ultimately settled, and Netflix agreed to donate one million dollars to the Innocence Project and move the disclaimer to the beginning of each episode.<a href=\"#_ftn57\" name=\"_ftnref57\">[57]<\/a><\/p>\n<p>\u00a0<\/p>\n<p>Netflix is actively involved in another defamation lawsuit over the <em>Inventing Anna<\/em> miniseries, inspired by the story of alleged \u201cGerman heiress\u201d and con-artist Anna Sorokin and Jessica Pressler\u2019s <em>New York Magazine<\/em> article,<a href=\"#_ftn58\" name=\"_ftnref58\">[58]<\/a> \u201cMaybe She Had So Much Money She Just Lost Track of It.\u201d<a href=\"#_ftn59\" name=\"_ftnref59\">[59]<\/a> Rachel DeLoache Williams, a former friend of Sorokin\u2019s who was depicted in the show, brought a defamation suit alleging that she was characterized as \u201cabandoning Sorokin in Morocco and ultimately betraying her to the authorities\u201d and that other statements portrayed her as \u201csnobbish\u201d and \u201cunethical.\u201d<a href=\"#_ftn60\" name=\"_ftnref60\">[60]<\/a> Netflix has argued that the show\u2019s creators had a literary license to tell their interpretation of what happened and that Williams\u2019 portrayal was an opinion.<a href=\"#_ftn61\" name=\"_ftnref61\">[61]<\/a> However, the district court disagreed, finding that some of the characterizations may be defamatory.<a href=\"#_ftn62\" name=\"_ftnref62\">[62]<\/a> It remains to be seen whether Netflix\u2019s creative liberties will withstand this legal challenge.<\/p>\n<p>\u00a0<\/p>\n<p>Courts have recognized that filmmakers are permitted \u201cto advance an opinion-based version of events[] provided that the account has some support in the historical record\u201d<a href=\"#_ftn63\" name=\"_ftnref63\">[63]<\/a> and that viewers are aware \u201csuch programs are more fiction than fact.\u201d<a href=\"#_ftn64\" name=\"_ftnref64\">[64]<\/a> However, as Netflix\u2019s defamation battles show, the line between creative expression and potential defamation is precarious and the profound impact of true crime
